NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted,<br \/>\n     We have learned counsel on both sides.\n<\/p>\n<p>     This appeal  by special leave arises from the judgement<br \/>\nand order  of the  Division  Bench  of\tthe  High  Court  of<br \/>\nAllahabad made on November 1,1995 in W.P. No.30914\/95.\n<\/p>\n<p>     The acquisition  is under\tthe  U.P.  Avas\t Evam  Vikas<br \/>\nParishan Adhiniyam,  1965 .  The controversy  is whether the<br \/>\nLand  Acquisition   act\t 68  of\t 1984  would  apply  to\t the<br \/>\nacquisition made  under the  Adhiniyam. In Gaurishankar Gaur<br \/>\nvs. State  of U.P.[(1994) (1) SCC 921, a bench of two Judges<br \/>\nof this court, to which one of us, K. Ramaswamy, J. had held<br \/>\nthat this  Adhiniyam and  the procedure\t prescribed  therein<br \/>\nvis-a-vis the  Land Acquisition\t Act, 1894   (1\t of 1894) by<br \/>\nincorporation and,  therefore, the  Amendment Act  does\t not<br \/>\napply to  the acquisition  under the Adhiniyam. Hon&#8217;ble R.M.<br \/>\nSahai, J.  had\ttaken  a  different  view  on  that  matter.<br \/>\nHowever, on  merit both\t agreed for shifting of the date for<br \/>\npayment of the compensation to the later date of declaration<br \/>\nas under :\n<\/p>\n<blockquote><p>     &#8220;Though for  different reasons,  we<br \/>\n     have come\tto the\tsame conclusions<br \/>\n     that the  civil  appeals  and  writ<br \/>\n     petitions\tshall  stand  dismissed.<br \/>\n     But the  appellants and petitioners<br \/>\n     shall be  paid compensation  on the<br \/>\n     market rate  prevalent in\tthe year<br \/>\n     the   declaration\t  analogous   to<br \/>\n     section 6\tof the\tLand Acquisition<br \/>\n     Act, 1894\twere issued.  In view of<br \/>\n     the  special   facts  and\tpeculiar<br \/>\n     circumstances and\tnor as of Law we<br \/>\n     have adapted this course.&#8221;<\/p><\/blockquote>\n<p>     Subsequently, the\tquestion was  considered by  another<br \/>\nBench of this Court in <a href=\"\/doc\/471647\/\">U.P. Avas Evam Vikas Parishad Lucknow<br \/>\nvs. Lata Awasthi<\/a> [(1995) 3 SCC 573] wherein it was held that<br \/>\nthe Amendment  Act has\tno application\tsince  some  of\t the<br \/>\nprovisions of the Land Acquisition Act, 1894(1 of 1894) were<br \/>\nincorporated  into   the  Adhiniyam.   The  same   view\t was<br \/>\nreiterated in  <a href=\"\/doc\/164800\/\">Ramesh Chandra  Tiwari &amp;\t ors. vs.  U.P. Avas<br \/>\nEvam Vikas Parishan, Lucknow<\/a> [CA No.1832\/86] decided January<br \/>\n8,1996 by  another   Bench. Under these circumstances, it is<br \/>\nnow settled  law that  the Land Acquisition Amendment Act 68<br \/>\nof  1894,   has\t no   application.  The\t notification  under<br \/>\nAdhiniyam similar  to section  4 and the declaration similar<br \/>\nto Section  6 do  not stand  lapsed after  the expiry of two<br \/>\nyears from  the date  the Amendment Act has come into force.<br \/>\nThe High  Court, therefore,  was right\tin refusing to grant<br \/>\nthe relief.\n<\/p>\n<p>     The Land  Acquisition Officer  is directed\t to pass the<br \/>\naward in  accordance with  law within  a period of six weeks<br \/>\nfrom the  date of  the receipt\tof this\t order. If  the Land<br \/>\nAcquisition Officer  does not  pass the\t award\twithin\tthat<br \/>\nperiod, he should award interest on the amount awarded @ 18%<br \/>\nfrom the  date of  the expiry  of six weeks till the date of<br \/>\nthe  deposit   with  him   of  the   compensation   by\t the<br \/>\nrequisitioning authority. In any event, if the amount is not<br \/>\ndeposited with the Land Acquisition Officer within a further<br \/>\nperiod\tof   three  months  thereafter,\t there\tshall  be  a<br \/>\ndirection to  the State\t Government  to\t withdraw  from\t the<br \/>\nacquisition.\n<\/p>\n<p>     The appeal is accordingly ordered.
