No. 627 of 2011<\/p>\n<p>                            Heard learned counsel for the appellant and<\/p>\n<p>                   State.\n<\/p>\n<p>                            Appellant stands convicted for the offence<\/p>\n<p>                   under section 21(C) and 22(C) of the Narcotic Drugs<\/p>\n<p>                   and Psychotropic Substance Act (hereinafter referred<\/p>\n<p>                   to N.D.P.S. Act) and sentenced to undergo rigorous<\/p>\n<p>                   imprisonment for ten years and pay a fine of Rs.<\/p>\n<p>                   1,00,000\/- (one lac) each and in default of payment<\/p>\n<p>                   further to undergo rigorous imprisonment for two<\/p>\n<p>                   years.\n<\/p>\n<p>                            He along with Deepak Kumar Singh faced<\/p>\n<p>                   trial. Both have been convicted, but recovery of<\/p>\n<p>                   narcotic substance was made from the possession of<\/p>\n<p>                   Deepak    Kumar     Singh    non-appellant.   Nothing<\/p>\n<p>                   incriminating was recovered from the appellant who<\/p>\n<p>                   enjoyed privilege of bail during trial and he is in<\/p>\n<p>                   custody since date of conviction.<\/p>\n<p>                            Considering the facts and circumstances of<\/p>\n<p>                   the case, during the pendency of this appeal, let the<\/p>\n<p>                   appellant namely, Kumar Amit, be released on bail on<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>          furnishing bail bond of Rs. 10,000\/- (ten thousand<\/p>\n<p>          only) with two sureties of the like amount each to the<\/p>\n<p>          satisfaction of Trial Court i.e. Additional Sessions<\/p>\n<p>          Judge, VIIth, Patna, in connection with Special Case<\/p>\n<p>          No. 32 of 2006, arising out of Gandhi Maidan P.S.<\/p>\n<p>          Case no. 182 of 2006.\n<\/p>\n<p>                    During       the   pendency   of   this   appeal,<\/p>\n<p>          realization of fine shall remain stayed.<\/p>\n<pre>Rajeev\/                          ( Akhilesh Chandra, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Kumar Amit vs State Of Bihar on 18 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.
