V\n\nJUDGMEQ1U'V\nThis appeal is preferred by  \"l.=':i' respondent before the\nCommissioner for A V Workm.en\"g._ Corriperisaitiori  challenging the\ncompensation aiyaifded  the 1%' e.re'sip'o'n'dent herein by the\nCommissionerwp ro:f';\u00bbwo\u00a3;&lt;m_\u00e9&#039;ri?s Compensation, Belgaum, in a\n\nsum of   \n\n2. The main Vvcoiiterititsrlifof the appellant is that the 1st\n\n respor1g\u00e9:\u00a7lient~ was  employee of the appellant and therefore\n\n th.e&#039;C,omrnissioner for Workmen&#039;s Compensation could not have\n\nallowedp\u00abtheiiiievlairri&#039;application of the 1st respondent. Therefore,\n\nV the substainti&#039;al&#039;ii question of law that is raised in the appeal is\n\n&quot;iv.ii&#039;co&#039;riCerninig&#039; the employenemployee relationship between the\n\n ap&#039;p_iell&#039;-ant and the 1-St respondent.\n\n%\n\n0&#039;\nla\n\n\n\n3. Sri.Rajendra S. Ankalkoti, learned counsel efor the\n\nappellant referring to the impugned order and to the \n\nof the parties as also the evidence let  bef:o&#039;re&quot;l \n\nCommissioner argued that the appellant &quot;teat,ego.riea&#039;11yl&#039;\n\nstated in his evidence that the 1st reesplondient&quot;herein, \n\nemployed by him and thereforevlthe qulestioneolf_Ath_e&quot;&#039;app:ellantVV\n\nbeing made liable to pay the ec,olmp_en,sation&quot;cloesg\ufb01not arise.\nMoreover, the 1st respondent;\u00a2.la:imar1--t:&#039;: has_enot placed any\ndocumentary evidence  employed by the\nappellant herein:  lvviltrilelsses were examined\non behalf  \u00abi   the \ufb01nding of the\nCommissiionerlll &#039;\u00abi.ereployer--employee relationship is\nerroneousl&quot;-and  evidence on record.
