\nwent to the houae at the ae\u00e9tsee and eaw the dead
\nbody of Sandya: fg\ufb01iie thee w\u00a2r; t;king the dead<\/p>\n
body in 1a tem\ufb01av get \ufb01uetin ifewn, they saw a
\nligature matt.o?e\ufb01”theWneck\u00bband sweiiing of the
\ncheek and the smeli ef ketosene. Therefore, they<\/p>\n
auspectee. that the’ aacused are responsible for<\/p>\n
the death pf Sandya. In the circumstances, they<\/p>\n
:in_ teak *the’ ae$a.tb\u00a7dy- for post-mortem examination<\/p>\n
V\ufb01 and req\ufb01ested the police to take action against<\/p>\n
iii\ufb01e accgsee for causing the death of Sandya. The<\/p>\n

Executive Magistrate to hold the inquest.<\/p>\n
On the next day, in the eetning; he sent to

the village a\u00a2a’\u00a7ha,\u00a2aaa a search for them and<\/p>\n
after tracinevceut iSan\ufb01Y3D {deceased} and Bakaah<\/p>\n
faccused? Nell] hfeught_ them to the village and
\nperfetme\ufb01 _theit*,marriage. She states in the<\/p>\n
complaihg. “that Q”after the marriage, Sandya<\/p>\n
her speoifle versien in the complaint that within<\/p>\n
IlefutheVacQusee. she was assaulted and was asked
\n~ fig tring mehey from her mother i.e., P.W.l. As
\n1″ePa\ufb01Ll*he\ufb02 no money, cellected an amount ef Rs.55~
\nl’\ufb01\u00e9 from the neighbours and sent Sandya {deceased}
\nh’\u00bbte’the house of the accused along with the amount<\/p>\n
\u00bbuof Rs.55wGS. So also, it is in the complaint<\/p>\n

\nrelationship were cordial. She states that rt ls.
\naccused No.1 i.e., the husband er the:ee\u00a2eas\u00e9d,lh
\nhis brother [accused No.Z}a asd  his slstert
\n[accused No.3], who were subjeeting the a\u00e9c\u00e9gga\u00e9
\nto harassment and cruelty and lg thls reear\ufb02 they
\nalso made a request to Vaaega\u00e9a _ho\u00a7}s to treat
\nSandya {deceased} fwith larra\u00a7\u00a3iagj’f\u00b0 It also
\nreveals that whee sangfa geeoeased} eas pregnant,
\nshe was broughtjh\u00a7*E.W;l to her house to perform
\n‘c:h0li’  and the accused
\ntook her badklte thelrghoee on 30.05.1999 i.e.,<\/p>\n
about a eonth priqr to the incident. It is also<\/p>\n
a week after the deceased returned to the house<\/p>\n

evidence that she had sent an amount of Rs.3Qt@Qaih<\/p>\n
aionq with Sandya [decea3ed} when the accused hag f;.*<\/p>\n
sent her to bring the money. It may””i\ufb01fath\u00e9*_<\/p>\n
complaint she stated that ehe odileetedh3\u00a7,55?OO;dx~t<\/p>\n
from the neighbours and stated\u00bb that, sh\u00e9= sent
\nR3.S5~OG along with senayag iaee\u00e9\u00e9sgd] its “the
\nhouse of the accused, i\ufb01_\u00a7\u00a7tg\u00a7;ni\u00a7\u00a7;,\u00a3\u00a7is is a
\nminor diecrepanoy~end ceneeteeerieueiy effect the
\nversion of the eroeeegtieeg _?erther more, P.W.i
\nstates thet~_atr the, \u00a3ie\u00e9A”\u00a7tW_ine death, the
\ndeceased \u00e9andya Qa\u00a7;\u00a7;\u00a7g\ufb01\u00a7nt and she was broeght
\nto her house*tor the eur\ufb01eee of ‘choli ceremony’
\naed she; stayed “there vfor about 5 days and the
\naoeesedr toeh \ufb02her bech and after one week, she<\/p>\n
went to the ho\ufb01se of the accused and she found<\/p>\n
Ihinjury Hon othe} right eye and after an enquiry,<\/p>\n
“‘e$endya {deceased} told her that she was assaulted<\/p>\n
hebyhher_husband. It is no~doubt true that this<\/p>\n
ffaiiegatien is not found in the complaint {Ex.P1],<\/p>\n
h’.bnt, so far as the demand for money and insisting<\/p>\n
Vd.:Sandya [deceased] to bring money from her mother<\/p>\n
s\u00e9<\/p>\n
x”subjecting esandya {deceased} to harassment and
\n‘dferaelty doea not take away the evidence of P.W.1
\nlbao lf\u00a7!_ as the demand fora money and subjecting
\n‘1T3\u00a7\u00a7aya: {deceased} to harassment and crueltyi by
\nV'”vahnse and assault. Further, the perusal of the<\/p>\n
l” levidence of P.W.l does not reveal anything as<\/p>\n

[P.W.l} and subjecting her to cruelty “and\ufb02laa
\nharassment by abusing and assaulting her} V\u00a3h\u00e97=’<\/p>\n
evidence of P.W.l is consistent with the contents ,*<\/p>\n
of the complaint. Though >the lperusal oil the: 3
\nevidence of P.W.1 reveals 5aa\u00a7* exaggeratlont as
\nregards the harassmentr and tereelty, litx is
\nrelevant to note that there as} be aany instances
\nbetween the husbaed. aadh kif\u00a7”;\u00a73g’ it is also
\nprobable that; alg lane iineidentsi of cruelty and<\/p>\n
harassment will not be narrated in the complaint<\/p>\n
at the time: when* the rlnoident of suicide had
\ntaken place *and_ the ocoeplaint was filed after
\nseeing the dead bode bf the mother who certainly
\ngill be iela depressed condition. Therefore, the<\/p>\n
mere~tact that there is an exaggerated version of<\/p>\n
\/.\n<\/p>\n

So far as this version of P.W.2 is concerned,fifWc”,<\/p>\n
the cross~examination is looked into, there _isi=u<\/p>\n
nothing except denying the suggestien ‘and aevend %_?<\/p>\n
the fact of payment of Rs.25ee0o by \u00a7tw.2 tee \ufb02bti.<\/p>\n
been denied in the cross~etaeination;l’*t\u00a7o;[‘ae
\nregards the conduct of.eccueed Negi is cencerned,
\nthe version of P.Ws.1 ae\ufb01ai Q 715 lceneietent and
\ncogent. Further, #\u00a7,W.\ufb01*t%\u00a7\ufb02:te\u00e9iedadggter of the
\nelder brother of \ufb02ea deeg\u00e9\ufb01edgtwhe epeaks about
\nthe love marriadeibetweeei\u00e9aedye [deceased] and
\naccused \ufb01Q.1′ tendtLdais\u00a7]a_states that Sandya
\n{deceased} eee4te11i\ufb01e tee that the Accused No.1
\nand her eieter wexe euejecting her to cruelty and<\/p>\n
harassment \ufb02y abusing and assaulting her and that<\/p>\n
she” had Veeid fee’ amount of Rs.15*OO on one<\/p>\n
Awoccasion and*Re\u00a720–00 on another occasion and she<\/p>\n
*e exec statee: that Sandya {deceased} wee weeping<\/p>\n
4Hdwhiiex_\ufb01arrating the incidents of cruelty and<\/p>\n
.i7aeeauit. Even if the evidence of P.Ws.1 and 4 is<\/p>\n
‘i’.ieeked into, except suggesting that P.W.4 is the<\/p>\n
‘”,fre1ative of the deceased, nothing is elicited in<\/p>\n

\u00a7\u00a2iic<\/p>\n
ih, of the Trial Court is imgroper and unreasonable.<\/p>\n
{icouid be seen from the crosseexamination of these h
\nd:\u00a7witneaaes, there is neither a omission nor a
\n‘*._contradiction. It is not allowed in law to look<\/p>\n
h*cdinto the statement of the witnesses unleas that<\/p>\n

Court is of the opinion that there canno\u00a7mh%e”tLh*
\nharassment for a paltry amount varying from hsb\u00a7;”2
\n00 to Ra.250-~00. Whether the amou’nt’–\u00abi.a
\nbig depends upon the financial \u00a7hnd\u00a3;i\u00a7\ufb01=Qfu\u00a3h\u00a7fa.*
\nparties and the amount demanded in this caaennay'”

a huge amount for” a poo;L.AhuThiau*asnect of the
\nmatter has not been tak\ufb01\ufb01 into g\ufb01naideration by<\/p>\n
the Trial Court a\ufb01a*ae:\u00e91\u00a7,5aa\u00e9aa\u00e9 the amount in
\ndemand is j\u00e9’neagre% the \u00a7:iar’\u00a2\u00a7\ufb01:t holds that
\nthere cannotm he han\ufb01iiharaaamentm and cruelty for
\nsuch amount} the etidenoe in each case has to be
\nlooked into from the angle of the parties which
\nd\u00e9\u00a7e\ufb02dst\ufb01u?\u00e9h._Ehe ‘financial condition of the<\/p>\n
parties} In my considered opinion, the approach<\/p>\n
‘\u00ae_12. ~It is further relevant to note that as<\/p>\n
is<\/p>\n
iheeriouem_ doubtli arises with regard to the<\/p>\n
‘~ poepiioity of accused No.2 in the crime and this<\/p>\n
oTdoubtxhae’go to the benefit of accused No.2.

ii:’attesting’ witness for the inquest {Ex.F3}.<\/p>\n

\nprosecution has made out a Case befoh\ufb01 reasonable

\nP.Ws.1, 2,\u00bb-4_\ufb01enaf*$._is:loonsistent, cogent and<\/p>\n
acceptable; eo fer as accused No.1 is concerned.<\/p>\n
Though except*E.W;i} the rest of the witnesses
\nstate about the Cruelty and harassment by accused<\/p>\n
No.2 as well, as the version of these witnesses<\/p>\n
is iinqgnsietentfaeith the evidence of P.W.1, a<\/p>\n

as to what happens in the home. It may -5 V<\/p>\n
