BASANT, J.\n\n               -------------------------------------------------\n\n                      CRL.M.C.NO. 1512 OF 2007\n\n               -------------------------------------------------\n\n                Dated this the  6th day of June, 2007\n\n\n\n                                   ORDER\n<\/pre>\n<p>      The   petitioners   are   counter   petitioners   in   a   proceedings<\/p>\n<p>initiated   under   Sec.109   of   the   Cr.P.C.   by   the   Sub   Divisional<\/p>\n<p>Magistrate, Thalassery.   The petitioners have come before this<\/p>\n<p>Court with a prayer that the proceedings against them may be<\/p>\n<p>quashed.\n<\/p>\n<\/p>\n<p>      2.    What  are   the   reasons   to   justify   the   invocation   of   the<\/p>\n<p>powers   under   Sec.482   of   the   Cr.P.C.?       Two   grounds   are<\/p>\n<p>raised.     First   of   all,   the   learned   counsel   for   the   petitioners<\/p>\n<p>contends that they are not the residents within the jurisdiction<\/p>\n<p>of the  Sub Divisional Magistrate, Thalassery, who has initiated<\/p>\n<p>the   proceedings   and,   in   these   circumstances,   the     Sub<\/p>\n<p>Divisional   Magistrate   lacks   the   territorial   jurisdiction   to   pass<\/p>\n<p>the order.\n<\/p>\n<\/p>\n<p>      3.     After   discussions   at   the   Bar,   the   learned   counsel   for<\/p>\n<p>the   petitioners   does   not   press   that   contention.       It   is   evident<\/p>\n<p><span class=\"hidden_text\"> CRL.M.C.NO. 1512 OF 2007  -: 2 :-<\/span><\/p>\n<p>that the apprehended mischief falls within the  jurisdiction of the<\/p>\n<p>Sub   Divisional   Magistrate,   Thalassery   and   in   these<\/p>\n<p>circumstances,   the   mere   fact   that   the   petitioners   are   not<\/p>\n<p>residents within  the jurisdiction of the Magistrate cannot affect<\/p>\n<p>the jurisdiction of the  Sub Divisional Magistrate.<\/p>\n<p>        4.   Secondly,   it   is   contended   that   the   allegations   are<\/p>\n<p>unacceptable  and  do  not   constitute   sufficient  ground  to  initiate<\/p>\n<p>the   proceedings.       I   shall   scrupulously   avoid   any   expression   of<\/p>\n<p>opinion on merits.     The learned Public Prosecutor submits that<\/p>\n<p>the   proceedings   have   already   started   and   the   principal   witness<\/p>\n<p>has   already   been   examined   and   is   remaining   in   the   box   cross-<\/p>\n<p>examined in part.  I am, in these circumstances, satisfied that no<\/p>\n<p>orders   invoking   the   extraordinary   inherent   jurisdiction   under<\/p>\n<p>Sec.482 of the Cr.P.C. need be passed in the matter.<\/p>\n<p>        5.      This  Crl.M.C. is, in  these circumstances, dismissed.   I<\/p>\n<p>may hasten to observe that the dismissal of this Crl.M.C. will not<\/p>\n<p>in any way fetter the rights of the petitioners to raise all relevant<\/p>\n<p>and   appropriate   contentions   before   the               Sub   Divisional<\/p>\n<p>Magistrate.\n<\/p>\n<\/p>\n<p>                                                           Sd\/-<\/p>\n<pre>\n\n\n                                                 (R.
