Justice KURIAN JOSEPH\n\n Dated :19\/10\/2006\n\n O R D E R\n                             KURIAN JOSEPH, J.\n                              -------------------------\n                         O.P.No. 14518 OF 2003\n                             --------------------------\n                    Dated this the 19th October, 2006\n\n                               J U D G M E N T\n<\/pre>\n<p>      The writ petition is filed with the following prayers:-\n<\/p>\n<p>              i)     Issue a writ in the nature of mandamus directing<br \/>\n      the first respondent to consider Ext.P4 on merits expeditiously<br \/>\n      after   due   notice   to   the   petitioner   and   affording   him   a<br \/>\n      reasonable opportunity of being heard;\n<\/p>\n<p>      ii)     issue   a   writ   in   the   nature   of   mandamus   directing   the<br \/>\n      respondents   to   consider   the   petitioner   for   promotion   to   the<br \/>\n      post of Regional Officer in the second respondent Corporation<br \/>\n      in the retirement vacancy that arose on 1.6.2002.\n<\/p>\n<p>      iii)    declare that prior approval of either the first respondent<br \/>\n      or the  committee  of  Secretaries   is not  required  for  effecting<br \/>\n      promotion  to  the  retirement  vacancy  in the  post  of Regional<br \/>\n      Officer.\n<\/p>\n<p>      It   is   submitted   that   pursuant   to   the   interim   order   in<\/p>\n<p>C.M.P.No.24357\/2003, petitioner has been promoted. Therefore,<\/p>\n<p>the surviving grievance is only with regard to the retrospective<\/p>\n<p>effect of promotion and other ancillary  benefits.
