NALINI JHA\n                                    Versus\n                              THE STATE OF BIHAR\n                                 -----------\n<\/pre>\n<p>2.   27.01.2011.                Heard.\n<\/p>\n<p>                                The prayer of the petitioner is to<\/p>\n<p>                   quash the order dated 2.11.2010 passed by the<\/p>\n<p>                   Chief     Judicial         Magistrate,        Muzaffarpur     in<\/p>\n<p>                   Mithanpura      P.S.Case        No.72    of    2001.   It   was<\/p>\n<p>                   submitted as one of the grounds for seeking<\/p>\n<p>                   the     order       that     two     accused    persons     are<\/p>\n<p>                   already       facing         trial    after     having      been<\/p>\n<p>                   summoned eight years back and after such a<\/p>\n<p>                   long gap the police was placing supplementary<\/p>\n<p>                   chargesheet along with the case diary sending<\/p>\n<p>                   up the petitioner for trial. It was contended<\/p>\n<p>                   that truly speaking,               there was no material<\/p>\n<p>                   contained in the supplementary case diary so<\/p>\n<p>                   as to justifying the passing of the order. It<\/p>\n<p>                   was contended that no offence could be said<\/p>\n<p>                   to be made out on perusal of the material<\/p>\n<p>                   placed before the court. The last contention<\/p>\n<p>                   was that the court was passing the order in a<\/p>\n<p>                   mechanical      manner        without    referring     to   any<\/p>\n<p>                   part    of    the     case    diary,    specially,     in    its<\/p>\n<p>                   paragraph so as to justifying the requirement<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>of summoning the petitioner.\n<\/p>\n<p>           It     may         be      pointed           out         that<\/p>\n<p>supplementary case diary is the part of the<\/p>\n<p>main    case     diary       and     when    a     supplementary<\/p>\n<p>chargesheet, as we call it, is filed in cases<\/p>\n<p>in which the police has kept investigation<\/p>\n<p>pending against any accused, the court has to<\/p>\n<p>peruse the main part of the case diary which<\/p>\n<p>could    have         been     submitted          earlier          while<\/p>\n<p>filing     the        chargesheet.          It    may        be    very<\/p>\n<p>difficult       for     this       court    to     consider            the<\/p>\n<p>whole    of     the    case    diary       for    examining            the<\/p>\n<p>correctness       or     otherwise          of     the       impugned<\/p>\n<p>order,     more        so,     the    petitioner             has       the<\/p>\n<p>opportunity       of    agitating           the     point         of    no<\/p>\n<p>offence made out or there being absolutely no<\/p>\n<p>material        justifying           the     trial           of        the<\/p>\n<p>petitioner by the court of Sessions when she<\/p>\n<p>is called upon to make upon her submission<\/p>\n<p>under Section 227 and 228 of the Cr.P.C. It<\/p>\n<p>may be pointed out that no sufficient grounds<\/p>\n<p>for framing a charge or sufficient materials<\/p>\n<p>justifying       the     inference          that        an    offence<\/p>\n<p>exclusively triable by the court of Sessions<\/p>\n<p>could be held only by making reference to the<\/p>\n<p>materials       contained       in    the        case    diary.         If<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>        there is no material then naturally there may<\/p>\n<p>        not be any inference raised. If there is no<\/p>\n<p>        offence made out or if the complicity of a<\/p>\n<p>        person    is    not       indicated        on   the    scale    of<\/p>\n<p>        sufficiency of materials then no such accused<\/p>\n<p>        could be tried by a court of Sessions as may<\/p>\n<p>        appear from the very provisions contained in<\/p>\n<p>        Sections 227 and 228 of the Cr.P.C.<\/p>\n<p>                  I direct the court of Sessions which<\/p>\n<p>        could     be        hearing         the    petitioner        under<\/p>\n<p>        Sections 227 and 228 of the Cr.P.C. to go<\/p>\n<p>        into    those       details     as     required   to    be     gone<\/p>\n<p>        into     regarding            the     constitution      of     the<\/p>\n<p>        offence        or        the        participation      of      the<\/p>\n<p>        individual like the petitioner and pass the<\/p>\n<p>        impugned order.\n<\/p>\n<p>                  With          the    above      observations,        this<\/p>\n<p>        petition is dismissed.\n<\/p>\n<\/p>\n<pre>B.Kr.
