This
\n\tpetition, under Article 226 of the Constitution of India, has been
\n\tpreferred with the following prayers:-\n<\/p>\n
“(A)\tThe
\nHon’ble court may please to admit and allow this petition.\n<\/p>\n
(B)\tThe
\nHon’ble court may pleased to issue writ of mandamus or writ in nature
\nof mandamus or writ in nature of mandamus or any other appropriate
\nwrit, order direction directing the respondent authority to issue a
\nfresh passport.\n<\/p>\n
(C)\tThe
\nHon’ble Court may be pleased to grant any other and further relief
\nin the interest of justice.”\n<\/p>\n
Briefly
\n\tstated, the facts of the case are that the Regional Passport
\n\tOfficer, Ahmedabad, issued a Passport to the petitioner in the year
\n\t1997, which was valid for a period of ten years. The said Passport
\n\texpired in the year 2007. The petitioner applied for issuance of a
\n\tfresh Passport which has been issued on 15.11.2007. The said
\n\tPassport was valid for a period of ten years, and is to expire on
\n\t14.11.2017. Meanwhile, the petitioner received letter dated
\n\t14.03.2008 from the respondent – Regional Passport Officer,
\n\tAhmedabad, directing him to surrender the Passport, as a criminal
\n\toffence under the provisions of Sections 307, 325, 124 of the Indian
\n\tPenal Code has been registered against him vide C.R.-I No.202\/1999
\n\tat Sola Police Station, in respect of which Sessions Case No.90 of
\n\t2000 is pending before the learned Sessions Judge (Ahmedabad Rural).
\n\tA cross criminal complaint filed by the petitioner against the rival
\n\tgroup is also pending. According to the respondent, these details
\n\twere not mentioned by the petitioner in the application for issuance
\n\tof a fresh Passport in the year 2007, necessitating issuance of the
\n\tabove-mentioned letter. The petitioner surrendered the Passport to
\n\tthe respondent-authority on 09.04.2008. By letter dated 08.02.2010,
\n\tthe petitioner has been informed that his file has been closed due
\n\tto non-compliance of the conditions mentioned in letter dated
\n\t14.03.2008. The conditions, interalia stipulate that the petitioner
\n\tshould furnish a certified copy of the Court judgment if the case is
\n\tdecided, or the permission of the Court, permitting him to go out of
\n\tIndia. The petitioner has also been directed to pay a penalty of
\n\tRs.5,000\/-. It is in this background that the petitioner has
\n\tapproached this Court, by making the prayers reproduced hereinabove.\n<\/p>\n
I
\n\thave heard Mr.Dhaval N.Vakil, learned advocate for the petitioner,
\n\tMr.Y.V.Vaghela, learned Central Government Standing Counsel for the
\n\trespondent and perused the averments made in the petition and the
\n\tdocuments annexed thereto.\n<\/p>\n
When
\n\tthe petition is take up for admission\/ hearing today, attention of
\n\tthis Court is drawn to a judgment of this Court in the case of
\n\tDhiren Baxi, Chartered Accountant v. Regional Passport
\n\tOfficer, Ahmedabad<\/a>
\n\treported in 2003(1) GLH 1.\n<\/p>\n
\tThe learned advocate for the petitioner has submitted that in view
\n\tof the principles of law enunciated in the abovementioned case, the
\n\tCompetent Authority is not debarred from considering the application
\n\tof the petitioner for grant of fresh Passport during the pendency of
\n\tthe criminal case. It is stated by the learned advocate for the
\n\tpetitioner that the petitioner shall pay the penalty of Rs.5,000\/-,
\n\tas imposed by communication dated 14.03.2008, and thereafter shall
\n\tmake an application to the respondent-authority, who may be directed
\n\tto consider the same, in accordance with law.\n<\/p>\n
Mr.Y.V.Vaghela,
\n\tlearned Central Government Standing Counsel, has submitted that in
\n\tthe event that the petitioner pays the penalty of Rs.5,000\/- and
\n\tmakes an application for the issuance of a fresh Passport, the
\n\tCompetent Authority shall consider and decide  the same, in
\n\taccordance with law. However, appropriate directions may be issued
\n\tfor surrendering the Passport
\n\tbefore the Trial Court and taking permission of the Trial Court in
\n\tcase the petitioner is desirous of travelling abroad.\n<\/p>\n
\tHaving
\n\theard the learned advocates for the respective parties and upon the
\n\tabove statements being made at the Bar on behalf of the respective
\n\tparties, the following order is passed:\n<\/p>\n
(I)\tThe
\npetitioner shall deposit Rs.5,000\/- as penalty in terms of
\ncommunication dated 14.03.2008 before the respondent-authority,
\naccompanied by an application for issuance of a fresh Passport,
\nwithin a period of fifteen days from today.\n<\/p>\n
(II)\tOn
\nreceipt of the penalty and application, the Competent Authority shall
\nconsider the application of the petitioner, in accordance with law,
\nand take further necessary action for issuance of Passport, within a
\nperiod of six weeks from the date of receipt of the application and
\namount of Rs.5,000\/- from the petitioner.\n<\/p>\n
(III)\tIn
\nthe event that a fresh Passport is issued
\nto the petitioner, the petitioner shall deposit the same, by way of
\nan application, before the Trial Court, within a period of one week
\nfrom the issuance thereof.\n<\/p>\n
(IV)\tIf
\nthe petitioner is desirous of travelling abroad, he shall make an
\napplication to the concerned Trial Court, which shall pass
\nappropriate orders thereupon.\n<\/p>\n
It
\n\tis made clear that this Court has not entered into the merits of the
\n\tcase.\n<\/p>\n
The
\n\tpetition is disposed of in the above terms. Notice is discharged.\n<\/p>\n
Direct
\n\tService of this order is permitted.\n<\/p>\n
