Civil Application<br \/>\n\tNo.18 of 2008 that the applicant shall satisfy the dues of<br \/>\n\tRs.2,25,000\/- of the principal amount and at that time, Mr. B. K.<br \/>\n\tRaj, learned advocate appearing for the applicant has agreed that if<br \/>\n\tthe amount is received, the application moved by him being OJ Civil<br \/>\n\tApplication No. 136 of 2008 no longer survived.  Subsequent to this,<br \/>\n\tShri Hari Appliances Private Limited, applicant of Misc. Civil<br \/>\n\tApplication No.18 of 2008 has taken out the Demand Draft of<br \/>\n\tRs.2,25,000\/- and zerox copy of the said Demand Draft was forwarded<br \/>\n\tto the present applicant.  However, the original Demand Draft was<br \/>\n\tnot received and hence, the present application is moved.  Original<br \/>\n\tdemand draft is still not traceable.  Mr. Malkan has, therefore,<br \/>\n\ttaken out another demand draft in lieu of the original draft for<br \/>\n\tRs.2,25,000\/- in favour of the present applicant.  The present<br \/>\n\tapplicant has also filed an affidavit before this Court today<br \/>\n\tstating therein that he would not have any objection if the original<br \/>\n\tdemand draft is cancelled and he has also authorized them to<br \/>\n\tinitiate proceedings for its cancellation.\n<\/p>\n<p>\tIn<br \/>\n\tview of the above affidavit, the original demand draft is required<br \/>\n\tto be cancelled and for that purpose, the present opponent i.e. Shri<br \/>\n\tHari Appliances Private Limited shall intimate to the Bank for its<br \/>\n\tcancellation.  The duplicate Demand Draft which is presented to the<br \/>\n\tCourt is handed over to Mr. B. K. Raj, learned advocate appearing<br \/>\n\tfor the applicant.\n<\/p>\n<p>\tSince<br \/>\n\tthe grievance of the present applicant is fully redressed on receipt<br \/>\n\tof the draft, nothing remains in the present application.
