Justice M.SASIDHARAN NAMBIAR\n\n Dated :15\/01\/2007\n\n O R D E R\n                     M.Sasidharan Nambiar,J.\n\n\n\n                   C.R.P.No.261 of 2006\n\n\n\n      Dated, this the 15\n                             th\n\n                                    day of January, 2007\n\n\n\n\n                          O R D E R\n<\/pre>\n<p>       State   is   challenging   the          proceedings   of<\/p>\n<p>  Taluk   Land   Board   dated   11.12.03   whereunder,<\/p>\n<p>  holding   that   State   Land   Board   had   declared<\/p>\n<p>  respondent Institution as a religious institution<\/p>\n<p>  of   public   nature,   Taluk   Land   Board     dropped   the<\/p>\n<p>  proceedings   initiated   against   the   respondent<\/p>\n<p>  under section 85 of Kerala Land Reforms Act.\n<\/p>\n<p>     2.     The   Taluk   Land   Board,   Mananthavady   had<\/p>\n<p>originally   initiated   ceiling   case   SMC   480\/77   to<\/p>\n<p>surrender   8.72   acres.   Case   was   reopened   as   there<\/p>\n<p>was   no   evidence   to   prove   that   respondent   is   a<\/p>\n<p>religious   and   charitable   institution.     Thereafter<\/p>\n<p>Taluk   Land   Board   as   per   impugned   order   dated<\/p>\n<p>11.12.03   held   that     State   Land   Board   proceedings<\/p>\n<p>dated   31.8.71   available   in     old   Taluk   Land   Board<\/p>\n<p>files   show   that   State   Land   Board   had   declared<\/p>\n<p><span class=\"hidden_text\">CRP 261\/06                             2<\/span><\/p>\n<p>respondent   institution   as   a   religious   institution<\/p>\n<p>of     public   nature   and   therefore   dropped   further<\/p>\n<p>proceedings in the   ceiling case.\n<\/p>\n<p>      3.     Learned   Government   pleader   and   learned<\/p>\n<p>counsel appearing for respondent were heard.\n<\/p>\n<p>      4.     Learned   Government   pleader   submitted   that<\/p>\n<p>Explanation   to   Section   98A   of   Kerala   Land   Reforms<\/p>\n<p>Act  mandates  that  neither  the  Taluk  Land  Board  nor<\/p>\n<p>State   Land   Board   is   competent   to   decide   the<\/p>\n<p>question           whether         respondent         is         a         religious<\/p>\n<p>institution and   that question can be decided only<\/p>\n<p>by State Government and therefore impugned order is<\/p>\n<p>to   be   quashed.   Learned   counsel   appearing   for<\/p>\n<p>respondent   argued   that   under   sub   section   (2)   of<\/p>\n<p>Section 65, Taluk Land Board is competent to decide<\/p>\n<p>the   question   whether   respondent   is     a   religious<\/p>\n<p>institution   of   a   public   nature   and   therefore   the<\/p>\n<p>order   is   not   be   quashed.     It   was   also   argued   that<\/p>\n<p>respondent   is   a   Wakf   as   is   clear   from   Gazette<\/p>\n<p>Notification    and  therefore  revision  is  only  to  be<\/p>\n<p>dismissed.\n<\/p>\n<p><span class=\"hidden_text\">CRP 261\/06                      3<\/span><\/p>\n<p>     5.     Section   65   provides   special   provisions<\/p>\n<p>relating   to   religious   charitable   or   educational<\/p>\n<p>institution   of   public   nature.   Under   the   said<\/p>\n<p>section   Land   Board   is   competent   to   decide   an<\/p>\n<p>application   filed   before   it   to   choose   whether   the<\/p>\n<p>right,   title   ,   interest   of   institution   in   respect<\/p>\n<p>of holding   should be vested in the Government   in<\/p>\n<p>consideration   of   the     payment   of   an   annuity     in<\/p>\n<p>perpetuity  by the Government  or whether it should<\/p>\n<p>be  paid  such  annuity  by  the  Government,  instead  of<\/p>\n<p>purchase   price.   in   case   the   holding     is   purchased<\/p>\n<p>by   cultivating   tenant   under   the   provisions   of   the<\/p>\n<p>Act.   It has no application with regard to Chapter<\/p>\n<p>III   dealing   with   the   ceiling   provisions.   Section<\/p>\n<p>98A   provides   that   for   the   purpose   of   Chapter   III<\/p>\n<p>the term &#8216;person&#8217;  shall not include a Co-operative<\/p>\n<p>Society   or   an   institution   of   a     public   nature   for<\/p>\n<p>religious   or   charitable   purposes   established   and<\/p>\n<p>maintained   by   a   religious   denomination     or   any<\/p>\n<p>Section   thereof   or   Board   of   Trustees   for   the<\/p>\n<p>improvements   of   city   of   Trivandrum   constituted<\/p>\n<p><span class=\"hidden_text\">CRP 261\/06                            4<\/span><\/p>\n<p>under   section   3   of   Trivandrum   City   Improvement<\/p>\n<p>Trust   Act   1960.     Explanation   makes   the   position<\/p>\n<p>absolutely clear.  It reads:-\n<\/p>\n<blockquote><p>       &#8220;If   any   question   arises   as   to<\/p>\n<p>       whether   an   institution   is   an<\/p>\n<p>       institution of a public nature<\/p>\n<p>       for   religious   and   charitable<\/p>\n<p>       purposes            maintained                by         a<\/p>\n<p>       religious   denomination   or   any<\/p>\n<p>       section   thereof,   the   question<\/p>\n<p>       shall         be         decided         by         the<\/p>\n<p>       Government   and   such   decision<\/p>\n<p>       shall be final.\n<\/p><\/blockquote>\n<p>Therefore under section 98A when any question arise<\/p>\n<p>as to whether an institution is an institution of a<\/p>\n<p>public nature for religious and charitable purposes<\/p>\n<p>maintained   by   a   religious   denomination   or   any<\/p>\n<p>section   thereof,   that   question   shall   be   decided   by<\/p>\n<p>Government and not by Taluk land Board or by State<\/p>\n<p>Land   Board   and   such   decision   of   the   Government<\/p>\n<p><span class=\"hidden_text\">CRP 261\/06                       5<\/span><\/p>\n<p>shall   be   final.     The   question   has   been   considered<\/p>\n<p>by   a   learned   single   Judge   (as   His   Lordship   then<\/p>\n<p>was)   of   this   Court     in  Mother  Superior   v.   Taluk<\/p>\n<p>Land   Board     (1989   (1)  KLT   267.)     It   was   held   that<\/p>\n<p>Taluk   Land   Board   is   not   competent   to   decide   that<\/p>\n<p>question   without   referring   the   matter   to   the<\/p>\n<p>government.  That exactly is the position herein.\n<\/p>\n<p>     6. The impugned order is   quashed.
