PRABHARI MAHILA PRAVESIKA RATHUNATHPUR, PANCHAYAT,\n         P.O-RAGHUNATHPUR, P.S0- KESARIYA, DISTT- EAST\n         CHAMPARAN\n                              -----------\n<\/pre>\n<p>2.   16.8.2010                Heard learned counsel for the petitioners and<\/p>\n<p>                 the State.\n<\/p>\n<p>                              Aggrieved by their termination from the post<\/p>\n<p>                 of Aganwari Sewika,     issued by the District Programme<\/p>\n<p>                 Officer on 6.1.2009, the petitioners preferred an Appeal<\/p>\n<p>                 Case No. 40 of 2008 before the District Magistrate.     A<\/p>\n<p>                 specific statement has been made in Paragraph-4 of the<\/p>\n<p>                 memo of appeal that the termination was without a show<\/p>\n<p>                 cause notice.\n<\/p>\n<p><span class=\"hidden_text\">                              2<\/span><\/p>\n<p>                      Learned counsel for the petitioners submits<\/p>\n<p>           that this specific ground taken in the memo of appeal<\/p>\n<p>           finds no consideration or discussion in the appellate<\/p>\n<p>           order dated 30.11.2009.\n<\/p>\n<p>                      Since this order is being passed on the first<\/p>\n<p>           date itself without a counter affidavit by the District<\/p>\n<p>           Magistrate, the impugned order dated 30.11.2009 is set<\/p>\n<p>           aside and the matter is remanded to the District<\/p>\n<p>           Magistrate to pass a fresh reasoned and speaking order<\/p>\n<p>           limited to this issue in light of the judgment of this Court<\/p>\n<p>           in 2004(2) PLJR 833. If no show cause notice was issued<\/p>\n<p>           before termination, the District Magistrate is obliged to<\/p>\n<p>           reinstate the petitioner without prejudice to proceed<\/p>\n<p>           afresh in accordance with law.\n<\/p>\n<p>                      Let this order be complied with within a<\/p>\n<p>           maximum period of four weeks from the date of<\/p>\n<p>           receipt\/production of a copy of this order and fresh order<\/p>\n<p>           in accordance with law be passed within the same period.<\/p>\n<p>                      The application stands allowed.\n<\/p>\n<\/p>\n<pre>P.
