Suit No.<br \/>\n1223 of 2010 filed by the opponent-original respondent from the<br \/>\nFamily Court at Ahmedabad to the Court of Civil Judge, Senior<br \/>\ndivision at Anjar-Kutch.\n<\/p>\n<p>\tLearned<br \/>\nadvocate for the applicant has contended that the applicant has to<br \/>\ntravel approximately 6 to 7 hours for attending the proceedings of<br \/>\nH.M.P. Suit No. 1223 of 2010 filed by the opponent at Family Court,<br \/>\nAhemadabad. Further, the applicant has four years old son and she has<br \/>\nbeen deserted by the opponent.  The applicant has filed maintenance<br \/>\nproceedings vide Criminal Misc. Application No. 108 of 2010 before<br \/>\nthe Judicial Magistrate, First Class, Anjar at Kutch. Keeping in mind<br \/>\nthe fact that the applicant has four years old child and she has to<br \/>\ntravel 6 to 7 hours from Anjar to Ahmedabad, it will be appropriate<br \/>\nto transfer the proceedings of H.M.P. Suit No. 1223 of 2010 filed by<br \/>\nthe opponent-original respondent from the Family Court at Ahmedabad<br \/>\nto the Court of Civil Judge, Senior division at Anjar-Kutch.<br \/>\nAccordingly, H.M.P. Suit No. 1223 of 2010 filed by the opponent in<br \/>\nthe Family Court at Ahmedabad shall be transferred to the Court of<br \/>\nCivil Judge, (Senior Division), Anjar-Kutch. The trial Court may hear<br \/>\nboth the proceedings together.
