Heard the learned counsels for the<\/p>\n<p>                   petitioner and the State.\n<\/p>\n<p>                              The petitioner being the husband is<\/p>\n<p>                   apprehending his arrest in which on protest<\/p>\n<p>                   the cognizance has been taken under Sections<\/p>\n<p>                   304B, 201\/34 of the Indian Penal Code.<\/p>\n<p>                              It     is      submitted          that      during<\/p>\n<p>                   investigation the accusation was found false<\/p>\n<p>                   and the victim died due to diarrhoea when<\/p>\n<p>                   the final form was submitted as a mistake of<\/p>\n<p>                   fact on 05.12.2007 and protest was filed on<\/p>\n<p>                   12.12.2007. It appears that for occurrence<\/p>\n<p>                   of     17.09.2007      the      F.I.R.   was     lodged      on<\/p>\n<p>                   02.10.2007. It is further submitted that out<\/p>\n<p>                   of    wedlock     there    is    a    male   child    who    is<\/p>\n<p>                   still residing with the petitioner.<\/p>\n<p>                              Considering the fact that accusation<\/p>\n<p>                   was    found     false    during      investigation,        let<\/p>\n<p>                   the petitioner, above named, be released on<\/p>\n<p>                   bail in the event of                 arrest or      surrender<\/p>\n<p>                   before     the    learned       court    below      within    a<\/p>\n<p>                   period      of    twelve        weeks    from    today       in<\/p>\n<p>                   connection with complaint case no. C1-1017<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>        of    2008     on       furnishing     bail      bond       of<\/p>\n<p>        Rs.10,000\/-(Ten Thousand) with two sureties<\/p>\n<p>        of the like amount each to the satisfaction<\/p>\n<p>        of   the    learned     S.D.J.M.,     Sitamarhi     Sadar,<\/p>\n<p>        subject to the conditions as laid down under<\/p>\n<p>        Section      438(2)     of   the     Code   of     Criminal<\/p>\n<p>        Procedure.\n<\/p>\n<p>                    Learned     court      below    will    be      at<\/p>\n<p>        liberty to cancel the bail of the petitioner<\/p>\n<p>        if    the     petitioner        defaults      for    three<\/p>\n<p>        consecutive occasions during trial.<\/p>\n<pre>U.
