CJM., Puttur, DK. in M.C.No. 10\/04 which is\n~, produced as per Annexure~A, etc.,.\n\n\n\nW.P.NO. 1 7259 g 2007\n\nThis Writ Petition coming on for Preliminary Hearing in\n&#039;B&#039; Group this day. the Court made the fonowing: 7 \n\nORDER\n<\/pre>\n<p>This Writ Petition by the <\/p>\n<p>against an interlocutory order <\/p>\n<p>passed by the Court of the-.___Addit.ion_a1  <\/p>\n<p>[Sr.Dn.], Puttur on I.A.I \ufb01led: :n_ 1\\}I;-c.:N\u00a7.1o\/2004.<br \/>\nM.C.No.1()\/2004 has   petitioner for<\/p>\n<p>restitution of conjugal rightsgj &#8216;<\/p>\n<p>2. By the   trial Court has awarded<br \/>\nan Rs.5,&#8217;O'(}t0\/&#8211; per month to the<br \/>\nrespondentfverife a.nd&#8217;:_:h_er.\/,ti&gt;\\rr\u00a7.~-&#8216;cI:1i1dren&#8211;a daughter and a<\/p>\n<p>son; it_iS stated that Atheisdaughter is studying in \ufb01nal<\/p>\n<p> year enginieer&#8217;ing Course and the son is studying in first<\/p>\n<p>year..engin&#8217;eerin&#8217;g.Veourse. Further, the petitioner is also<\/p>\n<p>  directed  AI\u00a7s.5,O00\/~ towards litigation expenses.<\/p>\n<p>   Vddfljiave heard the learned Counsel appearing for the<\/p>\n<p>  and perused the impugned order.<\/p>\n<p>\u00a31\u00bb: \/<br \/>\nY5&#8217;<\/p>\n<p>&#8216;vV.P.NO.17259g2007\n<\/p>\n<p>-3&#8243;\n<\/p>\n<p>4. Learned Counsel appearing for the petitioner in<\/p>\n<p>support of the writ petition submitted thatellthae<\/p>\n<p>respondent has her own income from the land&#8221;&#8216;bearirig___<\/p>\n<p>Sy.No.l36 and hence the   it<\/p>\n<p>unsustainable in law.\n<\/p>\n<p>5. The trial Court has found-that lthoixgh  <\/p>\n<p>land is in the name of the respondent, it is  &#8216;possession<br \/>\nand enjoyment of the peti.ti&#8217;oner.   C&#8217; V<\/p>\n<p>6.
