{"id":92415,"date":"2009-04-01T00:00:00","date_gmt":"2009-03-31T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/sheetal-singh-vs-fateh-singh-on-1-april-2009"},"modified":"2015-01-14T20:41:54","modified_gmt":"2015-01-14T15:11:54","slug":"sheetal-singh-vs-fateh-singh-on-1-april-2009","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/sheetal-singh-vs-fateh-singh-on-1-april-2009","title":{"rendered":"Sheetal Singh vs Fateh Singh on 1 April, 2009"},"content":{"rendered":"<div class=\"docsource_main\">Rajasthan High Court &#8211; Jodhpur<\/div>\n<div class=\"doc_title\">Sheetal Singh vs Fateh Singh on 1 April, 2009<\/div>\n<pre>S.B.CIVIL REVISION PETITION NO.314\/2008- Sheetal Singh vs. Fateh Singh   Order dt: 1.4.2009\n\n\n                                             1\/5\n\n\n              S.B.CIVIL REVISION PETITION NO.314\/2008\n                     (Sheetal Singh vs. Fateh Singh)\n\n                           DATE OF ORDER : 1.4.2009\n\n                HON'BLE DR.JUSTICE VINEET KOTHARI\n\n\nMr.Ramandeep Singh, for the petitioner.\nMr.Hemant Jain, for the respondent.\n\n\n        Heard learned counsels.\n\n\n        This revision petition is directed against the order dated\n\n11\/7\/2008, whereby, the trial court has held that the agreement dated\n\n24\/5\/2005 in the suit for specific performance, even though not being\n\nregistered, could be admitted in evidence and, therefore, objection\n\nraised by the defendant was not justified and hence application filed\n\nby the defendant was rejected.\n\n\n\n        Learned counsel for the petitioner submits that even though the\n\nagreement in question is not registered, since it was not adequately\n\nstamped, same could not be admitted in evidence. He relied on the\n\ndecision of this Court in case of Smt.Jamna Bai vs. Tulsi Ram -\n\nAIR 1997 Rajasthan 85.\n S.B.CIVIL REVISION PETITION NO.314\/2008- Sheetal Singh vs. Fateh Singh   Order dt: 1.4.2009\n\n\n                                             2\/5\n\n\n        On the other hand, learned counsel for the respondent relied\n\nupon the decision of this Court in case of Chandra Pal Singh vs.\n\nSmt.Nani Bai. &amp; Anr. - 2008 (2) WLN 98 (Raj.) and of Supreme\n\nCourt in case of <a href=\"\/doc\/534167\/\">Shyamal Kumar Roy vs. Sushil Kumar Agarwal<\/a> -\n\n2007 AIR SCW 234 and submits that since agreement in question\n\nafter due examination of the plaintiff in this regard was admitted in\n\nevidence and marked as Ex.1, the stage of raising such objection on\n\nthe part of defendant had passed and according to Section 36 of the\n\nStamp Act, 1899 the same could not be called in question.\n\n\n\n        In Shyamal Kumar Roy's case the Hon'ble Supreme Court in\n\npara no.22 held that what was necessary was that the document\n\nshould be marked in presence of the parties and they had an\n\nopportunity to object to the marking of the document. The question of\n\njudicial determination of the matter would arise provided an objection\n\nis taken what document is tendered in evidence and before it is\n\nmarked as an exhibit in the case. Explaining the object of Indian\n\nStamp Act in para no.23 the Apex Court observed that it may be true\n\nthat the object of Indian Stamp Act is to collect revenue and the\n\namendments carried out by the State of West Bengal provides for\n S.B.CIVIL REVISION PETITION NO.314\/2008- Sheetal Singh vs. Fateh Singh   Order dt: 1.4.2009\n\n\n                                             3\/5\n\n\nmore stringent steps in that behalf. It may also be true that by reason\n\nof sub-section (4) of Section 33 of the West Bengal Act, a duty has\n\nbeen cast upon the court to apply its mind when an instrument having\n\ninsufficient stamp duty is brought to its notice but only thereby\n\nSection 36 of the Indian Stamp Act cannot be made inapplicable.\n\nSection 36, is reproduced hereunder:-\n\n\n                \"Section 36 : Admission of instrument where\n         not to be questioned- Where an instrument has been\n         admitted in evidence, such admission shall not, except\n         as provided in Sec.61, be called in question at any\n         stage of the same suit or proceedings on the ground\n         that the instrument has not been duty stamped.\"\n\n\n        This Court in Chandra Pal Singh's case (supra) also dealing\n\nwith the proviso to Section 49 of the Indian Registration Act had held\n\nthat in a suit for specific performance by virtue of proviso to Section\n\n49 the agreement even though not registered can be admissible in\n\nevidence. Proviso to Section 49 is in two parts, while dealing with the\n\nsuit for specific performance said proviso clearly provides that\n\nunregistered documents affecting the immovable property and\n\nrequired by Registration Act or Transfer of Property Act to be\n\nregistered may be received as evidence of a contract in a suit for\n S.B.CIVIL REVISION PETITION NO.314\/2008- Sheetal Singh vs. Fateh Singh   Order dt: 1.4.2009\n\n\n                                             4\/5\n\n\nspecific performance under Chapter II of the Specific Relief Act or\n\nas evidence of any collateral transaction not required to be effected by\n\nregistered instrument.\n\n\n\n        Admittedly, the present is a case relating to suit for specific\n\nperformance and, therefore, question of inadequate stamp duty or\n\nunregisteration does not affect the admissibility of evidence in the\n\nform of said agreement, particularly when the same has already been\n\nmarked as Ex.1 after due cross-examination of the plaintiff in this\n\nregard by the learned trial court. The judgment relied upon by the\n\nlearned counsel for the petitioner relates to suit for injunction and not\n\na suit for specific performance and secondly same being at variance\n\nwith the judgment of this Court in subsequent matter in Chandra Pal\n\nSingh's case and of Apex Court in Shyamal Kumar Roy's case (supra)\n\ncannot be relied upon.\n\n\n\n        In view of the above, no force is found in the revision petition\n\nfiled by the petitioner.
