Justice P.S.GOPINATHAN\n\n Dated :19\/05\/2009\n\n O R D E R\n                       P.S.GOPINATHAN, J.\n           ======================================\n                       B.A.No.2624 of 2009\n            ======================================\n                Dated this the 19th day of May 2009\n\n                              ORDER\n<\/pre>\n<p>      Petitioner is the accused in Crime No.441 of 2009 of<\/p>\n<p>Ernakulam Central Police Station for the offences under<\/p>\n<p>Sections 302, 307 and 436 IPC. He was arrested on 24.2.2009<\/p>\n<p>and produced before the Judicial Magistrate of the First Class II,<\/p>\n<p>Ernakulam. He was remanded to judicial custody for the reason<\/p>\n<p>that the offence alleged is exclusively triable by the Sessions<\/p>\n<p>Court. Now this petition.\n<\/p>\n<p>      2. Today when the petition came up for hearing, the<\/p>\n<p>learned Public Prosecutor submitted that the investigation was<\/p>\n<p>already over and charge sheet was laid and hence bail may be<\/p>\n<p>granted on conditions.\n<\/p>\n<p>      3. In the result, this petition is allowed and it is ordered<\/p>\n<p>that the petitioner shall be released on bail on executing a bond<\/p>\n<p>for Rs.50,000\/- (Rupees Fifty thousand only) with two solvent<\/p>\n<p>sureties each for the like sum to the satisfaction of the Judicial<\/p>\n<p>First  Class   Magistrate   II,   Ernakulam    on  the   following<\/p>\n<p>conditions:-\n<\/p>\n<blockquote><p>    i)   The petitioners shall not enter the limits of the<\/p>\n<p><span class=\"hidden_text\">B.A.No.2624 of 2009          2<\/span><\/p>\n<p>            Ernakulam Central Police Station.<\/p>\n<\/blockquote>\n<blockquote><p>       ii) The petitioner shall not directly or indirectly make<\/p>\n<p>            any inducement, threat or promise to any person<\/p>\n<p>            acquainted with the facts of the case so as to<\/p>\n<p>            dissuade him from disclosing such facts to the<\/p>\n<p>            Court or to any police officer.<\/p>\n<\/blockquote>\n<blockquote><p>                                   P.S.GOPINATHAN, Judge<\/p>\n<p>       css\/<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Thomas Alva Edison vs State Of Kerala on 19 May, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 2624 of 2009() 1.
