He has filed earlier Criminal<br \/>\n\tMiscellaneous Application No.10244 of 2010, which came to be<br \/>\n\twithdrawn vide order dated 16.09.2010. As transpires from the<br \/>\n\tapplication, the present application has been filed on the ground<br \/>\n\tthat the mobile phone number was not belonging to the petitioner<br \/>\n\tfrom which the talks are said to have been made and it is stated in<br \/>\n\tthis application to give an impression that it is only on the basis<br \/>\n\tof some inadvertent mistake made by learned APP in this connection<br \/>\n\tthat mobile belonging to the applicant, ultimately learned counsel<br \/>\n\tfor the applicant withdrew the petition, as the Court was not<br \/>\n\tinclined. Therefore, ground which is sought to be made is only on<br \/>\n\tthe aspect of mobile whether it belongs to petitioner or not.<br \/>\n\tHowever, in another words, learned counsel is seeking review of the<br \/>\n\tearlier order.\n<\/p>\n<p>Therefore, again Mr.Anandjiwala<br \/>\n\thas referred to the papers and emphasized on this aspect that the<br \/>\n\tsaid mobile number is not that of petitioner. He emphasized that<br \/>\n\tother mobile which has been recovered from the jail was of the other<br \/>\n\taccused who has been released, for which he pointedly referred to<br \/>\n\tthe First Information Report at page-16 where the mobile number is<br \/>\n\tmentioned. Referring to FIR, he has submitted that entire FIR is<br \/>\n\tbased on that fact which is not indicated as to the involvement of<br \/>\n\tthe applicant accused. He has also referred to other papers and<br \/>\n\tsubmitted that considering the panchnama also, there is no evidence<br \/>\n\tto connect the accused or suggesting involvement of the accused for<br \/>\n\tthe alleged offence, and, therefore, present application may be<br \/>\n\tallowed when other co-accused have been released as per order passed<br \/>\n\tin Criminal Miscellaneous Application No.6494 of 2010.\n<\/p>\n<p>Learned counsel Mr.Anandjiwala has<br \/>\n\talso submitted that offence alleged is under section 386 of Indian<br \/>\n\tPenal Code for extortion and admittedly no amount has been given by<br \/>\n\tany one to the accused and there is no passing of money, and,<br \/>\n\ttherefore, offence is not completed. He, therefore, submitted that<br \/>\n\tthe present application may be allowed.\n<\/p>\n<p>Learned APP Ms.Shah submitted that<br \/>\n\tpresent application is a successive bail application and no change<br \/>\n\tof circumstances has been claimed except the fact about the<br \/>\n\tinadvertent mistake of learned APP in stating that mobile phone<br \/>\n\tbelonging to the accused. She, however, stated that, that is not the<br \/>\n\tonly material and further she emphasized that one mobile phone has<br \/>\n\tbeen destroyed and one mobile which has been recovered from other<br \/>\n\taccused as there is no even the case of the prosecution that the<br \/>\n\tsaid number belonging to the present applicant. The case of the<br \/>\n\tprosecution is that he has made use of the same for alleged offence<br \/>\n\twhich could be evident from the statement, and, therefore, at this<br \/>\n\tstage, present application may not be entertained as no ground can<br \/>\n\tbe said to be made out. She has, therefore, submitted that in fact<br \/>\n\tthis is asking for review of the order, which is not permissible, on<br \/>\n\tsuch a ground.\n<\/p>\n<p>In view of rival submissions, it<br \/>\n\tis required to be considered whether the present application can be<br \/>\n\tentertained or not.\n<\/p>\n<p>It is well settled that the Court<br \/>\n\tis not required to appreciate and scrutinize evidence in detail at<br \/>\n\tthis stage. However, for considering prima facie case<br \/>\n\tsuggesting the involvement of the applicant accused, relevant<br \/>\n\taspects i.e. nature of<br \/>\n\toffence, manner in which alleged offence is said to have been<br \/>\n\tcommitted, role attributed etc. are relevant. In the facts of the<br \/>\n\tpresent case, from the nature of offence and the manner in which it<br \/>\n\tis alleged to have been committed itself is a matter of concerned.<br \/>\n\tFurther, the ground made out for successive bail is also not<br \/>\n\taccepted as after the arguments were made at length, when the Court<br \/>\n\twas not inclined, matter was withdrawn, and it is not that only as<br \/>\n\tto whether mobile phone which is referred in the FIR belonging to<br \/>\n\tthe accused or not was the only consideration. Therefore, after<br \/>\n\thaving perused the papers when the Court was not inclined, it has<br \/>\n\tbeen withdrawn on merits and no other ground or circumstances have<br \/>\n\tbeen made out to entertain present application which is successive<br \/>\n\tbail application, the Court is of the opinion that present<br \/>\n\tapplication cannot be entertained. Further, again when the learned<br \/>\n\tcounsel has pressed on merits itself requires to be stated that<br \/>\n\thaving regard to the aforesaid circumstances stated above and prima<br \/>\n\tfacie material suggesting the<br \/>\n\trole attributed to the applicant accused, present application cannot<br \/>\n\tbe entertained inasmuch as what was emphasized was the use of mobile<br \/>\n\tphone in the jail by the accused or the alleged offence and no where<br \/>\n\tit belongs to him. Further admittedly one mobile has been destroyed,<br \/>\n\ttherefore, without any further elaboration, present application<br \/>\n\tcannot be entertained and deserves to be rejected and accordingly<br \/>\n\tstands rejected.
