Justice P.R.RAMACHANDRA MENON\n\n Dated :03\/02\/2010\n\n O R D E R\n                 P.R.RAMACHANDRA MENON, J.\n               =~=~=~=~=~=~=~=~=~=~=~=~=~=~=~=~=\n                    W.P.(C) No. 2419 of 2010\n               =~=~=~=~=~=~=~=~=~=~=~=~=~=~=~=~=\n                Dated this the 3rd February, 2010\n\n                             JUDGMENT\n<\/pre>\n<p>       The petitioner is challenging the steps taken by the<\/p>\n<p>respondent bank invoking the provisions under the SARFAESI Act for<\/p>\n<p>realization of the amount due under a loan transaction. The case of<\/p>\n<p>the petitioner is that he had availed a term loan of Rs.2 lakhs and a<\/p>\n<p>cash credit facility to the tune of Rs.3 lakhs from the respondent<\/p>\n<p>bank, creating security interest over the property, but due to some<\/p>\n<p>unforeseen circumstances, he could not honour the commitment<\/p>\n<p>and turned to be a defaulter, when the bank declared the loan<\/p>\n<p>account as &#8220;NPA&#8221; and proceeded with steps under the SARFAESI Act,<\/p>\n<p>which are under challenge in this writ petition.<\/p>\n<p>         2. The learned counsel for the respondent bank, on<\/p>\n<p>instructions, submits that, as on 1-10-2009, a sum of Rs.5.84 lakhs<\/p>\n<p>is due from the petitioner. It is also submitted that the request<\/p>\n<p>made by the petitioner to have time to wipe off the entire liability<\/p>\n<p>can be considered only on proving bona fides by effecting<\/p>\n<p>substantial payment towards the liability.<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 2419\/2010               2<\/span><\/p>\n<p>        3. The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner had made arrangements to pay off the entire liability by<\/p>\n<p>sale of a portion of some other property.\n<\/p>\n<p>      4. Considering the facts and circumstances, the petitioner is<\/p>\n<p>directed to deposit a sum of Rs.1 lakh forthwith, at any rate within<\/p>\n<p>two weeks from today and the balance amount shall be satisfied<\/p>\n<p>within a period of three months thereafter. Subject to the above, the<\/p>\n<p>coercive steps for realization of the due amount shall be kept in<\/p>\n<p>abeyance.
