(Oral)\n<\/pre>\n<p>            The petitioner filed CWP No.6999 of 2007 challenging<\/p>\n<p>Clauses 13 and 14 of the Notification No.5\/8\/2007-3HB3\/1334 dated<\/p>\n<p>21.3.2007 as violative of the judgment of the Hon&#8217;ble Supreme Court<\/p>\n<p>in the case of Saurabh Chaudri and another v. Union of India, AIR<\/p>\n<p>2004 SC 361 and also prayed to consider the candidature of<\/p>\n<p>graduates for admission to P.G. Degree\/Diploma Courses during the<\/p>\n<p>session 2007 on the basis of institutional preference only. The<\/p>\n<p>aforesaid writ petition came to be decided vide judgment dated<\/p>\n<p>12.7.2007 by this Court. Following observations have been made in<\/p>\n<p>the aforesaid judgment:-\n<\/p>\n<p><span class=\"hidden_text\"> COCP NO.1117 OF 2007                              :2:<\/span><\/p>\n<blockquote><p>           &#8220;&#8230;In view of above,     challenge to Clause 13 of the<\/p>\n<p>           impugned notification has been rendered unnecessary.<\/p>\n<p>           Needless to observe that the State of Punjab is bound by<\/p>\n<p>           the law laid by the Hon&#8217;ble Supreme Court in Saurabh<\/p>\n<p>           Chaudhri (supra), that reservation for Post Graduate<\/p>\n<p>           courses has to be based on institutional preference and<\/p>\n<p>           not on place of residence, apart from other permissible<\/p>\n<p>           constitutional reservations&#8230;&#8221;<\/p><\/blockquote>\n<p>     This Court relied upon the case of Saurabh Chaudhri (supra)<\/p>\n<p>wherein following observations were made:-\n<\/p>\n<blockquote><p>                 &#8220;&#8230;We are therefore of the view that so far as<\/p>\n<p>                 admissions to post-graduate courses, such as MS,<\/p>\n<p>                 MD and the like are concerned, it would be<\/p>\n<p>                 eminently desirable not to provide for any<\/p>\n<p>                 reservation based on residence requirement within<\/p>\n<p>                 the State or on institutional preference. But,<\/p>\n<p>                 having regard to broader considerations of<\/p>\n<p>                 equality of opportunity and institutional continuity<\/p>\n<p>                 in education which has its own importance and<\/p>\n<p>                 value, we would direct that though residence<\/p>\n<p>                 requirement within the State shall not be a ground<\/p>\n<p>                 for reservation in admissions to post-graduate<\/p>\n<p>                 courses, a certain percentage of seats may in the<\/p>\n<p>                 present circumstances, be reserved on the basis of<\/p>\n<p>                 institutional preference in the sense that a student<\/p>\n<p>                 who has passed MBBS course from a medical<br \/>\n<span class=\"hidden_text\"> COCP NO.1117 OF 2007                               :3:<\/span><\/p>\n<p>                college or University, may be given preference for<\/p>\n<p>                admission to the post-graduate course in the same<\/p>\n<p>                medical college or University but such reservation<\/p>\n<p>                on the basis of institutional preference should not<\/p>\n<p>                in any event exceed 50 per cent of the total<\/p>\n<p>                number of open seats available for admission to<\/p>\n<p>                the post-graduate course. This outer limit which<\/p>\n<p>                we are fixing will also be subject to revision on<\/p>\n<p>                the lower side by the Indian Medical Council in<\/p>\n<p>                the same manner as directed by us in the case of<\/p>\n<p>                admission to the MBBS course. But, even in<\/p>\n<p>                regard to admissions to the post-graduate course,<\/p>\n<p>                we would direct that so far as super specialities<\/p>\n<p>                such   as   neuro-surgery    and      cardiology   are<\/p>\n<p>                concerned, there should be no reservation at all<\/p>\n<p>                even on the basis of institutional preference and<\/p>\n<p>                admissions should be granted purely on merit on<\/p>\n<p>                all-India basis.\n<\/p><\/blockquote>\n<blockquote><p>                It in no uncertain terms direction:\n<\/p><\/blockquote>\n<blockquote><p>                The decisions reached by us in these writ petitions<\/p>\n<p>                will bind     the Union of         India, the State<\/p>\n<p>                Governments and Administrations of Union<\/p>\n<p>                Territories because it lays down the law for the<\/p>\n<p>                entire country and moreover we have reached this<\/p>\n<p>                decision after giving notice to the Union of India<\/p>\n<p>                and all the State Governments and Union<br \/>\n<span class=\"hidden_text\"> COCP NO.1117 OF 2007                               :4:<\/span><\/p>\n<p>                  Territories.&#8221;<\/p><\/blockquote>\n<p>      After passing of the aforesaid judgment, petitioner made a<\/p>\n<p>representation dated 20.7.2007 for implementation of the judgment.<\/p>\n<p>Even when this judgment was not implemented, the petitioner filed<\/p>\n<p>the present contempt petition.\n<\/p>\n<p>      When notice of this petition was issued, respondents sought<\/p>\n<p>time to implement the judgment. Respondent issued a notification<\/p>\n<p>dated 27.6.2007 allegedly in compliance of the judgment. However,<\/p>\n<p>it was found that the Notification is not in consonance with the<\/p>\n<p>judgment of this court where under eleven seats out of 21 seats<\/p>\n<p>available for General Category candidates in the State Medical<\/p>\n<p>Colleges were reserved by way of institutional preference to the<\/p>\n<p>exclusion of the petitioner. It was found that the judgment has not<\/p>\n<p>been carried out in letter and spirit. Accordingly, counsel for the<\/p>\n<p>respondents-State sought further time to comply with the judgment<\/p>\n<p>and consequently a Corrigendum dated 14.8.2008 has been issued<\/p>\n<p>whereby Clause 13 has been deleted from the Original Notification<\/p>\n<p>dated 17.3.2008. This Corrigendum, however, satisfies the court<\/p>\n<p>judgment.\n<\/p>\n<p>      Mr.Ashok Sharma Nabhewala, learned counsel for the<\/p>\n<p>petitioner, however, has vehemently argued that though the<\/p>\n<p>respondents have complied with the judgment by issuing the<\/p>\n<p>Corrigendum, but it has taken more than two years to comply with<\/p>\n<p>the judgment and the petitioners have been deprived of their right for<\/p>\n<p>seeking admission in Post-Graduate Courses for more than two years<\/p>\n<p>which has adversely affected their career. His further contention is<br \/>\n<span class=\"hidden_text\"> COCP NO.1117 OF 2007                                :5:<\/span><\/p>\n<p>that even though the judgment has been complied, but for more than<\/p>\n<p>two years, the respondents have committed the contempt of court<\/p>\n<p>and they should be punished in accordance with law. There seems to<\/p>\n<p>be substance in the contention of the learned counsel for the<\/p>\n<p>petitioner. Respondents have issued the Corrigendum after one year<\/p>\n<p>of the passing of the judgment. It has definitely adversely affected<\/p>\n<p>the career of the petitioner.
