Giri, JJ.\n            ========================\n                     M.F.A.No.371 of 2002\n            ========================\n\n          Dated this the 23rd day of August, 2007.\n\n                           JUDGMENT\n<\/pre>\n<p>Koshy,J.\n<\/p>\n<\/p>\n<p>     Appellant suffered serious injuries in an accident.    While<\/p>\n<p>she was travelling in an autorickshaw, a bus      insured by the<\/p>\n<p>second respondent &#8211; Insurance Company and driven by the third<\/p>\n<p>respondent in a rash and negligent manner hit the autorickshaw.<\/p>\n<p>She claimed a total compensation of Rs.1,74,500\/-. The Tribunal<\/p>\n<p>has granted a compensation of only Rs.43,000\/-, out of which<\/p>\n<p>major amounts are for reimbursement of medical expenses. The<\/p>\n<p>Tribunal, has noticed the following injuries:<\/p>\n<blockquote><p>           &#8220;Immediately after the accident, the petitioner<\/p>\n<p>     was taken to West Fort Hospital, Thrissur as evident<\/p>\n<p>     from Ext.A6 wound certificate. The external injuries<\/p>\n<p>     noted were an abrasion on the eye brow right side and<\/p>\n<p>     abrasion on the left ear lobe. Ext.X1 is the case sheet<\/p>\n<p>     which would also reveal the same.              But on<\/p>\n<p>     investigation it was revealed that she had a blunt<\/p>\n<p>     injury to the abdomen with rupture to the right lobe of<\/p>\n<p><span class=\"hidden_text\">MFA 371\/02                     -: 2 :-<\/span><\/p>\n<p>     liver and haemo peritoneum. Thus, she was subjected<\/p>\n<p>     to a laprotomy on 16.9.1991. This is evident from<\/p>\n<p>     Ext.X2 case sheet. The details of treatment given at<\/p>\n<p>     the West Fort Hospital, Thrissur are also evident from<\/p>\n<p>     Ext.A7, which is the discharge summary. Since she<\/p>\n<p>     has loss of consciousness and was disoriented, she<\/p>\n<p>     was managed with charge and observation. This is<\/p>\n<p>     also evident from Ext.X2 case sheet.      She had an<\/p>\n<p>     injury to the bone on the right eye brow resulting in<\/p>\n<p>     the injury to the trochlea, which caused paralysis of<\/p>\n<p>     superior oblique muscles resulting in deplopia (double<\/p>\n<p>     vision).   Ext.A7 certificate states that if the said<\/p>\n<p>     condition of deplopia is not getting spontaneous cure<\/p>\n<p>     within six months, she would have to undergo a<\/p>\n<p>     surgical procedure to correct this problem.&#8221;<\/p><\/blockquote>\n<p>     2.   Even at the time of examination, there was double<\/p>\n<p>vision. The Tribunal was of the opinion that the double vision will<\/p>\n<p>be cured prospectively.       Therefore, only Rs.10,000\/- was<\/p>\n<p>awarded for the disability and for loss of earning power. She<\/p>\n<p>was a Managing Partner of a Chemical Industry. Considering the<\/p>\n<p>nature of the injuries, especially, double vision as well as the<\/p>\n<p>injury to the liver, we award Rs.7,000\/- more as additional<\/p>\n<p><span class=\"hidden_text\">MFA 371\/02                       -: 3 :-<\/span><\/p>\n<p>compensation      for disability and its after effects. The above<\/p>\n<p>amount should be deposited by the second respondent &#8211;<\/p>\n<p>Insurance Company with 7.5% interest from the date of<\/p>\n<p>application till the date of deposit.
