Advocate\n\nHon'ble Ravindra Singh,J.\n<\/pre>\n<p>Heard learned counsel for the applicants and learned A.G.A.\n<\/p>\n<p>This application has been filed against the order dated 27.1.2010 passed by<br \/>\nlearned Judicial Magistrate, Mau Misc. Application No. 52 of 2009 by which<br \/>\nthe application under section 156(3) Cr.P.C. has been allowed and the officer<br \/>\nin charge of the Police Station concerned has been directed to register a case<br \/>\nand investigate the same.\n<\/p>\n<p>It is contended by the learned counsel for the applicant that the impugned<br \/>\norder is illegal, it has not been passed in accordance with the provisions of<br \/>\nlaw.\n<\/p>\n<p>It has been rebutted by the learned A.G.A.by submitting that there is no<br \/>\nillegality in the impugned order because on the basis of the allegations made<br \/>\nin the application under section 156(3) Cr.P.C. a prima facie cognizable<br \/>\noffence is made out and the allegations are of such nature which requires<br \/>\ninvestigation. There is no illegality in the impugned order.<br \/>\nConsidering the submissions made by the learned counsel for the applicants<br \/>\nand the learned A.G.A. and from the perusal of the application under section<br \/>\n156(3) Cr.P.C., it appears that on the basis of the allegation made therein a<br \/>\nprima facie cognizable offence is made out and the allegations are of such a<br \/>\nnature which requires investigation, the investigation is not suffering from any<br \/>\nillegality or irregularity, therefore, the prayer for quashing the impugned order<br \/>\nis refused.\n<\/p>\n<p>It is further contended that the applicants are men of peace loving. They shall<br \/>\ncooperate with the investigation. In case, they are arrested and sent to jail<br \/>\nduring investigation, they shall suffer irreparable loss. Therefore, they may<br \/>\nnot be arrested during investigation.\n<\/p>\n<p>Considering the facts, circumstances of the case and the submissions made by<br \/>\nthe learned counsel for the applicants and the learned A.G.A, it is directed that<br \/>\nin case the F.I.R. has not been registered till today, if it is lodged<br \/>\nsubsequently, in pursuance to the impugned order, the applicants shall not be<br \/>\narrested during investigation of the case, but the applicants shall cooperate<br \/>\nwith the investigation.\n<\/p>\n<p>With the above direction, this application is finally disposed of.<br \/>\nOrder Date :- 4.2.2010<br \/>\nSu\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Dharmesh Rai And Another vs State Of U.P.
