Rattna Oil Mills\/Rice Mills\n\nRESPONDENT:\nParamjit Singh &amp; Ors\n\nDATE OF JUDGMENT: 30\/11\/2007\n\nBENCH:\nTARUN CHATTERJEE &amp; DALVEER BHANDARI\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<br \/>\nTARUN CHATTERJEE, J.\n<\/p>\n<p>1.\tThis appeal by way of a special leave petition is directed<br \/>\nagainst the final judgment and order dated 9th of February, 2000 in<br \/>\nCWP No. 1719 of 2000 of the High Court of Punjab and Haryana<br \/>\nat Chandigarh.\n<\/p>\n<p>2.\tOne Munshi Singh, son of Dalip Singh, resident of Village<br \/>\nRampura, Tehsil Fazilka, District Ferozepur along with his wife<br \/>\nSmt. Satwant Kaur owned land measuring 15.9542 Hectares on<br \/>\n24th of January, 1971, which was the appointed date under the<br \/>\nPunjab Land Reforms Act 1972. A decree dated 6th of July, 1972<br \/>\nwas passed in favour of Karnail Singh and others against Smt.<br \/>\nSatwant Kaur and in pursuance to the said decree, the land was<br \/>\ntransferred and mutated in favour of Karnail Singh and others.<br \/>\nThereafter, Karnail Singh and others exchanged the land with<br \/>\nManjit Singh whose name had entered in the revenue records. On<br \/>\nor about 14th of June, 1974, Manjit Singh sold land measuring<br \/>\nabout 12 Kanals 8 Marlas to M\/s. Ahuja Oil and Chemicals,<br \/>\nFazilka, which is presently Respondent No. 5 herein and they<br \/>\nconstructed a factory on it. The land was mutated in the name of<br \/>\nRespondent No. 5.\n<\/p>\n<p>3.\tThe Collector, Fazilka by his order dated 11th of January, 1977<br \/>\ndetermined the ceiling of the original owner Munshi Singh and held<br \/>\n8.0804 Hectares of land as surplus in the hands of Munshi Singh.<br \/>\nFeeling aggrieved, the original owner Munshi Singh filed an appeal<br \/>\nbefore the Commissioner, Ferozepur and the Commissioner by an<br \/>\norder dated 5th of May, 1980 modified the order of ceiling of the<br \/>\nCollector to the extent that the lands mentioned in the said order<br \/>\nequivalent to 4.8187 hectares were excluded from the surplus pool<br \/>\nand the matter was remanded back to the Collector, Fazilka for<br \/>\nfresh decision. By an order dated 19th of August, 1982, the<br \/>\nCollector, Fazilka determined the ceiling limit and declared 1.7849<br \/>\nhectares of land as surplus. The land in dispute measuring 12<br \/>\nKanals 8 Marlas, sold to M\/s. Ahuja Oil and Chemicals was<br \/>\ndeclared surplus though no notice was given to them. Feeling<br \/>\naggrieved, M\/s. Ahuja Oil &amp; Chemicals filed an appeal before the<br \/>\nCommissioner, Ferozepur claiming that since the aforesaid surplus<br \/>\nland was purchased by them from Manjit Singh, they ought to<br \/>\nhave been heard and notice ought to have been served upon them<br \/>\nand accordingly, the order of the Collector must be set aside.<br \/>\nDuring the pendency of this appeal, the respondent No. 5 sold the<br \/>\nsaid land in which a factory is situated to the appellant herein by a<br \/>\nregistered sale deed dated 11th of June, 1985. The appellate<br \/>\nauthority viz. the Commissioner, Ferozepur dismissed the appeal<br \/>\nof M\/s. Ahuja Oil and Chemicals on 14th of October, 1985 on the<br \/>\nground that M\/s. Ahuja Oil &amp; Chemicals were not entitled to<br \/>\nprosecute the appeal in view of the fact that the land in dispute<br \/>\nwas already sold by it to the appellant. The appellant herein, being<br \/>\nthe purchaser from M\/s. Ahuja Oil &amp; Chemicals filed an application<br \/>\nbefore the Commissioner, Ferozepur, which was also rejected by<br \/>\nthe order dated 6th of July, 1987. Thereafter, the order dated 6th of<br \/>\nJuly, 1987 was also challenged by the appellant herein in revision<br \/>\nbefore the Financial Commissioner but the revision petition was<br \/>\nalso dismissed on the ground of locus standi of the appellant<br \/>\nherein to challenge the same. A writ petition filed before the<br \/>\nPunjab &amp; Haryana High Court by the appellant herein was also<br \/>\nrejected on the ground that the appellant herein was not entitled to<br \/>\nany hearing of the proceeding for determination of surplus land<br \/>\nunder Punjab Land Reforms Act, 1972.  It is this order of the High<br \/>\nCourt, which is now under challenge before us.\n<\/p>\n<p>4.\tHeard the learned counsel appearing for the parties and<br \/>\nexamined the materials on record including the impugned order as<br \/>\nwell as the orders of the Collector, Commissioner and the<br \/>\nFinancial Commissioner and the other materials on record.\n<\/p>\n<p>5.\tThe only question that was raised by the learned counsel for<br \/>\nthe appellant herein was that the appellant herein ought to have<br \/>\nbeen served with the notice of the appeal filed by M\/s. Ahuja Oil &amp;<br \/>\nChemicals before the Commissioner before disposing of the said<br \/>\nappeal. Reliance was placed in this connection on the case of<br \/>\nEscorts Farms Ltd., V\/s Commissioner, Kumaon Division, Nainital,<br \/>\nU.P. and ors. [(2004) 4 SCC 281]. In this case, it has been held by<br \/>\nthis court that it is difficult to accept that the transferees could be<br \/>\nsaid to be merely proper parties and were not entitled to be<br \/>\narrayed, noticed and heard in the proceedings under the ceiling<br \/>\nact. It was observed that the transfer made after the appointed<br \/>\ndate could have been saved only on proof of good faith and<br \/>\npayment of adequate consideration for the transfer and this<br \/>\nburden of proof can be discharged jointly or singly either by the<br \/>\ntransferor or the transferee. This court in that decision further<br \/>\nobserved that the transferee was the party likely to be adversely<br \/>\naffected by the order nullifying the transfer if found to be lacking in<br \/>\ngood faith. The learned counsel for the appellant herein, therefore,<br \/>\nsubmitted that the appellant herein, being the purchaser from M\/s.<br \/>\nAhuja Oil &amp; Chemicals, who had filed the appeal before the<br \/>\nappellate authority  the Commissioner, Ferozepur, was entitled to<br \/>\nbe heard after the said purchase from M\/s. Ahuja Oil and<br \/>\nChemicals. This submission of the learned counsel for the<br \/>\nappellant herein was contested by the learned counsel for the<br \/>\nstate who submitted that since the appellant herein was a post<br \/>\nvesting purchaser of the land in question, he was not entitled to be<br \/>\nnoticed or given any opportunity of hearing.\n<\/p>\n<p>6.\tAfter hearing the learned counsel for the parties and after<br \/>\nnoting the submissions made by them, we find that it is an<br \/>\nadmitted position that the appellant herein was a post vesting<br \/>\npurchaser of the land in question. The appointed day for<br \/>\ndetermination of the surplus land under the Punjab Land Reforms<br \/>\nAct, 1972 is 24th of January, 1971. It is true that it is an admitted<br \/>\nposition that M\/s. Ahuja Oil &amp; Chemicals was a subsequent<br \/>\npurchaser after the appointed date and so was the appellant<br \/>\nherein. It appears from the record that the name of M\/s. Ahuja Oil<br \/>\n&amp; Chemicals was admittedly mutated in respect of the land in<br \/>\nquestion but M\/s. Ahuja Oil &amp; Chemicals sold the land in question<br \/>\nto the appellant herein during the pendency of their appeal before<br \/>\nthe Commissioner, Ferozepur. The order itself would show that the<br \/>\nappeal of M\/s. Ahuja Oil &amp; Chemicals was dismissed only the<br \/>\nground that since M\/s. Ahuja Oil &amp; Chemicals had lost its interest<br \/>\nin respect of the land in question, the appeal was liable to be<br \/>\ndismissed. It would thus be evident from the said order that the<br \/>\nappeal of M\/s. Ahuja Oil &amp; Chemicals could not be decided on<br \/>\nmerits. In this court, an affidavit has been filed in which the record<br \/>\nshows mutation of the land in question in the name of M\/s. Ahuja<br \/>\nOil &amp; Chemicals. The learned counsel for the state, however, could<br \/>\nnot deny the authenticity of the said record (mutation entry).<br \/>\nTherefore, this document may be kept in file. From a bare perusal<br \/>\nof this mutation entry, we find that the names of M\/s. Ahuja Oil &amp;<br \/>\nChemicals and also of the appellant herein are entered in the<br \/>\nsame in respect of the land in question. This being the admitted<br \/>\nposition and in view of the fact that the names of M\/s. Ahuja Oil &amp;<br \/>\nChemicals and the appellant herein have been mutated in respect<br \/>\nof the land in question, we are of the view that the appellant herein<br \/>\nmust be given an opportunity of hearing by the appellate authority<br \/>\non merits.\n<\/p>\n<p>7.\tSuch being the position, we set aside the order of the High<br \/>\nCourt rejecting the writ petition and also the order of the appellate<br \/>\nauthority  Commissioner, Ferozepur and restore the appeal for<br \/>\nfresh disposal.\n<\/p>\n<p>8.\tFor the reasons aforesaid, the matter is remitted back to the<br \/>\nappellate authority  Commissioner, Ferozepur for decision on<br \/>\nmerits and in accordance with law. The appellate authority<br \/>\nCommissioner, Ferozepur shall decide the appeal within 3 months<br \/>\nfrom the date of supply of a copy of this order to it.\n<\/p>\n<p>9.\t The appeal is thus disposed of to the extent indicated above.<br \/>\nThere will be no order as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India M\/S.
