Second petitioner is a Pre-<\/p>\n<p>Primary teacher, the 3rd petitioner is a Pre-Primary Ayah<\/p>\n<p>and the 4th petitioner    is the parent of a      Pre-Primary<\/p>\n<p>student.\n<\/p>\n<p>     2.   Ext.P3 is an order issued by the Government of<\/p>\n<p>Kerala permitting the Parent Teachers Association of<\/p>\n<p>Government schools to hold Nursery classes                 in<\/p>\n<p>Government schools where excess accommodation              is<\/p>\n<p>available at their own expense and to collect fees to meet<\/p>\n<p>the expenses. Ext.P6 is the subsequent order issued by<\/p>\n<p>the Government of Kerala, approving the guidelines for<\/p>\n<p>the conduct of Pre-Primary classes in Government schools.<\/p>\n<p>This Government order also provided that the PTA shall<\/p>\n<p>meet the expenses by raising local resources levying fee<\/p>\n<p>from the students.\n<\/p>\n<p>     3.     It is stated   that based on Exts.P3 and P6<\/p>\n<p>orders, Pre-Primary classes were permitted to be started<\/p>\n<p>in   several     Government       schools      where   excess<\/p>\n<p>W.P (C) No.2700 of 2009<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>accommodation was available. In all those places, PTA took<\/p>\n<p>over the entire responsibility for establishing the classes<\/p>\n<p>and the PTA also made appointment of the Pre Primary<\/p>\n<p>teachers and Ayahs. Exts.P30, 31 and 32 show these facts.<\/p>\n<p>Petitioners 2 and 3 are Pre primary teacher and Ayah so<\/p>\n<p>appointed on being selected by the respective PTA in<\/p>\n<p>pursuance to the aforesaid policy decision of the<\/p>\n<p>Government and the individual orders there were issued.<\/p>\n<p>On their appointment, they were being paid salary based on<\/p>\n<p>the fee collected from the students and such payments were<\/p>\n<p>made by the PTA itself.\n<\/p>\n<p>      4. The appointees like petitioners 2 and 3 and their<\/p>\n<p>Association, were making repeated representations to the<\/p>\n<p>Government requesting for higher emoluments. It would<\/p>\n<p>appear that based on those representations, which engaged<\/p>\n<p>the attention of the Government, directions were issued to<\/p>\n<p>the Director of Public Instruction to examine the matter and<\/p>\n<p>to submit his report.     Accordingly, the Director of Public<\/p>\n<p>Instruction submitted Ext.P14 report to the Government.<\/p>\n<p>In that report, it is stated that there are 1743 Pre- Primary<\/p>\n<p>W.P (C) No.2700 of 2009<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>Teachers and 1335 Ayahs who are working on salary paid<\/p>\n<p>from out of the meager fees collected from the students. It<\/p>\n<p>is also stated that Pre Primary Teachers and Ayahs who<\/p>\n<p>were working in the Government runs schools and who<\/p>\n<p>were recruited through the Public Service Commission,<\/p>\n<p>were getting salary in the scale of Rs.4990-7990 and 4300-<\/p>\n<p>5930 respectively. It is stated that if Pre-Primary teachers<\/p>\n<p>and Ayahs like the petitioners 2 and 3 are to be paid salary<\/p>\n<p>at the aforesaid rate, it involves an annual expenditure of<\/p>\n<p>9.3 crores and that for such payment, legislative enactment<\/p>\n<p>is necessary and that therefore they could be paid<\/p>\n<p>honorarium at the rate of Rs.4000\/- and           Rs.2500\/-<\/p>\n<p>respectively. Despite the submission of Ext.P14, in spite of<\/p>\n<p>various representations and meetings that were held by the<\/p>\n<p>authorities of the Education Department including the<\/p>\n<p>Minister concerned, no decision was taken in the matter. It<\/p>\n<p>was at that stage, this writ petition was filed with the<\/p>\n<p>prayer to direct the respondents to pay         Pre-Primary<\/p>\n<p>Teachers and Ayahs like petitioners 2 and 3 salary at the<\/p>\n<p>rate as applicable to the Pre-Primary Teachers and Ayahs<\/p>\n<p>W.P (C) No.2700 of 2009<br \/>\n<span class=\"hidden_text\">                               4<\/span><\/p>\n<p>in the Government schools and for consequential reliefs.<\/p>\n<p>      5.      During the pendency of the writ petition, this<\/p>\n<p>Court passed an order on 1st of April 2009 directing that<\/p>\n<p>the Government shall take a decision in the matter in the<\/p>\n<p>light of Ext.P14 report submitted by the Director of Public<\/p>\n<p>Instruction.    Accordingly,  petitioners  again  submitted<\/p>\n<p>Ext.P24 representation and finally the Government passed<\/p>\n<p>Ext.P29 order, the relevant portion of which reads as<\/p>\n<p>under:\n<\/p>\n<blockquote><p>             &#8220;Government have examined the matter in<br \/>\n      detail. Those Pre &#8211; Primary Teachers and Ayahs<br \/>\n      of Government schools getting wages from PTA<br \/>\n      collected      fees were    not   appointed    by<br \/>\n      Government. The Ext.P14 proposal of the DPI to<br \/>\n      enhance the remuneration\/honorarium to the<br \/>\n      Teachers and Ayahs of Pre-Primary classes run<br \/>\n      by the PTAs involve huge financial commitment<br \/>\n      to the Government. At present Government are<br \/>\n      not in a position to bear with the extra financial<br \/>\n      burden and therefore the proposal submitted by<br \/>\n      the DPI as per his letter read as 3rd paper above<br \/>\n      (Ext.P14) cannot be considered now and the<br \/>\n      same is rejected, thereby complying the Court<br \/>\n      direction in     W.P (C) No.2700\/09 filed by the<br \/>\n      Kerala      Pre-Primary  Teachers    and   Ayahs<br \/>\n      Association and others.<\/p><\/blockquote>\n<p>      6.     Thereafter, the writ petition was amended<\/p>\n<p>incorporating a challenge against Ext.P29. When the case<\/p>\n<p>W.P (C) No.2700 of 2009<br \/>\n<span class=\"hidden_text\">                                 5<\/span><\/p>\n<p>came up for final hearing, although various contentions<\/p>\n<p>have been raised.        The main argument of the learned<\/p>\n<p>Senior Counsel for the petitioners was that the liability to<\/p>\n<p>provide free education to the children upto the age 14 is<\/p>\n<p>that of the State and that therefore it is incumbent on the<\/p>\n<p>part of the Government to establish Pre-Primary schools<\/p>\n<p>appointing necessary staff for teaching and other matters.<\/p>\n<p>It is stated that since the State has such a constitutional<\/p>\n<p>obligation, State could not have issued any executive<\/p>\n<p>orders in the nature of Exts.P3 and P6 and           avoid the<\/p>\n<p>responsibility of paying decent salary or honorarium to the<\/p>\n<p>Teachers and Ayahs appointed in such schools. Further it<\/p>\n<p>is also pointed out that recognising their obligation in this<\/p>\n<p>behalf Government have already issued orders according<\/p>\n<p>administrative sanction to pay honorarium at the rate of<\/p>\n<p>Rs.300\/- and 200\/- to Teachers and Ayahs by order dated<\/p>\n<p>23rd June 2010.       It is also pointed out that the IXth Pay<\/p>\n<p>Commission has also submitted its report recommending<\/p>\n<p>to increase the honorarium payable to Teachers and Ayahs<\/p>\n<p>to Rs.600\/- and 300\/- respectively.\n<\/p>\n<p>W.P (C) No.2700 of 2009<br \/>\n<span class=\"hidden_text\">                               6<\/span><\/p>\n<p>      7.     On     behalf of  the   respondents,    learned<\/p>\n<p>Government        Pleader  disputed the    liability of  the<\/p>\n<p>Government to pay any amount to the Pre-Primary<\/p>\n<p>Teachers and Ayahs like petitioners 2 and 3. According to<\/p>\n<p>the learned Government Pleader, the very establishment of<\/p>\n<p>the Pre-Primary Schools were on the basis of Exts.P3 and<\/p>\n<p>P6 orders referred to above, it is stated that while the<\/p>\n<p>Government have agreed for the establishment of Pre-<\/p>\n<p>Primary classes in Government schools having          excess<\/p>\n<p>accommodation, it was made clear that the Government<\/p>\n<p>will not accept any monetary liability for payment of salary<\/p>\n<p>to the    Teachers or Ayahs who are appointed by the PTA.<\/p>\n<p>It is also pointed out that it was on that basis, PTAs were<\/p>\n<p>permitted to proceed with establishment of the Pre-Primary<\/p>\n<p>classes, collecting fee from the students and paying salary<\/p>\n<p>from out of such resources. Therefore, according to the<\/p>\n<p>learned Government Pleader, the Government cannot be<\/p>\n<p>saddled with any liability to pay salary or honorarium to<\/p>\n<p>appointees like the petitioners 2 and 3 herein. It is also<\/p>\n<p>contended that in the absence of any employer-employee<\/p>\n<p>W.P (C) No.2700 of 2009<br \/>\n<span class=\"hidden_text\">                               7<\/span><\/p>\n<p>relationship between the Government and Pre-Primary<\/p>\n<p>Teachers and Ayahs, this Court will not be justified in<\/p>\n<p>issuing any direction as sought for by the petitioners<\/p>\n<p>involving huge financial liability on the Government. On<\/p>\n<p>this basis, the learned Government Pleader       prayed for<\/p>\n<p>dismissal of the writ petition.\n<\/p>\n<p>      8.     I have considered the submissions made by both<\/p>\n<p>sides. Admittedly, Pre-Primary Teachers and Ayahs who<\/p>\n<p>are members of the 1st petitioner, are employed in Pre-<\/p>\n<p>Primary classes which were established on the basis of<\/p>\n<p>Exts.P3 and P6 Government Orders. These orders show<\/p>\n<p>that the Government permitted the establishment of such<\/p>\n<p>Pre-Primary       Schools in  Government Schools where<\/p>\n<p>additional accommodation was available. Orders clearly<\/p>\n<p>provided that the PTA will establish the classes collecting<\/p>\n<p>fee from the students admitted in such classes and pay the<\/p>\n<p>wages from out of the fee collected. It was accordingly<\/p>\n<p>that Pre-Primary classes were established.<\/p>\n<p>      9.     As far as the appointment of the Teachers and<\/p>\n<p>Ayahs are concerned, such appointments were also made<\/p>\n<p>W.P (C) No.2700 of 2009<br \/>\n<span class=\"hidden_text\">                              8<\/span><\/p>\n<p>by the PTA. Of course, the Headmaster of the school was<\/p>\n<p>also involved in the selection process.           But such<\/p>\n<p>involvement of the Headmaster was in the capacity of the<\/p>\n<p>representative of the PTA and was not on a representative<\/p>\n<p>of the Government. Such involvement of the Headmaster<\/p>\n<p>will not in any manner alter the nature of the appointment<\/p>\n<p>nor will it entitle the appointees to make any claim against<\/p>\n<p>the Government on that basis. Therefore, for all practical<\/p>\n<p>purposes, Teachers and Ayahs were appointed by the PTA<\/p>\n<p>and the Government or the Education Department had<\/p>\n<p>nothing to do with the selection or appointment.<\/p>\n<p>Therefore, the petitioners cannot claim any employer-<\/p>\n<p>employee relationship with the Government.           In the<\/p>\n<p>absence of such a relationship, petitioners cannot have any<\/p>\n<p>legal right to contend     that the Government have the<\/p>\n<p>liability to pay them salary much less at the rate at which<\/p>\n<p>Teachers and Ayahs selected by the Public Service<\/p>\n<p>Commission and appointed in Government schools are<\/p>\n<p>paid. For this reason itself, this Court also cannot in the<\/p>\n<p>exercise of its powers under Article 226 of the Constitution<\/p>\n<p>W.P (C) No.2700 of 2009<br \/>\n<span class=\"hidden_text\">                                 9<\/span><\/p>\n<p>of India,     call upon the Government to pay salary or<\/p>\n<p>honorarium to the Teachers or Ayahs like petitioners 2 and<\/p>\n<p>3.<\/p>\n<p>      10. Learned senior counsel for the         petitioners<\/p>\n<p>pleaded that the approach in a matter like this should be<\/p>\n<p>justice oriented.       However, justice   can only be in<\/p>\n<p>accordance with law and not otherwise than in accordance<\/p>\n<p>with law and therefore this Court cannot accept that<\/p>\n<p>argument and issue any such directions.<\/p>\n<p>      11.     It is true that the Government appears to have<\/p>\n<p>agreed to pay honorarium at the rate of Rs.300\/- and 200\/-<\/p>\n<p>to the teachers and Ayahs and administrative sanction in<\/p>\n<p>that behalf has seen accorded by G.O (MS) NO.99\/10<\/p>\n<p>dated 23rd June, 2010. The IXth Pay Commission also has<\/p>\n<p>recommended revision of the honorarium.              If the<\/p>\n<p>Government voluntarily accepts such liability, it is free to<\/p>\n<p>do that. But the question is whether this Court can force<\/p>\n<p>the Government to accept any financial liability and in my<\/p>\n<p>view the answer can only be in the negative.<\/p>\n<p>W.P (C) No.2700 of 2009<br \/>\n<span class=\"hidden_text\">                               10<\/span><\/p>\n<p>      12. The argument of the petitioner based on the<\/p>\n<p>contention that the children of this country are entitled to<\/p>\n<p>have free education up to the age of 14. It is true, such a<\/p>\n<p>right has been recognised by the Constitution and it is for<\/p>\n<p>that purpose schools have been established by the<\/p>\n<p>Government or in the private sector              based on the<\/p>\n<p>recognition granted by the Government.         Such education,<\/p>\n<p>in my view, cannot extend to Pre-Primary education such<\/p>\n<p>as those imparted in pre-primary classes pursuant to Exts<\/p>\n<p>P3 and P6. A reading of Exts.P3 to P6 itself show that<\/p>\n<p>these classes have been established to ensure the<\/p>\n<p>availability of sufficient students in the first standard in the<\/p>\n<p>Government schools.          Such classes cannot get the<\/p>\n<p>protection of Article 21A and therefore this argument of<\/p>\n<p>the learned senior counsel is only to be rejected and I do<\/p>\n<p>so.\n<\/p>\n<p>      13.     Therefore, this Court will not be justified in<\/p>\n<p>issuing the directions sought for by the petitioners either<\/p>\n<p>for directing the Government to pay salary or honorarium<\/p>\n<p>to Teachers and Ayahs in classes established pursuant to<\/p>\n<p>W.P (C) No.2700 of 2009<br \/>\n<span class=\"hidden_text\">                                11<\/span><\/p>\n<p>Exts.P3 and P6.       Therefore, I do not find any merit in the<\/p>\n<p>writ petition.        The writ petition therefore will stand<\/p>\n<p>dismissed.\n<\/p>\n<p>      14. Learned senior counsel for the petitioners relied<\/p>\n<p>on Ext.P9 and submitted that by this order the Government<\/p>\n<p>have directed that the Pre-Primary Teachers of the<\/p>\n<p>recognised schools      should be     paid minimum salary of<\/p>\n<p>Rs.2500\/-. As I already held that unless the petitioners<\/p>\n<p>have an employer-employee relationship, the Government<\/p>\n<p>cannot be called upon to make any payment. Therefore, if<\/p>\n<p>at all the petitioners have such a claim, such claim can<\/p>\n<p>only be against those who have employed then in Pre-<\/p>\n<p>primary classes and        therefore I am not persuaded to<\/p>\n<p>accept that claim of the petitioners also.<\/p>\n<p>      In the result, writ petition is only to be rejected and I<\/p>\n<p>do so.
