Justice ANTONY DOMINIC\n\n Dated :05\/01\/2011\n\n O R D E R\n                      ANTONY DOMINIC, J.\n\n            ```````````````````````````````````````````````````````\n                  W.P.(C) No. 193 of 2011 Y\n            ```````````````````````````````````````````````````````\n           Dated this the 5th day of January, 2011\n\n                           J U D G M E N T\n<\/pre>\n<p>           Petitioner is a Charitable Society, which claims<\/p>\n<p>ownership of 3 cents of land in Re-survey No.25\/15C of Chokli<\/p>\n<p>village of Thalassery Taluk. According to the petitioner, on<\/p>\n<p>the strength of Exts.P1, P1(a) and P1(b) of 1998, they<\/p>\n<p>constructed a three storied building. At that stage, there was<\/p>\n<p>an allegation of encroachment into puramboke land.                    It is<\/p>\n<p>stated that, seeking to injunct the petitioner from proceeding<\/p>\n<p>with the construction, a stranger had filed O.S.No.288\/1990<\/p>\n<p>before the Munsiff Court, Thalassery, the plaint of which is<\/p>\n<p>Ext.P2.    According to the petitioner, in Ext.P3 written<\/p>\n<p>statement filed by the third respondent herein, he had<\/p>\n<p>confirmed that the allegation of encroachment was referred to<\/p>\n<p>the Tahsildar, Thalassery and that the Taluk Surveyor<\/p>\n<p>inspected the land with reference to the revenue records and<\/p>\n<p>reported that there was no encroachment. It is stated that<\/p>\n<p>W.P.(C) No.193\/2011<br \/>\n<span class=\"hidden_text\">                               : 2 :<\/span><\/p>\n<p>subsequently, the suit was dismissed for default.<\/p>\n<p>      2.    According to the petitioner, in 2000, notice was<\/p>\n<p>issued under the provisions of the Kerala Land Conservancy<\/p>\n<p>Act and that Ext.P6 order was passed. Case of the petitioner<\/p>\n<p>is that notice was not served on the representative of the<\/p>\n<p>petitioner and, therefore, the petitioner could not appear and<\/p>\n<p>contest the matter. It is stated that, irrespective of the above,<\/p>\n<p>they filed Ext.P7 appeal before the RDO. The RDO issued<\/p>\n<p>Ext.P8 order, rejecting the appeal but, however, reducing the<\/p>\n<p>area into 10 sq.m. as against 16.7 sq.m. mentioned in Ext.P6<\/p>\n<p>order of the Tahsildar. It is stated that, against Ext.P8 order,<\/p>\n<p>Ext.P9 revision was filed before the third respondent, which<\/p>\n<p>was also rejected by Ext.P10 order. Although the petitioner<\/p>\n<p>challenged Ext.P10 order before this Court by filing W.P.(C)<\/p>\n<p>No.21296\/2006, that writ petition was disposed of by Ext.P11<\/p>\n<p>judgment, relegating the petitioner to file revision. It is stated<\/p>\n<p>that accordingly the petitioner filed a revision petition before<\/p>\n<p>the Land Revenue Commissioner, which was also dismissed<\/p>\n<p>W.P.(C) No.193\/2011<br \/>\n<span class=\"hidden_text\">                               : 3 :<\/span><\/p>\n<p>by Ext.P12 order. It is challenging Exts.P6, P8, P10 and P12,<\/p>\n<p>this writ petition is filed.\n<\/p>\n<p>      3.    Two contentions have been raised. One is that,<\/p>\n<p>before passing Ext.P6, the petitioner was not heard. As far as<\/p>\n<p>this contention is concerned, I do not find any merit in this<\/p>\n<p>contention for the reason that the petitioner was heard by the<\/p>\n<p>appellate authority and revisional authorities, viz., RDO,<\/p>\n<p>District Collector and Land Revenue Commissioner. In that<\/p>\n<p>view of the matter, it cannot be said that any prejudice is<\/p>\n<p>caused for the reason that the petitioner was not heard by the<\/p>\n<p>Tahsildar before passing Ext.P6.\n<\/p>\n<p>      4.    The second contention raised by the learned<\/p>\n<p>counsel for the petitioner is that the finding of encroachment<\/p>\n<p>which has been found in the impugned orders is incorrect.<\/p>\n<p>This contention is sought to be substantiated by the petitioner<\/p>\n<p>by relying the averment in Ext.P3 written statement filed by<\/p>\n<p>the defendants in O.S.No.288\/1990, wherein it is stated that<\/p>\n<p>there was no encroachment by the petitioner. First of all, that<\/p>\n<p>W.P.(C) No.193\/2011<br \/>\n<span class=\"hidden_text\">                                 : 4 :<\/span><\/p>\n<p>suit was not decided by the Court on merits but, it was<\/p>\n<p>dismissed for default. Therefore, the petitioner cannot plead<\/p>\n<p>any resjudicata as against the respondents.          Secondly, a<\/p>\n<p>reading of Ext.P6 order shows that on verification, it was<\/p>\n<p>found that the petitioner has encroached in the puramboke<\/p>\n<p>land. This finding of the Tahsildar is confirmed by the RDO in<\/p>\n<p>Ext.P8 order. Again, Ext.P10 order passed by the District<\/p>\n<p>Collector shows that the RDO inspected the land and<\/p>\n<p>confirmed the encroachment of the petitioner. The relevant<\/p>\n<p>portion of Ext.P10 order reads as under:-\n<\/p>\n<blockquote><p>                   &#8221; On going through the argument notes<\/p>\n<p>            and connected records, it is seen that<\/p>\n<p>            Revision petitioners Committee (ie, Muslim<\/p>\n<p>            Relief Committee(Registered), Peringadi has<\/p>\n<p>            encroached 10 square meter of land in<\/p>\n<p>            R.S.No.25\/15 of Chokli amsom Peringadi<\/p>\n<p>            desam.    The Revenue Divisional Officer,<\/p>\n<p>            Thalassery has inspected the site and found<\/p>\n<p>            that    the   Muslim      Relief  Committee<\/p>\n<p>            (Registered), Peringadi has encroached the<\/p>\n<p>            Government land.      Further, the land was<\/p>\n<p>W.P.(C) No.193\/2011<br \/>\n<span class=\"hidden_text\">                                  : 5 :<\/span><\/p>\n<p>            measured by the Superintendent of Survey<\/p>\n<p>            and Land Records, Kannur and confirmed<\/p>\n<p>            the encroachment. In the light of the above,<\/p>\n<p>            it is clear that the revision petitioners<\/p>\n<p>            committee had encroached an extent of 10<\/p>\n<p>            square   meter   of    Government  land  in<\/p>\n<p>            R.S.No.25\/15 of Peringadi desam Chokli<\/p>\n<p>            Village.&#8221;<\/p><\/blockquote>\n<p>      5.    This finding of the lower authorities has been<\/p>\n<p>confirmed by the Land Revenue Commissioner.
