Pathak, learned counsel for the applicant.\n         Shri Ajay Tamrakar, learned PL for the respondent-State.<\/pre>\n<p>         Heard on IA No. 8580\/10, applicant&#8217;s application for urgent<br \/>\nhearing of this petition during summer vacation.\n<\/p>\n<p>         For the reasons stated in it, the same is allowed and the petition<br \/>\nis taken up for admission.\n<\/p>\n<p>         Heard on the question of admission.\n<\/p>\n<p>         Applicant &#8211; accused has preferred this petition under Section 482<br \/>\nof Cr.P.C.     being aggrieved by the order dated 25.2.10 passed by<br \/>\nSessions Judge, Satna in Criminal Revision No. 33\/10 dismissing the<br \/>\nrevision by affirming the order dated 2.2.2010 passed by the Judicial<br \/>\nMagistrate Ist Class, Satna in Criminal Case No. 3713\/08 dismissing his<br \/>\napplication to produce some additional documents in his defence.\n<\/p>\n<p>         In the course of arguments in view of available papers on record,<br \/>\non making some query regarding maintainability of such petition,<br \/>\napplicant&#8217;s counsel seeks permission to withdraw this petition with<br \/>\nliberty to raise the grounds, stated in the petition subject to decision of<br \/>\nthe trial court on arising the occasion in duly constituted appeal with a<br \/>\nfurther prayer     permitting the applicant to file certified copy of the<br \/>\njudgment dated 26.8.03 passed by the Judicial Magistrate, Ist Class,<br \/>\nSatna in Criminal Case No. 1545\/02 in his         defence before the trial<br \/>\ncourt.\n<\/p>\n<p>         Considering his prayer, the petition is dismissed as withdrawn<br \/>\nwith liberty aforesaid to raise the grounds stated in the petition subject<br \/>\nto decision of the trial court on arising the occasion in duly constituted<br \/>\nappeal before the appellate court.\n<\/p>\n<p>         However, taking into consideration that the aforesaid judgment<br \/>\ndated 26.8.03 is falling under the category of public document and the<br \/>\n same could be taken into consideration by any court without examining<br \/>\nany witnesses or marking the exhibit on record, hence applicant is<br \/>\npermitted to produce such judgment before the trial court and the trial<br \/>\ncourt is directed to take such judgment into consideration in accordance<br \/>\nwith law while deciding the impugned criminal case.\n<\/p>\n<p>       At this juncture, applicant&#8217;s counsel prayed for returning certified<br \/>\ncopy of this judgment dated 26.8.03 from the record of this petition to<br \/>\nfile the same before the trial court. Considering such prayer office is<br \/>\ndirected that on submitting a photocopy of such judgment, the original<br \/>\ncopy be given to the applicant&#8217;s counsel enabling him to file the same<br \/>\nbefore the trial court.\n<\/p>\n<p>       The petition is dismissed        as withdrawn       with aforesaid<br \/>\nobservation.\n<\/p>\n<p>       C c as per rules.<\/p>\n<pre>\n\n\n                                         ( U.C.
