DATTU, C.J:\n<\/p>\n<p>       The complainant is once over again before us in this Contempt Petition filed<\/p>\n<p>under Sections 11 and 12 of the Contempt  of Courts Act, 1971 read with Article 215<\/p>\n<p>of the Constitution of India.  According to petitioner, the respondent has not complied<\/p>\n<p>with the undertaking given by her in W.P.(C). No.27685\/03 dated 22.2.2006.\n<\/p>\n<p>       2.     The   respondent   has   filed   a   Counter   Affidavit   wherein,   it   is,   inter   alia,<\/p>\n<p>stated as follows:\n<\/p>\n<blockquote><p>                   &#8221;   3.     It   is   submitted   that   both   the   bunks   of   Sri.K.E.<\/p>\n<p>         Mohammed Basheer and Sreekuttan have been removed from the<\/p>\n<p>         Shenoys Road by themselves and now there are no shops on both<\/p>\n<p>         sides of the Shenoys Road.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                   4.   It is submitted that the Town Planning Committee at its<\/p>\n<p>         meeting held on 22.01.2008 vide item No.2 resolved that the bunk<\/p>\n<p>         of   Sri.   Unnikrishnan   shall   be   retained   in   the   Rajaji   Road   without<\/p>\n<p>         causing   any   obstruction   to   the   Vehicular   Traffic   and   pedestrians.<\/p>\n<p>         On inspection, it has been found that the bunk of Sri. Unnikrishnan<\/p>\n<p>         does not cause any obstruction to the traffic or pedestrians.&#8221;<\/p><\/blockquote>\n<p>       3.     After   going   through   the   Counter   Affidavit   filed   by   the   Secretary   of   the<\/p>\n<p>respondent   Corporation   of   Cochin,   Shri   Johnson   Manayani,   learned   counsel<\/p>\n<p>appearing for the complainant, would submit that the matter may be closed for the<\/p>\n<p>present.   Taking  note of  the statements contained in  the Counter Affidavit and  the<\/p>\n<p><span class=\"hidden_text\">C.C.(C). 218\/08                        2<\/span><\/p>\n<p>submission made by the learned counsel for the respondent, this Contempt of Court<\/p>\n<p>Case is dropped  for the present.\n<\/p>\n<p>        Ordered accordingly.<\/p>\n<pre>\n\n\n\n\n\n                                                               H.L.
