Appeal NO. 793    OF 2003\n               = = = = = = = = = = = = = = =\n          Dated this the 17th day of July, 2009.\n\n                      J U D G M E N T\n<\/pre>\n<p>     This appeal is preferred against the conviction and<\/p>\n<p>sentence passed by the Addl. Sessions Judge, Fast Track,<\/p>\n<p>Adhoc-II, Kozhikode in S.C.400\/00. The accused was charge<\/p>\n<p>sheeted for the offence u\/s 55(a) of the Abkari Act and was<\/p>\n<p>found guilty thereunder and sentenced to undergo rigorous<\/p>\n<p>imprisonment for a period of two years and to pay a fine of<\/p>\n<p>Rs.1,00,000\/- and in default to undergo simple imprisonment<\/p>\n<p>for a period of six months.   It is against that decision the<\/p>\n<p>appeal is preferred.\n<\/p>\n<p>     2.    The points that arise for determination in the<\/p>\n<p>appeal are;\n<\/p>\n<p>     (1)   Whether the prosecution as initiated is sustainable?<\/p>\n<p>     (2)   Whether the accused can be found guilty u\/s 55(a)<\/p>\n<p>of the Abkari Act?\n<\/p>\n<p>Crl.A. 793 OF 2003<br \/>\n<span class=\"hidden_text\">                                -2-<\/span><\/p>\n<p>       Points:\n<\/p>\n<p>       3.   It is the case of the prosecution that on 26\/10\/98<\/p>\n<p>at about 8 p.m. the accused was found in possession of three<\/p>\n<p>bottles of 180 ml. Golden Star Brandy, one bottle of R.B.<\/p>\n<p>Brandy and one bottle of Queens Brandy meant for sale in<\/p>\n<p>Pondichery without the sticker of the Kerala Beverages<\/p>\n<p>Corporation. Prosecution was launched. It is true that the<\/p>\n<p>detection was done by the Sub Inspector of Police. But quite<\/p>\n<p>strangely the investigation and laying of the charge was done<\/p>\n<p>by the Asst. Sub Inspector of Police. As PW3 in the chief-<\/p>\n<p>examination itself he had deposed that he was the Asst. Sub<\/p>\n<p>Inspector of Police on the relevant date and that as per the<\/p>\n<p>instructions of the Sub Inspector of Police he had conducted<\/p>\n<p>the investigation and laid the charge before the police. Or in<\/p>\n<p>other words the investigation and charge has been laid by<\/p>\n<p>Asst. Sub Inspector of Police.        Learned counsel for the<\/p>\n<p>appellant contends before me that the Assistant Sub Inspector<\/p>\n<p>is incompetent under the Abkari Act to do the same and<\/p>\n<p>therefore the prosecution will not lie.<\/p>\n<p>Crl.A. 793 OF 2003<br \/>\n<span class=\"hidden_text\">                                -3-<\/span><\/p>\n<p>       4.   S.50 of the Abkari Act specifically states that the<\/p>\n<p>Magistrate can take cognizance of the offence on a report filed<\/p>\n<p>by an Abkari Officer as defined under the Act. By virtue of the<\/p>\n<p>Governmental Notification in SRO 321\/96 who are the Abkari<\/p>\n<p>Officers for the purpose of the Act has been stated by the<\/p>\n<p>Government. So far as it relates to the police department it is<\/p>\n<p>stated that officers of and above the rank of a Sub Inspector<\/p>\n<p>are Abkari Officers. So only from a Sub Inspector of Police<\/p>\n<p>and upwards the power is given as an Abkari Officer.<\/p>\n<p>Unfortunately in the case before me the investigation and<\/p>\n<p>laying of charge has been done by an Asst. Sub Inspector of<\/p>\n<p>Police who is not an Abkari Officer as defined under the Act.<\/p>\n<p>This matter has been considered by this Court in the various<\/p>\n<p>decisions.\n<\/p>\n<p>       5.   In the decision reported in <a href=\"\/doc\/1623831\/\">Sabu v. State of<\/p>\n<p>Kerala<\/a> (2007 (4) KLT 169) the learned judge of this Court<\/p>\n<p>held that Assistant Sub Inspector of Police is not an authorized<\/p>\n<p>officer to detect and investigate an offence under the Act. This<\/p>\n<p>Court also held that even if he was empowered as per the<\/p>\n<p>Crl.A. 793 OF 2003<br \/>\n<span class=\"hidden_text\">                                   -4-<\/span><\/p>\n<p>provisions of S.2(o) of Cr.P.C. he cannot exercise the power<\/p>\n<p>conferred on an Abkari Officer.\n<\/p>\n<p>       6.   In the decision reported in <a href=\"\/doc\/858474\/\">Vikraman v. State of<\/p>\n<p>Kerala<\/a> 2007 (1) KLT 1010 another judge of this Court held:<\/p>\n<blockquote><p>           &#8220;When detection was made by Abkari Officer,<\/p>\n<p>           mere fact that Assistant Sub Inspector<\/p>\n<p>           conducted later part of investigation and laid<\/p>\n<p>           charge will not vitiate the trial.&#8221;<\/p>\n<\/blockquote>\n<p>The facts of the present case is exactly within the four corners<\/p>\n<p>which is considered by the learned Judge. But the correctness<\/p>\n<p>of this decision and the decision earlier referred to was<\/p>\n<p>referred to a Division Bench and the Division Bench of this<\/p>\n<p>Court in the decision reported in <a href=\"\/doc\/1381730\/\">Subash v. State of Kerala<\/a><\/p>\n<p>(2008 (2) KLT 1047) held:\n<\/p>\n<blockquote><p>                   &#8220;A Magistrate cannot take cognizance<\/p>\n<p>            of an offence under the Act on the basis of a<\/p>\n<p>            report filed by Assistant Sub Inspector of<\/p>\n<p>            Police who is not an Abkari Officer as<\/p>\n<p>            defined under the Act.      The Court further<\/p>\n<p>            held    that  illegality  or   irregularity in<\/p>\n<p>            investigation is different from lack of power<\/p>\n<p>            to initiate prosecution.&#8221;\n<\/p><\/blockquote>\n<p>Crl.A. 793 OF 2003<br \/>\n<span class=\"hidden_text\">                                -5-<\/span><\/p>\n<p>       7.   The Division Bench also considered the correctness<\/p>\n<p>of the decision in <a href=\"\/doc\/858474\/\">Vikraman v. State of Kerala<\/a> 2007 (1)<\/p>\n<p>KLT 1010 in paragraph 7 of the judgment and the Division<\/p>\n<p>Bench of this Court held as follows.\n<\/p>\n<blockquote><p>                 &#8220;We are of the opinion that on the<\/p>\n<p>           plain reading of S.50 of the Abkari Act, the<\/p>\n<p>           Magistrate has no jurisdiction to take<\/p>\n<p>           cognizance of the cases as the report was<\/p>\n<p>           filed by a person other than an Abkari<\/p>\n<p>           Officer. Hence, Vikraman&#8217;s case cannot be<\/p>\n<p>           acceptable as an authoritative decision that<\/p>\n<p>           despite the mandate in S.50 Magistrate can<\/p>\n<p>           take cognizance on a report filed by a<\/p>\n<p>           person other than an Abkari Officer.&#8221;<\/p><\/blockquote>\n<p>       8.   So in the light of this decision also the present<\/p>\n<p>action will not lie.  Later another judge has considered the<\/p>\n<p>point regarding the power of Assistant Sub Inspector in the<\/p>\n<p>decision reported in 2009 (1) KLD 854 <a href=\"\/doc\/1847616\/\">Unni v. State of<\/p>\n<p>Kerala<\/a> in that case this Court held that Assistant Sub<\/p>\n<p>Inspector of Police as per the notification issued by the<\/p>\n<p>Government is not authorised or empowered to detect or<\/p>\n<p>Crl.A. 793 OF 2003<br \/>\n<span class=\"hidden_text\">                                 -6-<\/span><\/p>\n<p>investigate an Abkari offence.       So in the light of these<\/p>\n<p>decisions it clearly emerges that an Assistant Sub Inspector of<\/p>\n<p>Police being not an Abkari Officer authorised under the Abkari<\/p>\n<p>Act is incompetent to detect, investigate or lay charge in<\/p>\n<p>relation to an Abkari offence. Therefore it has to be held that<\/p>\n<p>the action by the Assistant Sub Inspector of Police in the<\/p>\n<p>present case is lacking jurisdiction which cuts at the root of<\/p>\n<p>the prosecution and therefore the prosecution will not lie.<\/p>\n<p>Hence the Crl.Appeal is allowed and it is found that the<\/p>\n<p>accused is not guilty of the offence u\/s55(a) of the Abkari Act.<\/p>\n<p>He is acquitted and set at liberty forthwith.<\/p>\n<p>                                 M.N.
