Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :24\/05\/2010\n\n O R D E R\n<\/pre>\n<p>          THOTTATHIL B.RADHAKRISHNAN, J.<\/p>\n<p>  = = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>            W.P.(C).No.36472 of 2009-D<\/p>\n<p>  = = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>       Dated this the 24th day of May, 2010.<\/p>\n<p>                     Judgment<\/p>\n<p>1.The petitioner obtained Ext.P1, an order under<\/p>\n<p> Section 8 of the Kerala Private Forests (Vesting<\/p>\n<p> and   Assignment)  Act,  1971   from  the   Forest<\/p>\n<p> Tribunal, Palakkad. The State of Kerala and the<\/p>\n<p> Custodian were the respondents. The parties are<\/p>\n<p> bound by that judicial order. Respondents carried<\/p>\n<p> an appeal to this Court. That was dismissed as<\/p>\n<p> per Ext.P2 judgment. Obviously, therefore, the<\/p>\n<p> respondents have to give effect to the decision<\/p>\n<p> contained in Ext.P1 whereby the petitioner is<\/p>\n<p> found  entitled   to  be  in  possession  of   the<\/p>\n<p> property in question.\n<\/p>\n<\/p>\n<p>2.The  petitioner  complains   that  in  spite   of<\/p>\n<p> repeated   requests   and   representations,   the<\/p>\n<p> respondents have not given effect to the decision<\/p>\n<p> contained in Ext.P1, as affirmed as per Ext.P2.<\/p>\n<p><span class=\"hidden_text\">WPC36472\/09           -: 2 :-<\/span><\/p>\n<p> This is nothing but clear negation of justice and<\/p>\n<p> infraction of rule of law. If there is any<\/p>\n<p> dispute between the State and the Custodian on<\/p>\n<p> the one hand and the petitioner on the other, as<\/p>\n<p> to the identity of the property that is covered<\/p>\n<p> by Ext.P1, either of the parties can bring that<\/p>\n<p> issue to the notice of the Forest Tribunal since<\/p>\n<p> that Tribunal would be the best authority to<\/p>\n<p> decide on the identity of the property covered by<\/p>\n<p> Ext.P1.\n<\/p>\n<\/p>\n<p>3.However, learned Special Government Pleader for<\/p>\n<p> Forests states that in the meanwhile, Kerala<\/p>\n<p> Forests (Vesting and Management of Ecologically<\/p>\n<p> Fragile Land) Act, 2003 came into force and that<\/p>\n<p> the land in question is one that would fall under<\/p>\n<p> that Act. He says that on coming into force of<\/p>\n<p> that    legislation, the    petitioner ceases his<\/p>\n<p> entitlement to have the land because it is one<\/p>\n<p> that would be covered by that statute.<\/p>\n<p>4.But, the petitioner is entitled to require the<\/p>\n<p><span class=\"hidden_text\">WPC36472\/09            -: 3 :-<\/span><\/p>\n<p> respondents to give effect to Ext.P1. In taking a<\/p>\n<p> decision as to whether the respondents will give<\/p>\n<p> effect to or not, they render administrative or<\/p>\n<p> quasi    judicial decision.    The respondents are<\/p>\n<p> public authorities. Therefore, even by virtue of<\/p>\n<p> Section 4(1)(d) of the Right to Information Act,<\/p>\n<p> 2005, the respondents are bound to give the<\/p>\n<p> petitioner the reason, if any, as to why they<\/p>\n<p> would not give effect to Ext.P1 order issued<\/p>\n<p> under the     Kerala Private Forests (Vesting and<\/p>\n<p> Assignment) Act. If the reason of the respondents<\/p>\n<p> is referable to the Kerala Forests (Vesting and<\/p>\n<p> Management of Ecologically Fragile Land) Act,<\/p>\n<p> that has to be clearly stated and a decision<\/p>\n<p> taken and communicated to the petitioner. No<\/p>\n<p> citizen can be forced to run from pillar to post<\/p>\n<p> even without being told a firm decision and the<\/p>\n<p> reason    for    that   decision.   The   executive<\/p>\n<p> establishment of a democratic Republic cannot<\/p>\n<p> make    oral  decisions.     It has to record  its<\/p>\n<p> decision on files and communicate it in writing<\/p>\n<p> to the concerned.\n<\/p>\n<p><span class=\"hidden_text\">WPC36472\/09            -: 4 :-<\/span><\/p>\n<p> In the aforesaid situation, the second respondent<\/p>\n<p> is directed to take up Ext.P1 and comply with it<\/p>\n<p> or issue a decision as to why Exts.P1 and P2 are<\/p>\n<p> not being complied with. If decision with reasons<\/p>\n<p> to   that   effect  is   not  communicated  to  the<\/p>\n<p> petitioner within two months from now, he will be<\/p>\n<p> treated    as  eligible    for restoration  without<\/p>\n<p> reference to the provisions of Kerala Forests<\/p>\n<p> (Vesting and Management of Ecologically Fragile<\/p>\n<p> Land)    Act and  the   respondents  will  put  the<\/p>\n<p> petitioner in possession of the property covered<\/p>\n<p> by Ext.P1 within one month therefrom. All issues<\/p>\n<p> on   merits  are  left    open.
