Justice M.SASIDHARAN NAMBIAR\n\n Dated :22\/12\/2010\n\n O R D E R\n               M.Sasidharan Nambiar, J.\n              --------------------------\n                Crl.M.C.No.4600 of 2010\n              --------------------------\n\n                         ORDER\n<\/pre>\n<p>    Petitioners are the accused and third respondent,<\/p>\n<p>the defacto complainant, in C.C.No. 241\/2010 on the<\/p>\n<p>file  of  Judicial  First  Class  Magistrate&#8217;s   Court,<\/p>\n<p>Mattannur, taken cognizance for the offences under<\/p>\n<p>Sections 463, 465, 471 and 120(b) read with Section 34<\/p>\n<p>of  Indian  Penal  Code  on  Annexure-A2 final  report<\/p>\n<p>submitted in Crime No. 556\/2008 of Mattannur Police<\/p>\n<p>Station, registered on the basis of a complaint filed<\/p>\n<p>by the third respondent before Judicial First Class<\/p>\n<p>Magistrate&#8217;s   Court,    Mattannur   and    sent    for<\/p>\n<p>investigation under Section 156(3) of Code of Criminal<\/p>\n<p>Procedure.\n<\/p>\n<p>    2. Prosecution case, as is clear from Annexure-A2<\/p>\n<p>final report, is that 10= cents in R.S.No.39\/2A of<\/p>\n<p>Koodaly Village belongs to the third respondent and in<\/p>\n<p>furtherance of the common intention of the petitioners,<\/p>\n<p>on 5.2.2007, first petitioner forged a sale deed in<\/p>\n<p>favour of second petitioner as if the property belongs<\/p>\n<p>to the first petitioner, when, in fact, the property<\/p>\n<p><span class=\"hidden_text\">CRMC 4600\/10               2<\/span><\/p>\n<p>belongs    to the third  respondent  and  it  was   got<\/p>\n<p>registered and used as genuine and thereby committed<\/p>\n<p>the offences. This petition is filed under Section 482<\/p>\n<p>of Code of Criminal Procedure to quash the proceedings<\/p>\n<p>contending   that  entire  disputes   with  the   third<\/p>\n<p>respondent were settled amicably and consequent to the<\/p>\n<p>settlement, it is not in the interest of justice to<\/p>\n<p>continue the prosecution.\n<\/p>\n<p>    3. Third respondent appeared through a counsel and<\/p>\n<p>filed an affidavit stating that entire disputes with<\/p>\n<p>the petitioners were settled amicably and consequent to<\/p>\n<p>the settlement, he has no subsisting grievance against<\/p>\n<p>the petitioners and therefore, he has no objection for<\/p>\n<p>quashing the proceedings.\n<\/p>\n<p>    4. Learned counsel appearing for the petitioners,<\/p>\n<p>third respondent and learned Public Prosecutor were<\/p>\n<p>heard.\n<\/p>\n<p>    5. Prosecution case is not that first petitioner<\/p>\n<p>impersonated third respondent or executed a sale deed<\/p>\n<p>as if it is being executed by the third respondent. On<\/p>\n<p>the other hand, the case is only that, though the<\/p>\n<p>property belongs to the third respondent and first<\/p>\n<p>petitioner has no right or title over that property,<\/p>\n<p><span class=\"hidden_text\">CRMC 4600\/10               3<\/span><\/p>\n<p>she executed a sale deed and registered it as if the<\/p>\n<p>property belongs to her. Even if the case is true, it<\/p>\n<p>would not attract an offence either under Section 463,<\/p>\n<p>or 465 or 471 of Indian Penal Code, as the document<\/p>\n<p>cannot be a false document as provided under Section<\/p>\n<p>464 of Indian Penal Code. Whatever it be, the affidavit<\/p>\n<p>filed by the third respondent establishes that he has<\/p>\n<p>settled all the disputes with the petitioners and he<\/p>\n<p>has no subsisting grievance against them. As held by<\/p>\n<p>the Apex Court in <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of Punjab<\/a><\/p>\n<p>(2008 (3) KLT 19) and Manoj Sharma v. State (2008 (4)<\/p>\n<p>KLT 417), when the offences alleged are purely personal<\/p>\n<p>in nature and third respondent has settled all the<\/p>\n<p>disputes amicably, it is not in the interest of justice<\/p>\n<p>to continue the prosecution, as consequent to the<\/p>\n<p>settlement there is no likelihood of a successful<\/p>\n<p>prosecution.\n<\/p>\n<p>     Petition is allowed.
