THE SARPANCH, DUMARI GRAM PANCHAYAT P.O. - DUMARI, BLOCK-\nSHEOSAGAR, DISTT.- ROHTAS\n                                  -----------\n<\/pre>\n<p>2\/   04\/11\/2010            Heard learned counsel for the petitioner and<\/p>\n<p>                  learned counsel for the State.\n<\/p>\n<p>                           The   petitioner   who   claims   to   have   been<\/p>\n<p>                  appointed on the post of Secretary, Gram Kutchery at<\/p>\n<p>                  Dumari Panchayat in Rohtas is aggrieved by the<\/p>\n<p>                  termination of his service by orders dated 30.10.2009<\/p>\n<p>                  and 17.2.2010 on the ground that he was not a resident<\/p>\n<p>                  of Dumari Panchayat.\n<\/p>\n<p>                           Learned counsel for the petitioner submits that<\/p>\n<p>                  he applied in the prescribed manner enclosing his<\/p>\n<p>                  residence certificate that he was a resident of Dumari<\/p>\n<p>                  Panchayat not only in his application but also at the time<\/p>\n<p>                  of counseling. These facts were fully considered by the<\/p>\n<p>                  authorities and after their satisfaction the petitioner was<\/p>\n<p>                  selected and appointed on 22.11.2007 whereafter he was<\/p>\n<p>                  called for training also. His original documents prior<br \/>\n<span class=\"hidden_text\">                    -2-<\/span><\/p>\n<p>thereto were examined on 19.11.2007. The service has<\/p>\n<p>then been terminated without enquiry or show cause<\/p>\n<p>notice as aforesaid and direction for return\/recovery of<\/p>\n<p>salary has been issued.\n<\/p>\n<p>           Learned counsel for the State is unable to<\/p>\n<p>demonstrate from the recitals in the impugned order that<\/p>\n<p>any show cause notice was issued to the petitioner,<\/p>\n<p>served upon him and only whereafter the order has been<\/p>\n<p>passed.\n<\/p>\n<p>           Under Rule-5 of the Bihar Gram Kutchery<\/p>\n<p>Secretary (Appointment, Service Conditions and Duties)<\/p>\n<p>Rules, 2007 it was a mandatory condition that the<\/p>\n<p>applicants had to be a resident of the concerned<\/p>\n<p>Panchayat. Once the petitioner was appointed by the<\/p>\n<p>respondents, a presumption is there that official acts<\/p>\n<p>were properly performed and his qualifications were<\/p>\n<p>properly examined under Section-114(e) for the Indian<\/p>\n<p>Evidence Act. The presumption is certainly rebuttable,<\/p>\n<p>but subject to compliance with the principles of natural<\/p>\n<p>justice.\n<\/p>\n<p>           There is no discussion in the impugned orders<\/p>\n<p>that any show cause notice had been issued to the<\/p>\n<p>petitioner before termination. It is the specific assertion of<\/p>\n<p>the petitioner in paragraph-13 of the writ application that<\/p>\n<p>the order was in violation of the principles of natural<br \/>\n<span class=\"hidden_text\">                         -3-<\/span><\/p>\n<p>     justice.\n<\/p>\n<p>                The impugned orders dated 30.10.2009 and<\/p>\n<p>     17.2.2010 are accordingly set aside.
