DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 24\/03\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p> The  learned Additional   Public  Prosecutor for the State waives<br \/>\nthe service of Rule for the respondent-State.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel for the parties.\n<\/p>\n<p>\tThis<br \/>\napplication is filed by the applicants under Section 439 of the Code<br \/>\nof Criminal Procedure for regular bail in connection with first<br \/>\ninformation report registered at C.R.No.I-15 of 2011 with Vansda<br \/>\npolice station for the offences punishable under Sections 465, 468,<br \/>\n471 and 114 of the Indian Penal Code.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel for the parties and perused the record.\n<\/p>\n<p>\tConsidering<br \/>\nthe nature of offences and the punishment prescribed under the Code<br \/>\nand the Court in which it is triable, without discussing the evidence<br \/>\nin detail, prima facie, this Court is of the opinion that this is a<br \/>\nfit case to exercise the discretion to enlarge the applicants on<br \/>\nbail.\n<\/p>\n<p>\tThe<br \/>\nparties do not press for further reasoned order.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicants are ordered to be released on bail in connection<br \/>\nwith first information report registered at C.R.No.I-15 of 2011  with<br \/>\nVansda Police Station on executing a bond of Rs.5,000\/- (Rupees five<br \/>\nthousand only) each with one surety of the like amount to the<br \/>\nsatisfaction of the trial court and subject to the conditions that<br \/>\nthey shall<\/p>\n<p>(i)<br \/>\nnot take undue advantage of liberty or misuse liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injuries to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\tpresence at the concerned police station on the first Sunday of<br \/>\n\tevery month between 10 a.m. and 3 p.m for three months only.\n<\/p>\n<p>furnish<br \/>\n\tthe present  addresses of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>shall<br \/>\n\tnot enter the Districts of Navsari, Valsad, Dang and Surat for a<br \/>\n\tperiod of six months, except for marking presence and attending the<br \/>\n\ttrial.\n<\/p>\n<p>\tThe<br \/>\nAuthorities will release the applicants only if he is not required in<br \/>\nconnection with any other offence for the time being. If breach of<br \/>\nany of the above conditions is committed, the Sessions Judge<br \/>\nconcerned will be free to issue warrant or take appropriate action in<br \/>\nthe matter. Bail bond to be executed before the lower court having<br \/>\njurisdiction to try the case.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent. D.S.
