Hospital,            Jaipur.      His    case    was\n\nreferred for examination by a penal of experts and the\n\npenal     of    experts       recommended            for       Coronary    Artery\n\nBypass    Grafting.        The   Medical            Board      approved    bypass\nsurgery at Escorts Health Institute &amp; Research Centre,\n\nNew     Delhi.        On      25.3.2006             the     petitioner         felt\n\nbreathlessness and chest pain, therefore, he was taken\n\nto Escorts Goyal Heart Centre, Jodhpur wherein he was\n\nadmitted and operated for bypass surgery. The surgery\n\nwas     made    on     28.3.2006.           A   sum       of     Rs.1,25,000\/-,\n\nincurred in medical treatment at Escorts Goyal Heart\n\nCentre, Jodhpur and that was claimed for reimbursement\n\nas per the provisions of the Rajasthan Civil Services\n\n(Medical Attendance) Rules, 1970 (hereinafter referred\n\nto as \"the Rules 1970\"), however, no payment of same\n                                           2\n\nwas made on the count that the hospital where the\n\npetitioner        underwent         surgery         is     not    an    empaneled\n\nhospital. Being aggrieved by denial for reimbursement\n\nof   medical       expenses,         this          petition       for       writ     is\n\npreferred.\n\n\n\n             The contention of counsel for the petitioner\n\nis   that    the        petitioner            suffered          chest       pain     on\n\n25.3.2006    and,        therefore,           he    was    taken       to    Escorts\n\nGoyal Heart Centre, Jodhpur and looking to emergency a\n\nbypass surgery was made. It is asserted that in such\n\nemergent circumstances, it was not possible to search\n\nan empaneled hospital as the basic need was of saving\n\nthe life.\n\n\n\n             In     reply       to       the       writ     petition         it     is\n\nreiterated that the hospital where the petitioner has\n\nundertaken bypass surgery is not an empaneled one and,\n\ntherefore, he        is    not entitled              for    reimbursement of\n\nmedical expenses.\n\n\n\n             This       Court   in       the       case    of    Thomas      T.     Vs.\n\nState   of    Rajasthan         &amp;    Ors.,          SBCivil      Writ       Petition\n\nNo.3749\/2006,       decided         on    14th      September,         2006,       held\n\nthat in the circumstances when Government servant is\n\nhaving no option but to take immediate treatment, he\n\nis entitled to get reimbursement of medical expenses\n\nirrespective of the fact that whether such a hospital\n\nis   enlisted      or    not    by       Government        of     Rajasthan         for\n                                3\n\nreimbursement   of   medical       expenses.   Similarly,   this\n\nCourt in SBCivil Writ Petition No.5683\/2005, Mandal\n\nDutt Purohit v. State of Rajasthan &amp; Ors., decided on\n\n3.10.2006, held as under:-\n\n\n\n         \"It is not at all disputed that the\n         petitioner has undergone an angiography and\n         cardiac artery bypass at Goyal Hospital &amp;\n         Research   Centre  Pvt.   Ltd.,   Jodhpur   on\n         9.9.2004. The petitioner on facing an acute\n         cardiac pain was admitted to the hospital\n         concerned on 4.9.2004 and under a competent\n         medical advice he was subjected to emergent\n         angiography and coronary artery bypass. In\n         such crucial circumstances the petitioner was\n         having no option but to undergo the treatment\n         wherever the treatment was available at\n         earliest. It shall be highly unjust to expect\n         from a person battling for life to proceed\n         for a hospital recognised by the Government\n         of Rajasthan for getting the medical expenses\n         reimbursed. The prime consideration in such\n         situation is to bring the life in safe zone,\n         beyond the cost consideration. The government\n         has   provided  statutory   medical   benefits\n         including reimbursement of expenses incurred\n         in treatment. The main object behind it is to\n         extend a helping hand to its employees\n         suffering ailment, the place of treatment is\n         a    secondary    consideration.     If    the\n         reimbursement is made absolutely dependent to\n         the place of treatment then it shall not only\n         be arbitrary but shall also be contrary to\n         the fundamental right for protection of\n         life.\"\n                                      4\n\n               In    the   instant    matter      too   the    petitioner\n\nunderwent bypass surgery in emergent circumstances and\n\nas   such      the     denial   of       reimbursement        of    medical\n\nexpenses as per the provisions of the Rules of 1970 is\n\nunjust. The respondents should have made reimbursement\n\nof the medical expenses to the petitioner as per the\n\nprovisions of Rule 4(e) of the Rules of 1970.\n\n\n\n               The petition for wit, therefore, is allowed.\n\nThe respondents are directed to reimburse the medical\n\nexpenses to the petitioner as per the provisions of\n\nRule 4(e) of the Rules of 1970.
