Justice P.N.RAVINDRAN\n\n Dated :14\/10\/2008\n\n O R D E R\n                      P.N.RAVINDRAN, J.\n\n                   -------------------------------\n\n                     W.P.(C) No.3850 of 2006\n\n                   -------------------------------\n\n                Dated this the 14th October, 2008.\n\n                         J U D G M E N T\n<\/pre>\n<p>               The petitioners are persons included in Ext.P2<\/p>\n<p>ranked list for appointment to the post of Offset Printing Machine<\/p>\n<p>Operator Grade II in the Printing (Government Presses)<\/p>\n<p>Department. Ext.P2 ranked list came into force with effect from<\/p>\n<p>17.10.2005 and will cease to be in force on 16.10.2008. The<\/p>\n<p>petitioners have, in this writ petition, prayed for the following<\/p>\n<p>reliefs:-\n<\/p>\n<\/p>\n<blockquote><p>           (i)    Stay further appointments on other duty<br \/>\n                  and extension of appointments on other<br \/>\n                  duty for operating offset machines in<br \/>\n                  the Govt Presses;<\/p><\/blockquote>\n<p>           (ii)   direct the 2nd respondent to furnish the<br \/>\n                  details of the offset machines installed<br \/>\n                  and operating in each of the Govt<br \/>\n                  Presses with the no. of Printing Machine<br \/>\n                  Operators required for those machines<br \/>\n                  in each press as well as the no. of posts<br \/>\n                  of Offset Printing Machine Operators<\/p>\n<p>W.P.(C) No.3850\/2006<\/p>\n<p><span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>                    sanctioned so far, before this Hon&#8217;ble<br \/>\n                    Court.\n<\/p>\n<\/p>\n<p>            (iii)   direct the 2nd respondent to report such<br \/>\n                    number     of  vacancies   to the   PSC<br \/>\n                    reckoning the same as 2\/3 of the total<br \/>\n                    posts   of   Offset  Machine  Operators<br \/>\n                    required to operate the offset machines<br \/>\n                    installed in the Govt Presses.\n<\/p>\n<\/p>\n<p>                2.   According to the petitioners, in the Offset<\/p>\n<p>Printing Presses maintained by the State Government, 118<\/p>\n<p>persons are required to man the machines and that as per Ext.P3<\/p>\n<p>order, 66 2\/3 percentage of the said 118 posts are liable to filled<\/p>\n<p>up by advising\/appointing candidates included in Ext.P2 ranked<\/p>\n<p>list. The short question is whether there are 118 posts of Offset<\/p>\n<p>Printing Machine operators Grade II in various Government<\/p>\n<p>Presses under the Printing (Government Presses) Department.<\/p>\n<p>                3.    The respondents have filed two counter<\/p>\n<p>affidavits.   In the first counter affidavit dated 6.10.2006, the<\/p>\n<p>respondents have stated that 32 candidates advised by the<\/p>\n<p>Kerala Public Service Commission from Ext.P2 ranked list were<\/p>\n<p>W.P.(C) No.3850\/2006<\/p>\n<p><span class=\"hidden_text\">                                3<\/span><\/p>\n<p>appointed in the Government Presses at Mannanthala, Vazhoor<\/p>\n<p>(Kottayam), Ernakulam and Wayanad and that 17 posts are set<\/p>\n<p>apart to be filled up by promotion\/appointment by transfer of<\/p>\n<p>qualified employees in the Printing Department. It is also stated<\/p>\n<p>that though 118 persons from the letterpress side have been<\/p>\n<p>deployed in the Offset Wing, they are not working against<\/p>\n<p>sanctioned posts and are being paid salary only in the sanctioned<\/p>\n<p>post of Printer.       In the additional counter affidavit dated<\/p>\n<p>2.8.2008, the respondents have stated that only 50 posts of<\/p>\n<p>Offset Printing Machine Operators Grade II exist in the<\/p>\n<p>department and that 33 out of the said 50 vacancies have been<\/p>\n<p>filled up by advising\/appointing candidates included in Ext.P2<\/p>\n<p>ranked list. It is further stated that the remaining 17 vacancies<\/p>\n<p>are earmarked for appointment by transfer from among Printers<\/p>\n<p>in the Letter Press side.\n<\/p>\n<\/p>\n<p>                4. From the materials on record, it is evident that<\/p>\n<p>the sanctioned strength of Offset Printing Machine Operators<\/p>\n<p>Grade I and II is 50 and that 66 2\/3 percentage of the said<\/p>\n<p>W.P.(C) No.3850\/2006<\/p>\n<p><span class=\"hidden_text\">                                  4<\/span><\/p>\n<p>sanctioned posts have been filled up by appointing candidates<\/p>\n<p>included in Ext.P2 ranked list. There is total lack of material on<\/p>\n<p>record to hold that 118        sanctioned posts of Offset Printing<\/p>\n<p>Machine Operators Grade I and II existed in the Government<\/p>\n<p>Presses while Ext.P2 ranked list was in force and that 66 2\/3<\/p>\n<p>percentage of the said posts are available to be filled up by<\/p>\n<p>appointing candidates included in Ext.P2 ranked list.              The<\/p>\n<p>petitioners have not been able to show that the sanctioned<\/p>\n<p>strength of Offset Printing Machine Operators Grade II exceeds<\/p>\n<p>50.    Though the      respondents concede         the entitlement of<\/p>\n<p>persons included in Ext.P2 ranked list for appointment to 66 2\/3<\/p>\n<p>percentage of the vacancies, their stand is that it is restricted to<\/p>\n<p>33 posts in all.\n<\/p>\n<\/p>\n<p>                In this state of affairs, the reliefs sought for by the<\/p>\n<p>petitioners    cannot   be   granted.       The    respondents    have<\/p>\n<p>substantially accepted the contentions of the petitioners by filling<\/p>\n<p>up 66 2\/3 percentage of the available vacancies of Offset Printing<\/p>\n<p>Machine Operators Grade II by appointing candidates included in<\/p>\n<p>W.P.(C) No.3850\/2006<\/p>\n<p><span class=\"hidden_text\">                               5<\/span><\/p>\n<p>Ext.P2 ranked list. The petitioners are therefore not entitled to<\/p>\n<p>the reliefs     sought  in the writ petition.
