BALAKRISHNAN NAIR &amp; M.C.HARI RANI, JJ.\n                  ----------------------------------------\n      W.P.(C) Nos.19484 OF 2008 &amp; 16325 OF 2006\n                  ----------------------------------------\n         Dated this the 17th day of December, 2008\n\n                          J U D G M E N T\n<\/pre>\n<p>                          ~~~~~~~~~~~<\/p>\n<p>Balakrishnan Nair, J.\n<\/p>\n<p>     The    petitioners     are     practising     Electropathy\/Electro-<\/p>\n<p>Homeopathy. They say, they have the necessary qualifications<\/p>\n<p>for the same.       The practitioners of Modern Medicine and<\/p>\n<p>Homeopathy are moving the police and the police are<\/p>\n<p>unnecessarily threatening and harassing them, it is submitted.<\/p>\n<p>They are being frequently summoned to the police station.<\/p>\n<p>Threats are also held out to raid their places of practice and<\/p>\n<p>close down their establishments. In the above background, this<\/p>\n<p>writ petition is filed, seeking the following reliefs:<\/p>\n<blockquote><p>           i)     declare that the petitioners are entitled<br \/>\n           to practice Electropathy\/Electro-Homeopathy<br \/>\n           and that neither the respondents nor any<br \/>\n           other person or persons have any manner of<br \/>\n           (sic-or)   authority    to   interfere    with  the<br \/>\n           petitioners&#8217; practice of the aforesaid system<br \/>\n           of medicine.\n<\/p><\/blockquote>\n<blockquote><p>           ii)    issue a writ of mandamus or any other<br \/>\n           appropriate writ order or direction directing<br \/>\n           the    respondents     not    to   interfere   with<\/p>\n<p><span class=\"hidden_text\">W.P.(C) Nos.19484\/2008&amp; 16325\/06    2<\/span><\/p>\n<p>             Electropathy\/Electro-Homeopathy practice of<br \/>\n             the petitioners;\n<\/p><\/blockquote>\n<blockquote><p>             iii)  issue a writ of mandamus or any other<br \/>\n             appropriate writ order or direction directing<br \/>\n             the third respondent and the officers under<br \/>\n             him not to harass or to intimidate the<br \/>\n             petitioners or to obstruct them in the course<br \/>\n             of      their      practice   or      (sic-of)<br \/>\n             Electropathy\/Electro-Homeopathy.<\/p><\/blockquote>\n<p>      2.    The learned senior counsel, Mr.Govindh.K.Bharathan,<\/p>\n<p>who appeared for the writ petitioners, submitted that practice of<\/p>\n<p>Electropathy\/Electro-Homeopathy is not prohibited by any<\/p>\n<p>statute in force in India or in Kerala. They are not practising<\/p>\n<p>modern medicine or Homeopathy or any Indian System of<\/p>\n<p>Medicine, like Ayurveda or Unani. For prasticing those systems<\/p>\n<p>of medicine, registration under the Travancore &#8211; Cochin Medical<\/p>\n<p>Council     Act is mandatory. For getting such registration, the<\/p>\n<p>applicants should possess the prescribed qualifications also. But,<\/p>\n<p>Electropathy\/ Electro-Homeopathy is an entirely different system<\/p>\n<p>of medicine. Its practice is not controlled by any statute in India.<\/p>\n<p>It is not prohibited by any law also. Therefore, the petitioners<\/p>\n<p>have a fundamental right under Article 19(1)(g) of the<\/p>\n<p>Constitution of India to proceed with the practice of the above<\/p>\n<p><span class=\"hidden_text\">W.P.(C) Nos.19484\/2008&amp; 16325\/06  3<\/span><\/p>\n<p>said system of medicine, it is submitted.\n<\/p>\n<\/p>\n<p>      3.    Though the State of Kerala as also the Travancore &#8211;<\/p>\n<p>Cochin Medical Council are parties to this writ petition, they<\/p>\n<p>have chosen not to file any counter affidavit. We heard the<\/p>\n<p>learned Government Pleader for the official respondents.<\/p>\n<p>      4.    It is one of the fundamental principles of rule of law<\/p>\n<p>that a citizen is free to do anything not prohibited by law. Every<\/p>\n<p>State action must be supported by a statutory provision. If a<\/p>\n<p>citizen challenges a State action, the State must be able to show<\/p>\n<p>the strict legal pedigree of its action. Otherwise, the courts will<\/p>\n<p>invalidate that action. In this case, the respondents have not<\/p>\n<p>brought to our notice any law, which prohibits the practice of<\/p>\n<p>Electropathy\/Electro-Homeopathy. So, the State or its agents<\/p>\n<p>shall not interfere with the same. But, the petitioners shall not<\/p>\n<p>use designations like &#8216;Doctor&#8217; etc.       They shall not practice<\/p>\n<p>Modern Medicine, Homeopathy or any of the Indian Systems of<\/p>\n<p>Medicine. They shall not act in violation of the provisions of the<\/p>\n<p>Kerala Abkari Act or Drugs and Cosmetics Act or other relevant<\/p>\n<p>Acts or Rules. If the petitioners continue their Electropathy\/<\/p>\n<p><span class=\"hidden_text\">W.P.(C) Nos.19484\/2008&amp; 16325\/06   4<\/span><\/p>\n<p>Electro-Homeopathy practice, without infringing any other<\/p>\n<p>provisions of law, the police shall not interfere with the same.<\/p>\n<p>Unless the petitioners commit some cognizable offence by<\/p>\n<p>practising Electorpathy \/ Electro-Homeopathy, the police have no<\/p>\n<p>power or authority to interfere with their practice or summon<\/p>\n<p>them to the police station with a view to prevent their practice<\/p>\n<p>of Electropathy \/ Electro-Homeopathy.\n<\/p>\n<\/p>\n<p>     4.     It is clarified that this judgment will not affect the<\/p>\n<p>powers of the State or its agents to proceed in accordance with<\/p>\n<p>law, if the petitioners are found to act in violation of any<\/p>\n<p>statutory provision.\n<\/p>\n<p>     The writ petition is disposed of as above.\n<\/p>\n<p>W.P.(C) No.16325\/2006<\/p>\n<p>     The point raised by the petitioner is covered by our<\/p>\n<p>judgment in W.P.(C) No.19484\/2008 .
