Justice V.RAMKUMAR\n\n Dated :16\/01\/2007\n\n O R D E R\n\n\n                                  V.Ramkumar, J.\n\n                  ========================\n\n                               B.A.No. 105 of 2007\n\n                  ========================\n\n\n               Dated this the 16th day of January,  2007.\n\n\n                                         ORDER\n<\/pre>\n<p>         Petitioners,   who   are   accused   Nos.   1   and   2   in   Crime   No.725   of<\/p>\n<p>2006   of     Venjaramood   Police   Station   for   offences   punishable   under<\/p>\n<p>Sections   420,   465   and   468   read   with   Section   34   I.P.C.,   seek<\/p>\n<p>anticipatory bail.\n<\/p>\n<\/p>\n<p>         2.   The   learned   public   Prosecutor   opposed   the   application.   The<\/p>\n<p>case of the prosecution is that the accused persons had cheated the de<\/p>\n<p>facto complainant by preparing a forged sale deed in favour of the first<\/p>\n<p>petitioner with regard to nearly 1 acre of land belonging to the de facto<\/p>\n<p>complainant.\n<\/p>\n<\/p>\n<p>         3.   Anticipatory bail cannot be granted in a case of this nature.<\/p>\n<p>But   at   the   same   time   I   am   inclined   to   grant   the   petitioner   an<\/p>\n<p>opportunity   to   surrender   before   the   Investigating   Officer   for<\/p>\n<p>interrogation   and   then   to   have   his   application   for   regular   bail<\/p>\n<p>considered   by   the   Magistrate   concerned.     Accordingly,   the   petitioner<\/p>\n<p>shall   surrender   before   the   Investigating   Officer   on   any   day   between<\/p>\n<p>18.1.2007   and   20.1.2007   for   the   purpose   of     interrogation   and<\/p>\n<p><span class=\"hidden_text\">BA 105\/07                                -: 2 :-<\/span><\/p>\n<p>recovery   of   incriminating   material,   if   any.     The   petitioner   shall<\/p>\n<p>thereafter be produced before  the Magistrate concerned on the same<\/p>\n<p>day.
