The demand in the said<br \/>\n\tNotice dated 25.10.2004 was the duties of excise equal to the<br \/>\n\taggregate of the duties of the Customs leviable on raw material,<br \/>\n\trejects and the Wastes, rather than on the finished products.\n<\/p>\n<p>(B)<br \/>\n\tWhether in the facts and the circumstances of the case, the learned<br \/>\n\tTribunal is justified in law in remanding the matter essentially for<br \/>\n\tthe de-novo adjudication by the original adjudicating authority for<br \/>\n\tthe purpose of the re-determination of the Quantum of the Penalty,<br \/>\n\tas well as, considering the applicability of the Extended Period?\n<\/p>\n<p>Heard<br \/>\n\tMr. Gaurang H. Bhatt, learned Standing Counsel appearing for the<br \/>\n\tappellant-revenue and perused the orders passed by the authorities<br \/>\n\tbelow.  So far as, question (A) is concerned, the Tribunal has<br \/>\n\tobserved in its order that the duty chargeable on the finished<br \/>\n\tproducts cleared by M\/s. Opel Fabrics is to be charged under the<br \/>\n\tmain Proviso of Section 3 of Central Excise Act is not correct. The<br \/>\n\tTribunal has further observed that it is settled law that if duty is<br \/>\n\tdemanded on the finished products, duty benefit can not be demanded<br \/>\n\ton the raw materials. The Tribunal has, therefore, remanded the<br \/>\n\tmatter to the original adjudicating authority in relation to<br \/>\n\tredetermine the duty liability in the finished products under<br \/>\n\tProviso to Section 3(1) of the Central Excise Act, 1944.\n<\/p>\n<p>Since<br \/>\n\tthe issue is decided in favour of the revenue, there is no question<br \/>\n\tof raising this question before this Court, we are, therefore, of<br \/>\n\tthe view that the question (A) is not arising out of the order of<br \/>\n\tthe Tribunal.\n<\/p>\n<p>So<br \/>\n\tfar as, question (B) is concerned the Tribunal has merely remanded<br \/>\n\tthe matter back to the adjudicating authority for de-novo<br \/>\n\tadjudication for the purpose of re-determination of quantum of<br \/>\n\tpenalty as well as for consideration of applicability of the<br \/>\n\textended period. The Tribunal has clearly observed in its order that<br \/>\n\tthis issue was not considered at all by the adjudicating authority<br \/>\n\tor by the Appellate authority.\n<\/p>\n<p>Since<br \/>\n\tthe matter is remanded to the adjudicating authority for<br \/>\n\tconsideration of this issue, we are of the view that no question of<br \/>\n\tlaw, much less, any substantial question of law is arising out of<br \/>\n\tthe order of the Tribunal.
