The State of Rajasthan \n\nDate of Order :::  20.05.2010\n\nHon'ble Mr. Justice Mohammad Rafiq\n\nShri\tRajendra Singh Tanwar, Counsel for petitioners\nShri\tAmit Punia, Public Prosecutor\n####\n\nBy the Court:-<\/pre>\n<p>Heard learned counsel for petitioners as well as learned Public Prosecutor and perused the material made available to me during the arguments of the case.\n<\/p>\n<p>Learned counsel for petitioners argued that it is the first offence alleged against the petitioners; they were found in possession of illegal country made English liquor and the said offence is triable by a Magistrate.\n<\/p>\n<p>After considering all the facts and circumstances of the case and without expressing any opinion on its merits and demerits, I deem it just and proper to release the accused-petitioners, namely, (1) Gurudev Singh Son of Shri Manjit Singh and (2) Kundan Singh Son of Shri Surjit Singh on bail under Section 439 Cr.P.C., in FIR No.63\/2009-10, registered at Excise Police Station Gumanpura, Kota, provided each of them furnishes a personal bond in the sum of Rs.30,000\/- with two sureties of Rs.15000\/- each to the satisfaction of the trial court for their appearance on all subsequent dates of hearing and as and when called upon to do so.\n<\/p>\n<p>However, in case petitioners are found indulged in repeating the similar offence at any point of time the prosecution will be at liberty to apply for cancellation of their bail before the court below itself .\n<\/p>\n<p>The bail application stands disposed of.\n<\/p>\n<p>(Mohammad Rafiq) J.\n<\/p>\n<p>\/\/Jaiman\/\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court Gurudev Singh And Anr vs State Of Rajasthan on 20 May, 2010 IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR ORDER IN S.B.
