JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/02\/2011  \n \nORAL JUDGMENT<\/pre>\n<p>1.\tRule.\n<\/p>\n<p>Mr.Pranav Trivedi, learned Assistant Government Pleader waives<br \/>\nservice of notice of Rule on behalf of respondents. On the facts and<br \/>\nin the circumstances of the case, and with the consent of the learned<br \/>\ncounsel for the respective parties, the petition is being heard and<br \/>\nfinally decided, today.\n<\/p>\n<p>2.\tThis<br \/>\npetition, under Article 226 of the Constitution of India has been<br \/>\nfiled, with the following prayers :\n<\/p>\n<p> The<br \/>\nHonourable Court may be pleased to issue a writ of mandamus or any<br \/>\nother appropriate writ, order or<br \/>\ndirection to the respondent authorities and may be pleased to<br \/>\n:-\n<\/p>\n<p> (A)\tquash<br \/>\nand set aside the impugned communication dated 15.1.2009, Annexure-A<br \/>\nto this petition, whereby the<br \/>\napplication of the petitioner for compassionate appointment is<br \/>\nrejected, and<\/p>\n<p>(B)\tfurther<br \/>\nbe pleased to direct respondent Board to reconsider the case of the<br \/>\npetitioner for appointment on compassionate ground, and <\/p>\n<p>(C)\taward<br \/>\nthe cost of the petition, and<\/p>\n<p>(D)\tpending<br \/>\nadmission and final disposal of this petition, the  Honourable Court<br \/>\nmay be pleased to respondent authorities to reconsider the case of<br \/>\nthe petitioner for appointment on compassionate ground, and\/or<\/p>\n<p>(E)\tgrant<br \/>\nany other relief or pass any other order which the Honourable Court<br \/>\nmay consider as just and proper in the facts and circumstances of the<br \/>\ncase.\n<\/p>\n<p>3.\tBriefly<br \/>\nstated, the facts of the case are that, the father of the petitioner,<br \/>\nShri Bhurabhai Mansurbhai Dangar, who was working as Armed Police<br \/>\nConstable in the Police Department, expired in harness on 9.12.2006,<br \/>\nleaving behind a widow, two sons and a daughter. The petitioner,<br \/>\nbeing the eldest son in the family, made an application for<br \/>\ncompassionate appointment to Superintendent of Police, Junagadh<br \/>\n(respondent No.3), on 8.2.2007, which was forwarded to the Gujarat<br \/>\nSubordinate Service Selection Board for further necessary procedure,<br \/>\nas per letter dated 1.2.2008 of the respondents. The petitioner did<br \/>\nnot hear anything with regard to his above-mentioned application and<br \/>\nrespondent No.3 informed the petitioner on 15.1.2009 that the said<br \/>\napplication has been rejected by the authorities on the ground that<br \/>\nhe has not acquired the minimum qualification, that is, Secondary<br \/>\nSchool Certificate Examination (&#8216;SSC&#8217;, for short), within the<br \/>\nstipulated period of six months from the date of death of his father.<br \/>\nThe petitioner, thereafter, appeared in the  SSC examination in<br \/>\nMarch, 2007, but could not clear one paper, which ultimately was<br \/>\ncleared by the petitioner in July, 2007, that is, shortly after the<br \/>\nperiod of six months after the death of his father on 9.12.2006.<br \/>\nAggrieved by the rejection of the application, the petitioner has<br \/>\napproached this Court by filing the present petition.\n<\/p>\n<p>4.\tMs.Harshal<br \/>\nPandya, learned advocate for       Mr.Paresh Upadhyay, learned<br \/>\ncounsel for the petitioner has submitted that the rejection of the<br \/>\napplication of the petitioner on the ground that he has not passed<br \/>\nthe SSC Examination within six months from the date of death of his<br \/>\nfather is unjust and arbitrary, as the said period of six months<br \/>\nexpired on 9.6.2007 whereas the petitioner obtained the necessary<br \/>\nqualification in the month of July, 2007 itself. It is further<br \/>\nsubmitted that the embargo of six months contained in Government<br \/>\nResolution dated 10.3.2000 is not realistic, as it is not in the<br \/>\nhands of the dependent of the deceased employee, to clear the<br \/>\nexamination within the stipulated period of six months, as the date<br \/>\nof death of the employee cannot be known in advance.\n<\/p>\n<p>5.\tThe<br \/>\nlearned counsel for the petitioner has brought to the notice of this<br \/>\nCourt, order dated 15.10.2010, passed in Special Civil Application<br \/>\nNo.8553\/2010 wherein the Court had directed the respondents to<br \/>\nconsider the case of the petitioner therein for appointment on<br \/>\ncompassionate grounds, in similar circumstances. It is stated by the<br \/>\nlearned advocate for the petitioner that the respondents may be<br \/>\ndirected to consider the case of the petitioner in the light of the<br \/>\nobservations of the Court made in this judgment.\n<\/p>\n<p>6.\tMr.Pranav<br \/>\nTrivedi, learned Assistant Government Pleader submits that the<br \/>\npetitioner did not obtain the requisite qualifications of SSC within<br \/>\na period of six months from the date of death of his father,<br \/>\ntherefore, his request has been rightly rejected.\n<\/p>\n<p>7.\tI<br \/>\nhave heard the learned counsel for respective parties and perused the<br \/>\naverments made in the petition and other documents on record.\n<\/p>\n<p>8.\tIn<br \/>\nSpecial Civil Application No.8553\/2010, decided by order dated<br \/>\n15.10.2010, the petitioner therein had made an application seeking<br \/>\nappointment on compassionate grounds within the time limit of six<br \/>\nmonths. However, he did not possess the minimum educational<br \/>\nqualifications of new SSC on the date of filing his application,<br \/>\ntherefore, such appointment was denied to him. In such a situation,<br \/>\nthe observations made in the said order are reproduced hereinbelow :\n<\/p>\n<p> 3.\t\tAny<br \/>\ninsistence for a particular qualification that too for giving<br \/>\nappointment in Class-IV category while considering the case for<br \/>\nappointment on compassionate ground is nothing but indirectly<br \/>\nfrustrating the object of giving appointment on compassionate ground,<br \/>\nmore so, when the candidate is not possessing qualification of new<br \/>\nSSC on the date of his filing the application and the result is<br \/>\ndeclared thereafter.  In the present case, the result was declared on<br \/>\n31.5.2007. The action of the authority, rejecting the application on<br \/>\nthis ground is not only unjust, but arbitrary as it frustrates the<br \/>\nentire object of providing the scheme for giving appointment on<br \/>\ncompassionate ground.\n<\/p>\n<p>3.1\tTaking<br \/>\ninto consideration the fact that the father of the petitioner was<br \/>\nserving as Peon in the office of the Collector, Porbandar, what is<br \/>\nclaimed by the petitioner is only appointment on compassionate ground<br \/>\nand the object of floating the scheme for giving appointment on<br \/>\ncompassionate ground is to see that the family is not pushed into<br \/>\npitiable condition on sad demise of bread earner.  In the present<br \/>\ncase, the petitioner was not holding the new SSC examination<br \/>\nqualification is not something which was within the control of the<br \/>\npetitioner and more particularly unfateful event of the death of the<br \/>\npetitioner&#8217;s father was certainly not within the control of anybody.<br \/>\nIt cannot be foreseen by the petitioner to expedite the getting of<br \/>\nrequired qualification only because his father is going to expire on<br \/>\na particular day similarly it is not possible for the father of the<br \/>\npetitioner to postpone the death until his son gets the qualification<br \/>\nof new SSC so as to enable him to get appointment on compassionate<br \/>\nground.\n<\/p>\n<p>4.\tIn<br \/>\nview of the aforesaid discussion, this Court finds that the decision<br \/>\nof the authority of denying the appointment on compassionate ground<br \/>\nto the petitioner is unjust, arbitrary and is required to be quashed<br \/>\nand set aside.  It is accordingly quashed and set aside.  The<br \/>\nauthorities are directed to consider and appoint the petitioner on<br \/>\ncompassionate ground within six weeks from the date of receipt of<br \/>\nthis order.  Rule is made absolute to the aforesaid extent.  No<br \/>\ncosts.\n<\/p>\n<p>9.\tIn<br \/>\nthe present case, the impugned order dated 15.1.2009 reveals that the<br \/>\ncase of the petitioner for appointment on compassionate grounds has<br \/>\nbeen rejected, as he did not acquire the qualification of SSC within<br \/>\na period of six months from the date of death of his father. In view<br \/>\nof the observations made in order dated 15.10.2010 reproduced<br \/>\nhereinabove and the statement of the learned advocate of the<br \/>\npetitioner, the case of the petitioner requires reconsideration at<br \/>\nthe hands of the respondents.\n<\/p>\n<p>10.\tIt<br \/>\nis stated by Ms.Harshal Pandya, learned advocate for Mr.Paresh<br \/>\nUpadhyay, learned counsel for the petitioner that order dated<br \/>\n15.10.2010 in Special Civil Application No.8553\/2010 has not been<br \/>\nchallenged by the respondents. Considering the above facts and<br \/>\ncircumstances and as the petitioner has now passed the requisite<br \/>\nexamination, the interest of justice would be met, if the respondents<br \/>\nare directed to reconsider the case of the petitioner in right<br \/>\nperspective, keeping in view the observations made in order dated<br \/>\n15.10.2010 passed in Special Civil Application No.8553\/2010. It is so<br \/>\ndirected. The decision, after reconsideration, may be  conveyed to<br \/>\nthe petitioner at the earliest. The petitioner shall be at liberty to<br \/>\napproach this Court, if aggrieved.\n<\/p>\n<p>\tThe<br \/>\npetition is disposed of, in the above terms, without entering into<br \/>\nthe merits of the case.
