Justice R.BASANT\n\n Dated :20\/06\/2007\n\n O R D E R\n                                    R.BASANT, J\n\n                          ------------------------------------\n\n                              B.A.No.3727 of 2007\n\n                         -------------------------------------\n\n                      Dated this the 20th day of June, 2007\n\n\n                                        ORDER\n<\/pre>\n<p>       Application   for   regular   bail.     Petitioner   is  the  2nd  accused.     He<\/p>\n<p>had   allegedly   transported   7315   litres   of   spirit   in   a   vehicle   on<\/p>\n<p>19.04.2007.     He   was   intercepted   and   arrested   on   that   date.     He<\/p>\n<p>continues   in   custody   from   that   date.     The   learned   counsel   for   the<\/p>\n<p>petitioner   submits   that   the   petitioner   is   innocent.     At   any   rate,   a<\/p>\n<p>period   of   60   days   having   elapsed   from   the   date   of   first   remand   and<\/p>\n<p>the final report having not been filed, the petitioner is entitled to bail<\/p>\n<p>as   right   by   default,   submits   the   learned   counsel   for   the   petitioner.<\/p>\n<p>The learned Public Prosecutor   accepts that the petitioner is entitled<\/p>\n<p>for bail by default under Section 167 Cr.P.C.  Investigation having not<\/p>\n<p>been completed so far,   I am satisfied notwithstanding the gravity  of<\/p>\n<p>the offence alleged that bail must be granted to the petitioner in these<\/p>\n<p>circumstances.\n<\/p>\n<\/p>\n<p>       2.      In   the   result,   this   application   is   allowed.     The   petitioner<\/p>\n<p>shall be released on bail on the following terms and conditions.<\/p>\n<p>       i)      The petitioner shall execute a bond for Rs.3 lakhs with two<\/p>\n<p>solvent sureties each for the like sum to the satisfaction of the learned<\/p>\n<p>Magistrate;\n<\/p>\n<p>\n<span class=\"hidden_text\">B.A.No.3727 of 2007                          2<\/span><\/p>\n<p>         ii)     The   petitioner   shall   make   himself   available   for<\/p>\n<p>interrogation   before   the   Investigating   Officer   between   10   a.m   and   1<\/p>\n<p>p.m on all Mondays and Fridays until further orders;<\/p>\n<p>         iii)    The   petitioner   shall   not   leave   the   Sessions   divisions   of<\/p>\n<p>Kollam   until   further   orders   without   appropriate   direction   of   the<\/p>\n<p>learned Magistrate.\n<\/p>\n<\/p>\n<p>                                                             (R.BASANT, JUDGE)<\/p>\n<p>rtr\/-\n<\/p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Anilkumar vs State Of Kerala on 20 June, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 3727 of 2007() 1.
