complainant eementions\ufb01of the accused being the absolute owners<\/p>\n
“of  question who were granted land by the<\/p>\n

 ‘ScheduId”e–d Tribe. and entitled to get the property purchased from<\/p>\n
 lie refers to acquisition of title by the accused on<\/p>\n
 24.4’.–ll ’31” and also admits they are in continuous possession.<\/p>\n
it ‘fiowe–v:er, he contends that. the accused had executed General<\/p>\n
 of Attorney in his favour and in terms of the same he<\/p>\n
V. executed a deed of sale on 5.5.2006. The reason for obtaining<\/p>\n
General Power of Attorney is that, there was a bar for<\/p>\n
registration of sale deed.\n<\/p>\n

9. The second stand is that he has constructed compound<\/p>\n
wall to secure the property which the accused demolishedwith<\/p>\n
an intention to extort Rs.6,00,000\/~ from him. He H<\/p>\n
in possession for two years but the averments in the CD:Ii’~1p.lC1iI)’1t,V <\/p>\n
belie that statement.\n<\/p>\n
10. Be that as it may, in the  itself there <\/p>\n
mention that the complainant ha.d”\u00bbpaid llany’ .ainount”‘toll: the it<\/p>\n
accused towards the value oyfthe property’\/sale priceand even in<\/p>\n
his evidence befo;rell\u00a7h-ep    of obtaining
\nGeneral Power    which he executed the
\nsale deed   Ramadevi. Nowhere he
\nclaims to   value of the property to be<\/p>\n
entitled to _ownelr’shipi.Kionsedtiently it is to be noticed that, on<\/p>\n
 the complainaritl claims to have gone to the land in<\/p>\n
asked the accused why they demolished the<\/p>\n

 gives ta different version. According to him a shed on the<\/p>\n
 property”‘~*Nas demolished. There is no mention of compound<\/p>\n
V”  Accused have put a direct suggestion of PWi that the<\/p>\n
 yggaccused had obtained permission from the Panchayat and put<\/p>\n
 up a shed on the property. This suggestion though denied by<\/p>\n
PW} is fully proved by evidence of PW2. Apart from it even if we<\/p>\n
consider this evidence, in its totality it is a case of the<\/p>\n

complainant. going over to the land which the accused claim to<\/p>\n
be their own. There is no dispute that the accused_”h,ad”,”not2<\/p>\n

It is only the complainant who has exec-u’ted* -:,loc”urn_ents’.1ik:e=sale’;<\/p>\n
deed by Virtue of alleged (Power) authority conferred ._<\/p>\n
deed or General Power of Attorney–,:itself “ill the
\naccused have denied having executed’. any suchwdociurnents.
\nTherefore, the charge for v’A.:$er:tion 447 was
\ncertainly not tenable,::As_   the offence is
\npunishable undei’  Vll?C,,f_’thgelcolmplainant himself
\nsays that ac()use’d..wahtted’  towards the sale price
\nof the property..   demand was raised it goes
\nout of mischiefu of  because Rs.6,00,000\/– was<\/p>\n
clgaimedyytfolwards Value: of the property and not illegal demand<\/p>\n
termed. in law as eictortion. That charge also fails.<\/p>\n
   threat to the life of the complainant is<\/p>\n
concerned, it is ‘ noticed that, the accused had not gone to the<\/p>\n
‘ro\ufb01incyident or to the place of the complainant. It is the<\/p>\n
 pon1pl.ai’nar1t who had gone to the land of the accused, which<\/p>\n
i l–ar1d”according to him was owned by them.<\/p>\n
12. The Trial Court was right in considering all the
\ncircumstances to record that the evidence falls short legal proof<\/p>\n
to establish charges levelled against the accused. The acquittal<\/p>\n

of the accused by the Trial Court: is just and proper, nee\u00e9is no
\ninterference.\n<\/p>\n
In the circumstances revision is rejected.<\/p>\n
