Mishra &amp;\n                                                 :Mr.Brij Kishore Misra\n                            For the State        :Mr.Jharkhandi Upadhyay,APP\n                                                              -----------\n<\/pre>\n<p>2.   29.10.2010               Heard learned counsel for the petitioners and the<\/p>\n<p>                  State.\n<\/p>\n<p>                              Petitioners are aggrieved by order dated 02.02.2009,<\/p>\n<p>                  passed by learned Special Judge, West Champaran at Bettiah in<\/p>\n<p>                  S.T.No.403 of 2008, whereby their application preferred under<\/p>\n<p>                  sections 227 and 228 Cr. P.C. for discharge under section 3(i)(x)<\/p>\n<p>                  of the SC\/ST Act has been considered and rejected on the<\/p>\n<p>                  ground that there is\/are sufficient materials available on record.<\/p>\n<p>                              Learned counsel for the petitioners while assailing<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>the order submits that   going by the allegations contained in the<\/p>\n<p>FIR, the allegation of humiliating the informant in his caste<\/p>\n<p>name followed by assault is directed against only one accused<\/p>\n<p>person, namely, Brij Kishore Thakur. As per the FIR lodged on<\/p>\n<p>10.04.2001 at 7.00 P.M. the informant was sitting at the canal<\/p>\n<p>when accused Brij Kishore Thakur came there and started<\/p>\n<p>calling his caste name which was protested whereafter other<\/p>\n<p>accused persons joined him and assault was inflicted upon the<\/p>\n<p>informant and other persons who had assembled at the said place<\/p>\n<p>on the alarm raised by the informant. Petitioners are facing<\/p>\n<p>prosecution under    diverse sections    of the Penal Code read<\/p>\n<p>with section 3(i)(X) of the SC\/ST Act. It is also contended on<\/p>\n<p>behalf of the petitioners    that due to previous animosity as<\/p>\n<p>reflected from different FIRs it would appear that there was<\/p>\n<p>hostility between the parties. It is also the contention that the<\/p>\n<p>police submitted charge-sheet under diverse sections of the<\/p>\n<p>Penal Code but not under sections 379 and 436 IPC and section<\/p>\n<p>3(i)(X) SC\/ST Act.\n<\/p>\n<p>            It appears that against one of the accused persons,<\/p>\n<p>namely, Sujit Thakur charge sheet was submitted under diverse<\/p>\n<p>sections of     IPC including section 3(i)(X) SC\/St Act.<\/p>\n<p>Subsequently, another charge sheet was submitted against rest of<\/p>\n<p>the accused persons in which allegation constituting offence<\/p>\n<p>punishable under section 3(i)(X) SC\/ST Act was not found to<\/p>\n<p>have been substantiated. It further appears from records that<\/p>\n<p>learned Magistrate differing with the said report had taken<br \/>\n<span class=\"hidden_text\">                            3<\/span><\/p>\n<p>     cognizance under diverse sections of IPC as also section 3(i)(X)<\/p>\n<p>     SC\/ST Act.\n<\/p>\n<p>                  At the stage of framing of charge, the court has to<\/p>\n<p>     only consider as to whether there is\/are sufficient evidence on<\/p>\n<p>     records justifying proceeding further with the case\/trial. The plea<\/p>\n<p>     of the petitioner that the present allegation has been levelled due<\/p>\n<p>     to animosity and that there is         no allegation against the<\/p>\n<p>     petitioners constituting offence under section 3(i)(X) SC\/ST Act<\/p>\n<p>     shall be appraised at the trial. Law is fairly settled that even<\/p>\n<p>     on a grave suspicion based on materials on record, accused has<\/p>\n<p>     to be put on trial. This Court does not find any patent illegality<\/p>\n<p>     in the order meriting interference.\n<\/p>\n<p>                  In view of observations hereinabove, the petitioner<\/p>\n<p>     shall have liberty to raise\/agitate all these issues at the relevant<\/p>\n<p>     stage of the proceeding.\n<\/p>\n<p>                  With the liberty aforesaid, the application is<\/p>\n<p>     disposed of.\n<\/p>\n<\/p>\n<p>                               ( Kishore K.
