Singh\nRespondent Counsel :- C.S.C.\nHon'ble\u00a0Krishna\u00a0Murari,\u00a0J.\n\nHeard\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0petitioner\u00a0and\u00a0learned\u00a0Standing\u00a0Counsel.\n\nIn\u00a0view\u00a0of\u00a0the\u00a0peculiar\u00a0facts\u00a0and\u00a0circumstances\u00a0of\u00a0the\u00a0case,\u00a0no\u00a0useful\u00a0purpose\u00a0\n\nwould \u00a0 be \u00a0 served \u00a0 by \u00a0 keeping \u00a0 this \u00a0 matter \u00a0 pending \u00a0 by \u00a0 calling \u00a0 for \u00a0 a \u00a0 counter\u00a0\n\naffidavit \u00a0 and \u00a0 with \u00a0 the \u00a0 consent \u00a0 of \u00a0 the \u00a0 learned \u00a0 counsel \u00a0 for \u00a0 the \u00a0 parties, \u00a0 the\u00a0\n\npetition\u00a0is\u00a0being\u00a0finally\u00a0disposed\u00a0of.\n\nFacts<\/pre>\n<p>\u00a0 giving \u00a0 rise \u00a0 to \u00a0 the \u00a0 dispute \u00a0 are \u00a0 that \u00a0 under\u00a0 the \u00a0 order\u00a0 dated \u00a0 03.04.2010\u00a0<\/p>\n<p>passed\u00a0by\u00a0Joint\u00a0Director\u00a0of\u00a0Education,\u00a0Vindhyachal\u00a0Manda.,\u00a0Mirzapur,\u00a0fresh\u00a0<\/p>\n<p>elections\u00a0of\u00a0the\u00a0committee\u00a0of\u00a0management\u00a0of\u00a0Janta\u00a0Janardan\u00a0Shiksha\u00a0Sadan\u00a0<\/p>\n<p>Inter\u00a0College,\u00a0Tilaon,\u00a0Lalganj,\u00a0Mirzapur\u00a0are\u00a0to\u00a0be\u00a0held.\u00a0By\u00a0the\u00a0same\u00a0order,\u00a0the\u00a0<\/p>\n<p>District\u00a0Inspector\u00a0of\u00a0Schools,\u00a0Mirzapur\u00a0has\u00a0been\u00a0appointed\u00a0as\u00a0Election\u00a0Officer\u00a0<\/p>\n<p>to\u00a0conduct\u00a0the\u00a0election.\n<\/p>\n<p>Learned\u00a0counsel\u00a0for\u00a0the\u00a0petitioner\u00a0contends\u00a0that\u00a0the\u00a0election\u00a0program\u00a0has\u00a0not\u00a0<\/p>\n<p>yet \u00a0 been \u00a0 notified \u00a0 by \u00a0 the \u00a0 Election \u00a0 Officer \u00a0 appointed \u00a0 under \u00a0 order \u00a0 dated\u00a0<\/p>\n<p>03.04.2010.\u00a0It\u00a0is\u00a0further\u00a0contended\u00a0by\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0petitioner\u00a0that\u00a0in\u00a0<\/p>\n<p>view\u00a0of\u00a0the\u00a0fact\u00a0that\u00a0a\u00a0first\u00a0information\u00a0report\u00a0has\u00a0been\u00a0lodged\u00a0by\u00a0him\u00a0against\u00a0<\/p>\n<p>the\u00a0District\u00a0Inspector\u00a0of\u00a0Schools\u00a0on\u00a005.05.2010,\u00a0he\u00a0has\u00a0no\u00a0hope\u00a0of\u00a0fair\u00a0election\u00a0<\/p>\n<p>being \u00a0 conducted \u00a0 with \u00a0 the \u00a0 District \u00a0 Inspector \u00a0 of \u00a0 Schools, \u00a0 Mirzapur \u00a0 as \u00a0 the\u00a0<\/p>\n<p>Election\u00a0Officer.\n<\/p>\n<p>Attention\u00a0of\u00a0the\u00a0Court\u00a0has\u00a0also\u00a0been\u00a0drawn\u00a0to\u00a0a\u00a0letter\u00a0dated\u00a022.05.2010\u00a0written\u00a0<\/p>\n<p>by \u00a0 Joint \u00a0 Director \u00a0 of \u00a0 Education, \u00a0 respondent \u00a0 no. \u00a0 3 \u00a0 to \u00a0 Additional \u00a0 Director \u00a0 of\u00a0<\/p>\n<p>Education\u00a0for\u00a0appointing\u00a0any\u00a0other\u00a0officer\u00a0as\u00a0Election\u00a0Officer\u00a0in\u00a0place\u00a0of\u00a0District\u00a0<\/p>\n<p>Inspector\u00a0of\u00a0Schools.\n<\/p>\n<p>Considering\u00a0the\u00a0totality\u00a0of\u00a0the\u00a0circumstances\u00a0and\u00a0in\u00a0the\u00a0interest\u00a0of\u00a0justice,\u00a0the\u00a0<\/p>\n<p>Court\u00a0feels\u00a0it\u00a0appropriate\u00a0to\u00a0direct\u00a0the\u00a0Joint\u00a0Director\u00a0of\u00a0Education,\u00a0Vindhyachal\u00a0<br \/>\n Mandal,\u00a0Mirzapur,\u00a0respondent\u00a0no.\u00a03\u00a0herein\u00a0to\u00a0appoint\u00a0any\u00a0other\u00a0suitable\u00a0officer\u00a0<\/p>\n<p>to \u00a0 function \u00a0 as \u00a0 Election \u00a0 Officer \u00a0 to \u00a0 conduct \u00a0 the \u00a0 election \u00a0 of \u00a0 the \u00a0 committee \u00a0 of\u00a0<\/p>\n<p>management\u00a0of\u00a0the\u00a0institution\u00a0in\u00a0question\u00a0within\u00a0a\u00a0period\u00a0of\u00a0two\u00a0weeks\u00a0from\u00a0<\/p>\n<p>the\u00a0date\u00a0of\u00a0production\u00a0of\u00a0a\u00a0certified\u00a0copy\u00a0of\u00a0this\u00a0order\u00a0before\u00a0him.\u00a0The\u00a0Election\u00a0<\/p>\n<p>Officer\u00a0so\u00a0appointed\u00a0by\u00a0respondent\u00a0no.\u00a03\u00a0shall\u00a0thereafter\u00a0proceed\u00a0to\u00a0hold\u00a0the\u00a0<\/p>\n<p>election\u00a0and\u00a0shall\u00a0complete\u00a0the\u00a0exercise\u00a0within\u00a0a\u00a0period\u00a0of\u00a0two\u00a0months\u00a0from\u00a0<\/p>\n<p>the\u00a0date\u00a0of\u00a0his\u00a0appointment.\n<\/p>\n<p>With\u00a0the\u00a0aforesaid\u00a0directions,\u00a0the\u00a0writ\u00a0petition\u00a0stands\u00a0finally\u00a0disposed\u00a0of.<\/p>\n<p>17.06.2010<br \/>\nVKS\/\u00a0WP\u00a035515\/10\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Vijay Narain Singh (Manager) vs State Of U.P.
