This Miscellaneous First Appeal is filed under
\nSection 173(1) of the Motor Vehicles Act, 1988, against
\nthe judgment and award dated 31.10.2007 passed in
\nMVC No.426\/ 2002 on the file of the Presidirigl’Oi”ficer,<\/p>\n
Fast Track Court-V <3: Additional IVEACT,
\nallowing the claim petition for compensation._and-.seekinlg V' <\/p>\n
enhancement for compensation.\n<\/p>\n
This Appeal coming on for ladrriissiiorrl   ‘ttiie
\nCourt delivered the following; ‘ ”   ‘   ‘-\n<\/p>\n

The appeal coming _o1i forjad.rniAs’si\u00bbon is considered
\nfor final disposal, “1f”C\u00a7ard\u00abV.’tol’lthe facts and
\ncircumstances.  ‘ 0\n<\/p>\n
2. The” appellafntl =was about 42 and she was<\/p>\n
employedlassllavtalilorp,  she had met with an accident<\/p>\n
 in serioii–s\u00ab’injuries which required sustained<\/p>\n
  grafting and surgery for removal of<\/p>\n
foreign bodies” and damage caused to major nerves of her<\/p>\n
lgleft elbow. As a result of the same, even after treatment,<\/p>\n
i.,:”_,shel.jltrJas left with a permanent disability of 40% to the<\/p>\n
 wliinb. According to the medical practitioner. it<\/p>\n
 would translate to a whole hody disability of 20%. The<\/p>\n
Motor Accident Claims Tribunal [hereinafter referred to<\/p>\n

as ‘the Tribunal’ for brevity] however on a claim for
\ncompensation has awarded various amounts in a total
\nsum of Rs.1,79,500\/e with interest thereon. Itfjiseptuliis<\/p>\n
which is under challenge seeking er1ha1icernent,;.t’VV’.___l’  . it<\/p>\n
3. The Counsel for the appellant woulci..l..su.bn:1″rt”ithlatl\u00bbt<\/p>\n
the appellant had to underglo”‘\u00absus\u00abtainedl._ irnedivcalb<\/p>\n
treatment and she has Vproducedl.\n<\/p>\n
expenditure exceeding Rs.”}i.gC4,00tl\/\u00ab.u.,_l <\/p>\n
however has granted’~the .e\u00a7\u00a7actlj4arrl()Aunt to the ruppee<\/p>\n
while:’tign’ori.ng   that””there are other expenses
\nwhjchxare..nVo[.  bills. and the appellant was<\/p>\n
entitled aslla inatterl’oflc’oL1rse. The Tribunal insisting on<\/p>\n
 l:)’il1s~-.wouldlpiace the appellant at a disadvantage<\/p>\n
  ai1d’theijet*oie_.”_11e has been denied of a just compensation<\/p>\n
towards .rr1’e.:liCal expenses.\n<\/p>\n
 Counsel would also submit that the income of<\/p>\n
uh’V-.Ath.erappe11ant has been taken at Rs.l.500\/–. though she<\/p>\n
ll   .._was capable of earning more than Rs..’3000 to Rs.4iOOO\/~<\/p>\n
per month as a tailor. T he compensation has thus been<\/p>\n
reduced under various tgxds. on the basis of the low<\/p>\n
income attributed to the appellant. The appellant is thus<\/p>\n
entitled to loss of income during the period of treatment.<\/p>\n
She is also entitled to loss of future ea1’nJI:ng’<\/p>\n
on account of the permanent disability she’ “hla_rblours and”. <\/p>\n
the Counsel would submit  <\/p>\n
miscellaneous eXpenditure,l_ “‘!zgIhich’v~ has   ~just1y.l’<\/p>\n
compensated while co11te11di11ugiA”vt_hat the “apypeVI_lant ought
\nto be awarded larger  under the other
\nConventional heacds ofclaim<\/p>\n
4. fi’hhel’CAo.uriseli reslpondeiit on the other hand
\nwould submit  will have to be considered<\/p>\n
on merits  therefore}: the records ought to be called<\/p>\n
“V….,fQr-l:c._,\u00a7_hti’tr.further”lonmthe face of it, the Tribunal having<\/p>\n
  that was suggested by the medical<\/p>\n
practitioner} as on account of the medical practitioner<\/p>\n
ill'”-__lV'”having-…exaggerat.ed the whole body disability at 20%,<\/p>\n
it  the disability in respect of the upper limb was<\/p>\n
  about 40%, this is not in accordance with the accepted<\/p>\n
medical norms and th_erefo1’e, the Tribunal having<\/p>\n
possibly entertained dou .s as to the correctness of the<\/p>\n
assessment has ignored the same. T his Cannot be held
\nto be an infirmity.\n<\/p>\n
Insofar as the medical expenses are con~e.erri_es’d.j; <\/p>\n
the appellant has produced extensive <\/p>\n
the same, it cannot be imagined  <\/p>\n
to produce the other bills ,fo.1j_ other_ve:;pene(jiture.\u00ab. ‘Fhere <\/p>\n
no warrant for enhancing thel’i’arnot1.nte.l   ‘ ”
\nInsofar as the Vc–1ai’–m –‘to\\\u00a7.rard.s\u00bbvvhlo.ss of earning is
\nconcerned, there is m_ate’rial, p’l’acedI_belore the Court.<\/p>\n
The selfvser\\?ing;;1:i’el_jairrtthat she..lvwa’s”‘e’mployed as a tailor<\/p>\n
is not ‘leVid’en.,eed  a_n’3r_”rnatelrial. There is no warrant for
\ninterference, ‘ the award of loss of earning<\/p>\n
capacity or lo’ssll'”of income during the period of<\/p>\n
treat’rr\u00a7ent’;’..ln thlemabsentte of material., the Tribunal<\/p>\n
  atleast, a sum of Rs.l500\/– is also<\/p>\n
wi’t..hoLtt~b\u00e91sis and the-reiore. there is no room for<\/p>\n
 enhancen1ent:.\n<\/p>\n
 ”  Given these rival contentions, suggestion that the<\/p>\n
appeal should be heard on merits, after calling for the<\/p>\n
record may not be necessary. On the face of it, it is seen<\/p>\n
3<\/span><\/p>\n
that the material available and which is referred 1:0 in<\/p>\n
the judgement is adequate for the disposal of this ‘appeal.<\/p>\n
The appellant was an ablewbodied person, <\/p>\n
when she met with accident. Even assumiiigv her, <\/p>\n
avocation as a tailor was not es:tabl.ish}eci–._ it_canw.b.te said<\/p>\n
that she was capable of earning Rs,3l(500\/ <\/p>\n
this is applied insofar as the4ll’lo:ss.uof earning capacity is
\nconcerned, the appeiiaritpwa.s_’en*titled__to a substantial
\nsum which hasbeen    ll<\/p>\n
Insofar’as:-.’th\u00bbe:\u00ab_di_sab\u00ability  concerned, even<\/p>\n
assuming;  there  an incorrect assessment by the
\nmedical.practi–tio’n:er,”\u00ab..__:”ag..—opposed to accepted medical<\/p>\n
norms, this _dis.a,’3i1Ai’L.yl’witli a person with 40% disability<\/p>\n
 “-to  51imb,.would”h’arbour a disability to the whole body<\/p>\n
  20%. This is an area which requires<\/p>\n
expertise  therefore, the medical opinion cannot; be<\/p>\n
  whollyvi.g’noi*ed. However, to err on the side of prudence,<\/p>\n
  -is..’t”app1’opriat.e to adopt the percentage of disability at<\/p>\n
  ..,_.lF3% in which event, applying the multiplier method, the<\/p>\n
appellant would be entitled to a sum of Rs.65,520\/~<\/p>\n
towards loss of earning cgacity.\n<\/p>\n
Further, the appellant would also be entitled to<\/p>\n
atleast three months earnings towards loss of Vtihrieorne<\/p>\n
during the period of treatment and is <\/p>\n
Rs.9000\/\u00bb– towards loss of income du1’in.g,lV_t:lielperiod <\/p>\n
treatment.\n<\/p>\n
Insofar as the rni’se_ellan’eous expenditure ” <\/p>\n
concerned, the Tribunal has  ded of :lRs.6000\/–
\nwhich ought to be V  further sum of
\nRseooo\/-.\n<\/p>\n
Insofar as  inedieal expensesllare concerned, as
\nrightly’il”pointe.d  byfthe _”lCou1’1sel, it is not to be<\/p>\n
expected. that  would document bills in<\/p>\n
respect of t’ne_:lmec’iicia.l expenses to the fullest extent and<\/p>\n
  produced bills to the extent of<\/p>\n
 an indication that she has undergone<\/p>\n
sustained ttreatment Costing much and therefore, it can<\/p>\n
 saleylyi’ presurned that there were other miscellaneous<\/p>\n
 –expenditu1*e bills may not have been produced before the<\/p>\n
 …Ti*ibunal . Hence, the appellant is entitled to a further<\/p>\n
sum of Rs. l5000\/- towards medical expenses.<\/p>\n

The appellant. suffering from a permanent<\/p>\n
disability is ceriiairily deprived of amenities thrciiighout<\/p>\n
her life and therefore, the Tribunal ought.’.’_&>f\u00a3hr’l;”1:a’\u00bbze<\/p>\n
awarded compensation towards loss of a_me_hi.tie–s:;’ f_W’hi’Cl’1x <\/p>\n
in the opinion of this Court woiald  he  <\/p>\n
amount awarded towards pain and suffering. rd in \u00e9; sum’,<\/p>\n
of Rs.25.000\/~ and the samevlvlis.awarded;  ‘
