Thereafter, on 17.09.2008, the matter was adjourned, so<br \/>\nas to enable the respondents to file reply. However, till today, no<br \/>\nreply has been filed. I have heard learned counsel for the respective<br \/>\nparties at length and perused the documents on record.\n<\/p>\n<p>3.\tOn<br \/>\na bare perusal of the impugned order, it transpires that no reasons<br \/>\nhave been assigned by the respondent   authority for effecting the<br \/>\nsaid recovery. The learned AGP appearing on behalf of respondents is<br \/>\nalso not in a position to show that reason\/s  have been assigned by<br \/>\nthe respondent   authority while passing the impugned order. Thus,<br \/>\nonly on the ground that the impugned order is a non-speaking order<br \/>\nand that no reply has been filed by the respondents till now, in<br \/>\nspite of the earlier orders of this Court, the impugned order<br \/>\ndeserves to be quashed and set aside.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, the impugned order passed by respondent no. 2, at<br \/>\nAnnexure   A to the petition, is quashed and set aside. The<br \/>\npetition is allowed. Looking to the status of the original petitioner<br \/>\nand since she had been made to run from pillar to post in order to<br \/>\nenjoy the retiral benefits of her deceased   husband, a cost of an<br \/>\namount of Rs.35,000\/- [Rupees Thirty five thousand only] is imposed<br \/>\non the authority concerned who has passed the order at Annexure   A<br \/>\nto the petition and the said amount shall be recovered from the<br \/>\npersonal account of the Officer concerned.\n<\/p>\n<p>5.\tAt<br \/>\nthis stage, Mr. Parikh, learned AGP, requests to grant some time. It<br \/>\nis a very pitiable and shameful situation that in many matters<br \/>\nwherein the State is required to file its reply, no reply\/s are filed<br \/>\neven after the lapse of a considerable long period. Therefore, the<br \/>\nCourt is left with no other alternative but, to adjourn the matter<br \/>\ntime and again.  Looking to the facts of this case and the reasons<br \/>\ncited herein above, the request made by the learned AGP is rejected.\n<\/p>\n<p>6.\tRegistry<br \/>\nto send a copy of this order to the Chief Secretary, State of Gujarat<br \/>\nand the Secretary, Legal Department forthwith.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
