Col. Avtar Singh Berar (Retd)\nRespondent          -      Delhi Sikh Gurudwara Management Committee\n\n\nFacts<\/pre>\n<p>:\n<\/p>\n<p>By application of 22.4.07 Lt. Col. Avtar Singh Berar of Har Gobind Enclave, Delhi<br \/>\napplied to the President, Delhi Sikh Gurudwara Management Committee seeking<br \/>\nthe following information :\n<\/p>\n<blockquote><p>         &#8220;a)   the source of access to information envisaged under section<br \/>\n               4 of RTI Act (website address, etc.)<\/p>\n<blockquote><p>         b)    name and address of the Public Information Officer,<br \/>\n               designated under section 5 of RTI Act.\n<\/p><\/blockquote>\n<blockquote><p>         c)    name and address of the Appellate authority under section<br \/>\n               19 of RTI Act.&#8221;<\/p><\/blockquote>\n<p>     On not receiving a response Lt. Col. Berar has moved a complaint directly<br \/>\nbefore us with the following prayer :\n<\/p>\n<blockquote><p>         &#8220;3.   I made frantic enquiries over a long period from the office of<br \/>\n               the DSGMC about the source of access to information<br \/>\n               envisages under section 4 (website address, etc.), name and<br \/>\n               address of the CPIOs designated under sec. 5 and name<br \/>\n               and address of the appellate authority under sec. 19 of RTI.<br \/>\n               I remained clueless since no one could provide me the<br \/>\n               relevant information as there was none. In disgust, I wrote a<br \/>\n               letter dated 7.4.2007 (Annexure) sent per speed post mail on<br \/>\n               23.4.2007 and another copy hand delivered under<br \/>\n               acknowledgment vide their diary number 909\/2006 dated<br \/>\n               25.4.2007 to the President, DSGMC asking for the above<br \/>\n               information. I am sorry to submit that I have not received<br \/>\n               any response as yet from the office of DSGMC.<\/p><\/blockquote>\n<p>         4.    In view of the above, I submit this complaint in terms of<br \/>\n               section 18 (1) (a) since I have not been above to submit my<br \/>\n               request to a CPIO of DSGMC for the reason that no such<br \/>\n               officer has been appointed by DSGMC. I request for an<\/p>\n<p><span class=\"hidden_text\">                                               1<\/span><br \/>\n               inquiry by the Commission in terms of the above provisions<br \/>\n              of the Act.&#8217;<\/p>\n<p>     Accordingly, a hearing notice was sent to CPIO and President, Delhi Sikh<br \/>\nGurudwara Management Committee on 14.1.08, but no response was received.\n<\/p>\n<p>The appeal was heard on 10.7.2008. The following are present:\n<\/p>\n<blockquote><p>       Appellant<br \/>\n             Mr. Avtar Singh Berar<\/p>\n<p>       Respondents<br \/>\n            Mr. Nirmal Singh Badhan, PIO (appeared after the appellant had<br \/>\n            left and was heard subsequently)<\/p>\n<p>     Col. Berar invited our attention to the Delhi Sikh Gurudwaras Act, 1971,<br \/>\nunder sec. 3 of which Delhi Sikh Guruwara Management Committee has been<br \/>\nestablished as follows :\n<\/p><\/blockquote>\n<blockquote><p>       &#8220;3(1) With effect from such date as the Central Govt. may, by<br \/>\n             notification in the official Gazette appoint, there shall be<br \/>\n             established a Committee to be called the Delhi Sikh<br \/>\n             Gurudwara Management Committee for the proper<br \/>\n             management and control of the Gurudwara and Gurudwara<br \/>\n             property.\n<\/p><\/blockquote>\n<blockquote><p>       (2)   The Committee shall be a body corporate with the name<br \/>\n             aforesaid having perpetual succession and a common seal<br \/>\n             and shall by such name sue and be sued.\n<\/p><\/blockquote>\n<blockquote><p>       (3)    The Committee shall have its head office in Delhi.&#8221;<\/p><\/blockquote>\n<blockquote><p>      Shri Nirmal Singh Badhan submitted that on learning that the Committee<br \/>\nfalls under the definition of &#8220;public authority&#8221;, he has been designated as PIO<br \/>\nw.e.f. 1.7.2008 and appointment of another PIO and First Appellate Authority is<br \/>\nunder process.<\/p><\/blockquote>\n<p>                           DECISION NOTICE<\/p>\n<p>A public authority under the RTI Act 2005 is defined as follows:\n<\/p>\n<p><span class=\"hidden_text\">                                        2<\/span><\/p>\n<blockquote><p>            Sec. 2(h)<\/p>\n<p>           &#8220;public authority&#8221; means any authority or body or institution of self-<br \/>\n           government established or constituted&#8211;\n<\/p><\/blockquote>\n<blockquote><p>                   (a) by or under the Constitution;\n<\/p><\/blockquote>\n<blockquote><p>                   (b) by any other law made by Parliament; 1\n<\/p><\/blockquote>\n<blockquote><p>                   (c) by any other law made by State Legislature;<\/p><\/blockquote>\n<blockquote><p>                   (d) by notification issued or order made by the appropriate<br \/>\n                   Government,<\/p>\n<p>           and includes any&#8211;\n<\/p><\/blockquote>\n<blockquote><p>                   (i)   body owned, controlled or substantially financed;\n<\/p><\/blockquote>\n<blockquote><p>                   (ii) non-Government organisation substantially financed,<br \/>\n                   directly or indirectly by funds provided by the appropriate<br \/>\n                   Government;\n<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>         From the above, it is clear that the Delhi Sikh Gurudwara Management<br \/>\nCommittee established by law of Parliament, is a public authority. Because this<br \/>\nis accepted by the Committee we need not labour this point. However, this<br \/>\nCommittee appears thus far not to have complied with its obligations under the<br \/>\nlaw. They are now directed to ensure that the necessary infrastructure mandated<br \/>\nu\/s 5 of the RTI Act 2005 is established and made operational by full adherence<br \/>\nto sec. 4, particularly section 4(1)(b), the time limit for compliance of which has<br \/>\nalready expired. This exercise will be completed within one moth of the<br \/>\nissue of this Decision Notice<\/p>\n<p>The complaint is allowed.
