REVISION PETITION NO. 329\/1994\n\n                             Mohan Lal\n                                  Vs.\n                          State of Rajasthan\n\n\n             DATE OF ORDER :: 3rd February, 2010\n\n\n            HON'BLE MR.JUSTICE GOVIND MATHUR\n\n\nMr. Rajesh Joshi, for the petitioner.\nMr. O.P. Singaria, PP for the State.\n\n\n        This revision petition as per provisions of Section 397 read\n\nwith    Section    401   Cr.P.C.   is    preferred   to   assail   validity,\n\ncorrectness and propriety of the judgment dated 7.9.1994\n\npassed by learned Additional Sessions Judge, Pali in Criminal\n\nAppeal No.15\/1994, affirming the judgment dated 5.2.1994\n\npassed by learned Additional Chief Judicial Magistrate, Pali\n\nconvicting the petitioner for the offence punishable under Section\n\n7\/16 of the Prevention of Food Adulteration Act, 1954. The trial\n\ncourt    after    recording   conviction   as   above,    sentenced     the\n\npetitioner for six months' rigorous imprisonment with a fine of\n\nRs.1000\/- and in default of payment of fine, further to undergo\n\none month rigorous imprisonment.\n\n\n\n        While challenging the judgments impugned, the contention\n\nof the learned counsel for the petitioner is that the trial court\n                                 2\n\nfailed to appreciate that the formalities referred under Section 13\n\n(2) of the Prevention of Food Adulteration Act, 1954 (for short\n\n'the Act of 1954' hereinafter) were not observed, inasmuch as,\n\nno timely action was taken by the competent officer for sending\n\nthe report of chemical examiner.\n\n\n\n     It is also stated that the offence alleged is said to be\n\ncommitted on 18.7.1984 whereas the petitioner received the\n\nreport on 17.9.1984 i.e. quite a belated stage. Learned counsel\n\nfor the petitioner also pointed out that retention of the sample\n\nfor petty long time, deteriorated condition of edible article and\n\nthat gave a wrong finding relating to adulteration.\n\n\n\n     I have examined the orders impugned and also entire\n\nrecord of the case.\n\n\n\n     Whatever arguments raised by the learned counsel for the\n\npetitioner before this Court, as a matter of fact, have been\n\nappropriately considered and dealt with by both the courts\n\nbelow. The issue relating to compliance of Section 13(2) of the\n\nAct of 1954 is considered by the appellate court and a definite\n\nfinding is given that there was no procedural error and if there\n\nwas any irregularity that has not caused any prejudice to the\n\naccused. It is also noticed by the appellate court that a copy of\n                                   3\n\nthe enquiry report was sent to the accused by registered post\n\nand that is adequate compliance of the provisions of Section 13\n\n(2) in view of the judgment of the Hon'ble Supreme Court in AIR\n\n1985 SC 299 (Tulsi Ram Vs. State of Maharastra).\n\n\n\n      Looking to the entire position as stated above and on the\n\nbasis of examination of record, I am not inclined to interfere with\n\nthe judgments impugned while exercising powers under Section\n\n397 read with Section 401 Cr.P.C. as there is no manifest error.\n\n\n\n      Accordingly,   the   conviction   recorded   stands   affirmed.\n\nHowever, so far as, the sentence awarded is concerned, suffice it\n\nto mention here that in the year 1984 age of the accused-\n\npetitioner was of 58 years and now he is of about 85 years. At\n\nthis advance age, it shall not be in the interest      of justice to\n\nremit him to undergo remaining sentence, thus, I consider it\n\nappropriate to substitute the sentence awarded by a fine of\n\nRs.20,000\/- in addition to the period already undergone by the\n\npetitioner in custody.\n\n\n\n      The revision petition stands disposed of, accordingly. The\n\nconviction as affirmed by the appellate court is maintained.\n\nHowever, the sentence awarded is substituted by a fine of\n\nRs.20,000\/- with the sentence for a term already undergone in\n                                4\n\ncustody.
