Justice K.T.SANKARAN\n\n Dated :31\/03\/2010\n\n O R D E R\n                          K.T.SANKARAN, J.\n             ------------------------------------------------------\n                       B.A. NO. 1856 OF 2010\n             ------------------------------------------------------\n             Dated this the 31st day of March, 2010\n\n\n                                O R D E R\n<\/pre>\n<p>      This is an application for anticipatory bail under Section 438 of<\/p>\n<p>the Code of Criminal Procedure.             The petitioner is the second<\/p>\n<p>accused in Crime No.170 of 2010 of Nilambur Police Station.<\/p>\n<p>      2.   The offences alleged against the accused are under<\/p>\n<p>Sections 341, 294(b) and 353 read with Section 34 of the Indian<\/p>\n<p>Penal Code.\n<\/p>\n<\/p>\n<p>      3. The prosecution case is that on 4.3.2010, the accused<\/p>\n<p>persons committed the offence and wrongfully restrained the Medical<\/p>\n<p>Officer of the Taluk Head Quarters Hospital, Nilambur.                It is<\/p>\n<p>submitted that the overt acts alleged against the petitioner do not<\/p>\n<p>really constitute the offence under Section 353 of the Indian Penal<\/p>\n<p>Code.    It is not necessary to decide that question in this Bail<\/p>\n<p>Application.     However, taking into account the facts and<\/p>\n<p>circumstances of the case, the nature of the allegations levelled<\/p>\n<p>against the petitioner and the overt acts alleged against the<\/p>\n<p>B.A. NO. 1856 OF 2010<\/p>\n<p>                                      :: 2 ::\n<\/p>\n<p>petitioner, I am of the view that anticipatory bail can be granted to<\/p>\n<p>the petitioner.\n<\/p>\n<\/p>\n<p>       4. There will be a direction that in the event of the arrest of the<\/p>\n<p>petitioner, the officer in charge of the police station shall release him<\/p>\n<p>on bail on his executing bond for Rs.15,000\/- with two solvent<\/p>\n<p>sureties for the like amount to the satisfaction of the officer<\/p>\n<p>concerned, subject to the following conditions:<\/p>\n<blockquote><p>       a)     The petitioner shall report before the investigating<br \/>\n              officer between 9 A.M.        and 11 A.M. on alternate<br \/>\n              Mondays, till the final report is filed or until further<br \/>\n              orders;\n<\/p><\/blockquote>\n<blockquote><p>       b)     The petitioner shall appear before the investigating<br \/>\n              officer for interrogation as and when required;\n<\/p><\/blockquote>\n<blockquote><p>       c)     The petitioner shall not try to influence the prosecution<br \/>\n              witnesses or tamper with the evidence;\n<\/p><\/blockquote>\n<blockquote><p>       d)     The petitioner shall not commit any offence or indulge in<br \/>\n              any prejudicial activity while on bail;\n<\/p><\/blockquote>\n<blockquote><p>       e)     In case of breach of any of the conditions mentioned<br \/>\n              above, the bail shall be liable to be cancelled.\n<\/p><\/blockquote>\n<blockquote><p>       The Bail Application is allowed to the extent indicated above.<\/p><\/blockquote>\n<p>                                                     (K.T.SANKARAN)<br \/>\n                                                             Judge<br \/>\nahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Najeeb P.A. vs State Of Kerala on 31 March, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 1856 of 2010() 1.
