JOSEPH, JJ.\n                  -------------------------------\n                 W.A.NO.1738 OF 2008 ()\n                -----------------------------------\n        Dated this the 20th day of August, 2008\n\n                      J U D G M E N T\n<\/pre>\n<p>KOSHY,J.\n<\/p>\n<\/p>\n<p>     Petitioners have appeared for the examination conducted<\/p>\n<p>by the Public Service Commission for selection to the post of<\/p>\n<p>Medical Officer (Homeo) in the Homeopathy Department.<\/p>\n<p>Rank list was published with effect from 15.3.2004.        Few<\/p>\n<p>candidates approached this Court initially on publishing the<\/p>\n<p>rank list stating that the number of persons shortlisted is less<\/p>\n<p>than the number required. This Court by Ext.P4 judgment<\/p>\n<p><a href=\"\/doc\/1129593\/\">(Ajayan v. State of Kerala<\/a> (2006 (3) KLT 854) directed<\/p>\n<p>the Public Service Commission that when the list is prepared,<\/p>\n<p>sufficient number of persons should be shortlisted.      While<\/p>\n<p>shortlisting the candidates as observed by the Supreme Court<\/p>\n<p>in <a href=\"\/doc\/957587\/\">State of Punjab and others v. Manjit Singh and others<\/p>\n<p>(AIR<\/a> 2003 SC 4580), number of vacancies that may occur<\/p>\n<p>during the currency of the list should be considered.         A<\/p>\n<p>direction was also given to publish the additional list and<\/p>\n<p>advise candidates for the vacancies reported during the<\/p>\n<p><span class=\"hidden_text\">W.A.1738\/08                       2<\/span><\/p>\n<p>currency of the list.         Accordingly, the PSC has given<\/p>\n<p>appointments to some other candidates. Contention of the<\/p>\n<p>petitioners is that they were also entitled to be shortlisted but<\/p>\n<p>they filed the writ petition only after the expiry of the rank list.<\/p>\n<p>Ext.P4 judgment (Ajayan&#8217;s case (supra) was passed in July<\/p>\n<p>2006. The above judgment was reported also. In the above<\/p>\n<p>case, it was also held that those who have not challenged the<\/p>\n<p>list till that date will not be entitled to get the benefits as they<\/p>\n<p>have slept over the matter for years. But they moved this<\/p>\n<p>Court only after the dismissal of the Special Leave Civil<\/p>\n<p>Appeal filed by the PSC before the Supreme Court (Ext.P5)<\/p>\n<p>much after the expiry of the rank list in 2008. Petitioners<\/p>\n<p>were sleeping and therefore, they are guilty of latches. After<\/p>\n<p>the expiry of the rank list, their case cannot be considered.<\/p>\n<p>We agree fully with the reasonings of the learned Single<\/p>\n<p>Judge.
