No. 9070\/2008\n6\/05\/2010:\n      Shri Ashok Lalwani, Advocate for the applicant.\n      Shri Imtiyaz Hussain, Advocate for the respondent<\/pre>\n<p>no.1\/complainant.\n<\/p>\n<p>      Shri Arvind Singh, Panel Lawyer for the State.<br \/>\n      Applicant\/accused has filed this petition u\/s 482 of Cr.P.C<br \/>\nagainst the order dated 8\/09\/2008 passed by VIIIth Additional<br \/>\nSessions Judge, Bhopal in criminal revision no. 269\/08 confirming<br \/>\nthe order dated 6\/05\/2008 passed by JMFC, Bhopal in criminal<br \/>\ncase no. 6071\/07 whereby the trial Court has refused the<br \/>\npermission to summon District Mining Officer as defence witness.\n<\/p>\n<p>      Respondent no.1\/complainant has filed a criminal complaint<br \/>\nu\/s 138 of the Negotiable Instruments Act in respect of the cheque<br \/>\ndated 30\/04\/2007 of State Bank of India, Chola Road, Bhopal<br \/>\nalleged to have been given by the applicant to respondent in<br \/>\nconnection with purchase of stone crusher for the price of Rs. 12<br \/>\nlacs in part payment.     When the case was fixed for defence<br \/>\nevidence on 1\/04\/2008, the accused has moved an application<br \/>\n(Annexure A-8) for summoning the District Mining Officer,<br \/>\nBhopal as witness u\/s 254 of Cr.P.C because by a notice State has<br \/>\ndemanded Rs. 1,41,000\/- as dues regarding this crusher whereas<br \/>\nrespondent has admitted in the purchase agreement that no dues are<br \/>\npending and further he will be liable to pay all dues of this crusher<br \/>\nduring his ownership.\n<\/p>\n<p>      The application for summoning the District Mining Officer<br \/>\nwas rejected by JMFC, Bhopal vide order dated 6\/05\/2008. The<br \/>\n applicant has filed the revision against the said order wherein the<br \/>\nprayer of the applicant to summon Mining Officer was rejected and<br \/>\nrevisional court has confirmed the order of learned trial Court in<br \/>\nthe revision. The applicant has filed the petition u\/s 482 of the<br \/>\nCr.P.C alleging that the order of learned trial Court declining the<br \/>\nprayer for calling the District Mining Officer is unwarranted by the<br \/>\nlaw and as such, the impugned order passed by both the courts<br \/>\nbelow should be set aside and opportunity should be provided to<br \/>\napplicant to examine the District Mining Officer as defence<br \/>\nwitness.\n<\/p>\n<p>      Learned counsel for the applicant Shri Ashok Lalwani has<br \/>\nsubmitted that arrears regarding dues of State Government can be<br \/>\nproved by Mining Officer. Learned counsel further submitted that<br \/>\nin   case   u\/s   138   of   the   Negotiable    Instruments   Act,<br \/>\ncomplainant\/respondent must prove that cheque was drawn by the<br \/>\naccused for payment of any amount of money to complainant for<br \/>\nthe discharge of whole or in part of any debt or any other liability<br \/>\nand accordingly, Mining Officer is a proper person who can prove<br \/>\nthat respondent\/complainant has to deposit dues in treasury,<br \/>\napplicant is willing to pay remaining amount to respondent.\n<\/p>\n<p>      In view of the fact that applicant is not challenging the fact<br \/>\nthat impugned cheque was signed and delivered to the respondent<br \/>\nregarding sale of the stone crusher, both the courts below have not<br \/>\ncommitted any mistake in rejecting the prayer of the applicant to<br \/>\ncall District Mining Officer as a witness u\/s 254 of Cr.P.C.\n<\/p>\n<p>       In Krishnan v. Krishnaveni (1997) 4 SCC 241, Apex Court<br \/>\nexplained the scope and power of the High Court under Section<br \/>\n 482 of the Code. The question before the Court was if in view of<br \/>\nthe bar of second revision under sub-section (3) of Section 397 of<br \/>\nthe Code was prohibited, inherent power of the High Court is still<br \/>\navailable under Section 482 of the Code. The Apex Court said as<br \/>\nunder :\n<\/p>\n<blockquote><p>            &#8220;Ordinarily, when revision has been barred<br \/>\n            by Section 397 (3) of the Code, a person &#8211;<br \/>\n            accused\/complainant &#8211; cannot be allowed to<br \/>\n            take recourse to the revision to the High<br \/>\n            Court under Section 397 (1) or under<br \/>\n            inherent powers of the High Court under<br \/>\n            Section 482 of the Code since it may amount<br \/>\n            to circumvention of the provisions of<br \/>\n            Section 397 (3) or Section 397 (2) of the<br \/>\n            Code. It is seen that the High Court has suo<br \/>\n            motu power under Section 401 and<br \/>\n            continuous supervisory jurisdiction under<br \/>\n            Section 483 of the Code. So, when the High<br \/>\n            Court on examination of the record finds<br \/>\n            that there is grave miscarriage of justice or<br \/>\n            abuse of the process of the courts or the<br \/>\n            required statutory procedure has not been<br \/>\n            complied with or there is failure of justice or<br \/>\n            order passed or sentence imposed by the<br \/>\n            Magistrate requires correction, it is but the<br \/>\n            duty of the High Court to have it corrected at<br \/>\n            the inception lest grave miscarriage of<br \/>\n            justice would ensue. It is, therefore, to meet<br \/>\n            the ends of justice or to prevent abuse of the<br \/>\n            process that the High Court is preserved<br \/>\n            with inherent power and would be justified,<br \/>\n            under such circumstances, to exercise the<br \/>\n            inherent power and in an appropriate case<br \/>\n            even revisional power under Section 397 (1)<br \/>\n            read with Section 401 of the Code. As stated<br \/>\n            earlier, it may be exercised sparingly so as to<br \/>\n            avoid needless multiplicity of procedure,<br \/>\n             unnecessary delay in trial and protraction of<br \/>\n            proceedings. The object of criminal trial is<br \/>\n            to render public justice, to punish the<br \/>\n            criminal and to see that the trial is concluded<br \/>\n            expeditiously before the memory of the<br \/>\n            witness fades out. The recent trend is to<br \/>\n            delay the trial and threaten the witness or to<br \/>\n            win over the witness by promise of<br \/>\n            inducement. These malpractices need to be<br \/>\n            curbed and public justice can be ensured<br \/>\n            only when trial is conducted expeditiously.&#8221;<\/p><\/blockquote>\n<p>      No reason exist whatsoever, to doubt the correctness of the<br \/>\norder of the Court of revision by which the impugned order of the<br \/>\ntrial Court was confirmed.\n<\/p>\n<p>      It is well settled that the inherent power are exercised for the<br \/>\nlimited purpose very sparingly where there is an apparent<br \/>\nmiscarriage of justice. Further, the second revision is barred under<br \/>\nSection 397 (3) of the Cr.P.C and the power of Section 482 Cr.P.C<br \/>\nis not exercised to circumvent the bar of second revision under<br \/>\nSection 397 (3) of the Cr.P.C as held in Madhu Limaye Vs. State<br \/>\nof Maharashtra, AIR 1978 SC 47 .\n<\/p>\n<p>      On facts and in the circumstances, no case is made out for<br \/>\nexercising of jurisdiction u\/s 482 of the Cr.P.C. Consequently, this<br \/>\npetition fails and is hereby dismissed. Trial Court is directed to<br \/>\ndisposed of case (criminal case no. 6071\/07) as expeditiously as<br \/>\npossible within four months.\n<\/p>\n<p>      Certified copy as per rules.\n<\/p>\n<p>                                             (S.C.
