DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 08\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with first information report registered at<br \/>\n\tCR No.I 67\/2010 with Sarkhej Police Station,  Ahmedabad for the<br \/>\n\toffences punishable under Sections 395, 346, 365, 323, 327, 504,<br \/>\n\t506(2), 114 etc. of the Indian Penal Code and section 135 of the<br \/>\n\tBombay Police Act.\n<\/p>\n<p>Learned<br \/>\n\tSenior Advocate appearing for the applicant submits that the<br \/>\n\tapplicant is falsely involved in the offence.  Learned Senior<br \/>\n\tfurther submits that the complainant has given criminal colour to a<br \/>\n\tcivil dispute by creating a false story and by filing false<br \/>\n\tcomplaint.  He further submits that there is no direct or indirect<br \/>\n\tevidence against the present applicant.  Considering the overall<br \/>\n\tfacts and circumstances of the case, the applicant may be enlarged<br \/>\n\ton bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP for the respondent &#8211; State.\n<\/p>\n<p>Heard<br \/>\n\tlearned counsels for the parties and perused the record of the case.<br \/>\n\t The following main aspects are considered; (i) charge sheet is<br \/>\n\tfiled; (ii) the complainant, who is in no uncertain terms averred in<br \/>\n\tthe complaint that he had earned money out of gamble;  that the<br \/>\n\tgeneses of the complainant is allegedly ill-gotten wealth of Rs.1,90<br \/>\n\tcrores and recovery of the said amount for which the complainant was<br \/>\n\tabducted and beaten, as alleged; (iii)   FIR and the above<br \/>\n\tbackground in which the complaint is filed are required to be kept<br \/>\n\tin mind;  (iv) if the complaint is read as a whole it reveals the<br \/>\n\trole of the accused herein and at his instance certain acts have<br \/>\n\tbeen done; (v) one of the co-accused is enlarged on bail by the<br \/>\n\tco-ordinate bench of this Court in Criminal Misc. Application<br \/>\n\tNo.4595 of 2010; (vi) other co-accused who have been denied bail<br \/>\n\tapproached Apex Court and the Apex Court confirmed the same<br \/>\n\tconsidering the different roles attributed to them; (vii) at the<br \/>\n\tmost if the allegations are read in the context of the incident,<br \/>\n\twhich is taken place, now the investigation is over and there is no<br \/>\n\tlikelihood of the applicant tampering with any evidence or<br \/>\n\tinfluencing witnesses. Considering the overall facts and<br \/>\n\tcircumstances of the case, I am inclined to enlarge the applicant on<br \/>\n\tbail.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith first information report registered at C.R. No.I 67\/2010 with<br \/>\n\tSarkhej Police Station,  Ahmedabad, on executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five thousand only) with one surety of the like<br \/>\n\tamount to the satisfaction of the trial Court and subject to the<br \/>\n\tconditions that he shall;\n<\/p>\n<p>not take undue advantage of<br \/>\n\tliberty or misuse liberty;\n<\/p>\n<p>not act in a manner injurious to<br \/>\n\tthe interest of the prosecution;\n<\/p>\n<p>surrender passport, if any, to the<br \/>\n\tlower court within a week;\n<\/p>\n<p>not leave the State of Gujarat<br \/>\n\twithout prior permission of the Sessions Judge concerned;\n<\/p>\n<p>mark presence at the concerned<br \/>\n\tpolice station on the first Sunday of every month between 10.00 a.m.<br \/>\n\tand 3.00 p.m. for three months only;\n<\/p>\n<p>furnish the present address of his<br \/>\n\tresidence to the I.O. and also to the Court at the time of execution<br \/>\n\tof the bond and shall not change the residence without prior<br \/>\n\tpermission of this Court;\n<\/p>\n<p>The<br \/>\n\tAuthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
